You can also not expect a criminal to follow the laws set in place. After you’ve actually beaten the criminal and have him in a court of law, you actually have a list of laws the criminal’s broken to charge him on. The same applies to war, where after one side beats the other they can individually charge individuals with war crimes as opposed to just accepting a surrender and letting war criminals go. They did this at the Nuremberg trials to bring justice to immoral individuals without having to punish the rest of the country. You know, justice, something some people care about beyond “what happens in war stays in war.”
