True but the key word here is 'transform'. KZbinrs typically want to believe that minimal transformation is ok. But in reality, you need to transform the clip enough for it to be unrecognisable. So if i watch your video and it's pretty obvious that your clips are from a TNT or ESPN coverage, they are not transformed enough to classify as fair use. Basically, making a mixtape with a bunch of visual effects is not transformation.

What about on Streams? I stream live sporting events for local teams, and when I do this, they sometimes have a DJ. So, technically, I am not PLAYING the music, but my crowd mics are picking up the music, which is causing KZbin to flag the nat sound. Now, obviously, I could turn off the nat sound, but then i'll lose the ambience, so I don't want to do that.

Unfortunately that's pretty standard for situations like yours. It doesn't make any difference for KZbin (or for the rights owner for that matters) if the music is there on purpose or if it just happens to be playing in the background. It's the same thing. Like you said, you can either turn off the mics or you could wait to see which parts of your stream are claimed and mute only those segments through KZbin studio.

I don’t know where you got that information but there’s absolutely no chance of it being true. It would be a terrible business move to charge certain people millions of dollars for something and then give the same thing for free to others. The fact that you got a strike once and not the other time just confirms what I said in the video. This is not an exact science. Sometimes you get away with it and sometimes you don’t. But it doesn’t mean you’re doing the right thing and it doesn’t mean you can’t eventually get a strike a month or a year down the line.

@@realkingproductions yes exactly. If you just get a copyright claim you can still use the video but you won't make any money from it. The money goes to the copyright owner who triggered the claim. That's exactly what I said in the video. Same rules apply to the channels you just mentioned. Just because they are getting a lot of views doesn't mean they are making a lot of money. Or, if they know what they are doing, they are making money another way like with sponsorships for example. But ultimately, no matter who you are, if you use NBA footage you can't know for sure before posting a video if it will get a copyright claim or if it will be blocked or if you'll get a strike. It's a gamble every time.

Well what is most likely to happen is that one or more music tracks will get detected and claim the ad revenu from your video. Worst case scenario, your video could be blocked because of the use of one track in particular but, in that case, you would be given the option to simply mute that part of your video which in your case I assume wouldn’t be a big deal.

I had my recent videos of UFC 285 taken down after only about 8 hours of being uploaded. I did upload the video footage of a few fight and it had the original comentary. They straight up blocked all 4 videos right as they were getting up in the thousands of veiws. I did however reach out to see if they woukd retract it of if there was any way to get permission to use the content. I havnt heard back yet but I just sent the email about an hour ago.

I hate to break it to you but that’s never going to happen. The UFC’s #1 source of income after maybe their ESPN deal, is pay per view revenue. Letting people upload fights for free would destroy that. Especially within 24hrs of the fight taking place. The only difference for a viewer between watching the fight on KZbin and watching it on pay per view is that one is free and the other one is $60. So the UFC is always going to do everything they possibly can to stop people from doing what you tried to do and I can totally understand why.

Getting views and making money are two different things. Like I said in the video, just because a video is getting views, doesn't mean it is monetized. I don't know the channel you mentioned so I can't speak on their situation but if you make the same videos as them and get copyright claims, it means they most likely get them as well. And regarding social blade, they don"t have access to any financial info. All they do is multiply the views by the amount of money per view that channels typically make in the same country. Their numbers are as random as a Family Feud survey.

Just because there are ads doesn’t mean the money goes to them. If there’s a copyright claim, the money from the ads goes to ESPN & FS1.
