While that would be a hilarious movement, the best way is to boycott them. People need to stop buying their products and they need to stop showcasing anything Nintendo in KZbin videos and streaming platforms. Downvote all their official videos, stop playing games like Smash or Splatoon in the competitive scene etc. Unfortunately, I don’t think there’s many of us that are that pissed to make a sizeable dent in their profits. It's not KZbin as much as the actual copyright laws that are the issue. If Nintendo releases a takedown request, and KZbin denies it, KZbin is attesting that it is not infringement, and is considered liable if it IS infringing KZbin has little to no incentive to do this, and with the way the law is written, Nintendo has little reason NOT to do this if they can even make the vague arguments they made here. We need copyright reform that has a clause to prevent frivolous claims.

Ironically, seeing more piracy might just make them even more draconian and obsessed with IP enforcement, meaning even more strikes, takedowns and lawsuits. It’s a vicious cycle. The gaming community isn’t ever going to stop with emulation and piracy, and Nintendo likely isn’t going to compromise either-if they lose any sales at all because of it they might just blame the lost sales on piracy itself and come down even harder. The most possible solution seems to be for piracy and emulation to be driven underground far enough that the tech-savvy can still access them but they’re sufficiently out of sight that Nintendo don’t feel “threatened” by them, and possibly DMCA-compliant enough that they have no grounds to sue…but that seems incredibly far away at the moment.

More and more I'm given a reason to not really support Nintendo in any capacity moving forward. Now they are just being petty (I'm aware they've BEEN petty for a long time now) but this is honestly childish. You could have just sent Russ an email or something to take the videos down or edit them and that would have at least been more acceptable than striking the whole damn channel. I have a switch v1 and switch lite that I really don't play because of other various reason, but I think it is time for me to sell them because I just can't get behind these movies Nintendo is making towards emulations as if anyone is doing anything wrong. It isn't piracy and even if people are pirating them games, so tf what? Y'all don't even want to reserve them properly! You're not losing any money here, AT ALL. I don't condone the high price in games, mediocre games that come with high prices, subscription fees within gaming that continue to go up, but with more mediocre offerings, but we have to do it because a company wants to "better align their resources". Unrelated in a way, but don't even get me started on Sony because my PS5 has been sitting on a shelf for over a year, but that's neither here nor through. These companies can do what they want and not do what they SHOULD do in order to be more engaging and listen to the community in terms of what we actually want within reason.

With IP being a form of property, Nintendo is essentially a heavily restrictive IP landlord. What they want with their old releases and their IPs is more than just immediate profits-it’s absolute control. They want to be the only way of obtaining those games, and for everyone to come through their pipelines, subject to their availability, at their determined costs-and if that’s the case, then not selling at all is better than selling for less. It’s a rent crisis-they’d rather keep the rent high on empty homes than lower the prices for tenants who pay less. In fact, given how they seem to deploy scarcity as a tactic sometimes, I’d see their lack of access to older games as a tool for raising demand and keeping fans hungry. That’s why retaining the exclusive ability to market their retro offerings is such a big goal for them-they value the ability to turn a higher profit on rereleases in the future far greater than accessibility today. And emulation is the one thorn in this whole system. By providing convenient access at higher quality than the original system, and for completely free, on any system, it pokes a hole in their tightly limited system of control through which their “tenants” can escape. Little surprise they hate it so much.

Why risk it unless you have nothing to loose and your willing to go down fighting with a company with an unlimited legal budget. Nintendo’s pr side won’t be affected because the core fan base who buy all the latest games and products will still buy them. Parents will simply still buy their kids games and people all around the world will. I don’t think turning the emu or retro community against them will be the end of Nintendo or affect them enough to matter to them. It shucks for those who own said games and want them to live on and be archived and enjoyed for the future but unfortunately it’s just not worth the risk fafo’ing with them anymore. Rus, I wish you well brother and I pray they leave you alone and I hope they were just trying to shake you and not stop you. My best advice is to preemptively take down any spicy content or anything clips they could actually strike if they wanted to. Maybe just clip out the gameplay segments or use the blur tool we have access to on the youtube studio side on pc. Please brother don’t give up. ❤

The retro community is half of Nindo's fan base because they rely on nostalgia to sell fans on an old Plumber and every other game they bought endlessly from them in the last 20 years. The ones that hate the thought thata few people playing an old game they way they want to and not the way the corporation wants you to will always be there lifting the massive anti-consumer juggernaut up on their pedestal, but the more people whittle away at the free publicity by not talking about their products or revisiting childhood memories (that Nindo claims to own the rights to) the more quiet the nostalgia gets after a while. Unfortunately, it could take decades of constant vigilance to really have an effect... But it doesnt mean we shouldnt start.

Nintendon't want to collaborate with content creators that way because it cuts into their profit. These corporations forget that as long as people have a desire to play the content, they'll find a workaround to play the games that they enjoy on different devices. Nintendo can't profit off the end users creativity and intelligence. Nintendo does not like the idea of their software being played on non-Nintendo hardware. Lets not make them the topic of conversation. They're directly hurting our friends. And a better response than speaking with your wallet, is speaking by letting something disappear into obscurity. Covering news on them is supporting them. And supporting a company that is actively damaging the gaming hobby. The content creators, the devs who aren't nintendo, abusing the legal cases with the weight of their size not with true just cause. They're beneither even piracy at this point (well, at a point well before this). I don't understand supporting companies damaging your loved hobby, damaging your friends. Even if Russ supports still covering and playing Nintendo games, it's just beyond completely backwards to me. We can have better. We should have better. Make it happen everyone. Make them disappear into irrelevance. It's vile filthy behavior they are exhibiting. And it's damaging. Outright damaging. Claiming this wont' do anything is false too. Of course it won't make them dissaprear, but there is NO END of gaming news. Focus on indies. Focus on positive things in our beloved hobby. It won't make nint en d fade away completely, but it will rise other things up. Put them in front of people. Generate new hype for companies that are adding to the industry, not subtracting (ex. through patenting game mechanics so no one can use a mechanic, is hurting all of us immensely).

Nintendo shenanigans, is why anything pre switch....is morally 100% fine to pirate. ....and all the negative PR will keep feeding the Streisand effect of WHY everyone Pirates the Big N. Note that there's no such computer as the Amstrad. Amstrad released a wide variety of computers in their day, including various models of the CPC and the PCW. Software for one doesn't necessarily run on the others, at least not without modification, so in a news story about software for an Amstrad computer, it's always helpful to name the actual model concerned.

The best thing to do about Nintendo imo is to give them exactly what they want industry wide. They don't want their games featured in youtube videos? Censor them out, no free advertising. They don't want you downloading roms to digitally backup your Nintendo games? Don't buy their games in the first place. They don't want you emulating their consoles? Don't buy their consoles in the first place. Just desserts.

Why is Nindo doing it? Petty greed, Of course they're trying to make an example of him honestly any image of any Nindo character he puts on screen from a screen shot to a random T-shirt puts him at risk if they aren't already going back through hours of footage looking for something old he did to strike him again. Again, I say if they don't want people to use their IP openly either in gaming videos or reviews then banish Nindo to the realm of obscurity, stop giving them free visibility, change the art in your fan games so they can't nuke you, and say screw those guys for their pettiness, we don't need their IP. Just look at some of the Sonic fan games that evolve into full non Sonic products without Sega even lifting a finger.

I play all Nintendo games on PC, so f*ck'em. Loving the Wii and Switch on my PC. Sometimes if I really like a game though, I will buy a copy for somebody I know with actual hardware. That's as far as I go though with Nintendo. However, KZbin gives them the power to bully people, so KZbin is really who people should blame.

We need some kind of legal precedent that fully protects "Fair Use" because fair use is NOT a fully fledged law. We also need to make MODERN laws protecting consumers rights to back up their games. ...but this stuff takes money what are we gonna do? Crowd fund it?

I'd say that's why Nintendo continually picks on the little guys, knowing they won't take the next step fearing Nitendo's cash will buy a judge/jury. It'll be far more difficult for Nintendo to prove their case, where they'll be required to follow laws and provide factual evidence backed by those laws, rather than with KZbin's useless copyright system. it only takes 1 person to stand up to them and win to show everyone it can be done.

Need to fight back every way we can. Host your own videos on your own server. Don’t cover anything Nintendo can get free advertising for on something they currently sell. Don’t watch Nintendo monetized content and don’t buy Nintendo products (this will be a hard one for me, I was looking forward to Switch 2). If you are a developer, don’t release on Nintendo platforms. If you for some reason own the rights to anything shown in the background of a Nintendo owned video on KZbin, file a claim. Message Nintendo and KZbin about the issue. If Russ goes to court we need community funding for a lawyer.

Nintendo can bully people because nobody wants to take it to court. But I wonder if somebody were to actually take them to court, how much could they sue out of Nintendo for threatening people, unlawful copyright claims, taking away people's livelihood and such. @LegalEagle what's your take on this? If it's a winnable case would anyone take it pro-bono just to stop corporate bullying?

They are targeting him. The first strike was for showing a Switch Game on a Nintendo Switch - both of which Russ legally paid for and owns. It's one thing if it was on a third party device, but if you're arbitrarily removing someone's right to showcase your games on your hardware, that means every content creator that depends on Switch content - like Poke-Tubers - are at risk. If Nintendo considers playing the games you bought from them on their official hardware as piracy, then what don't they consider as piracy? Not playing any Nintendo game at all and only buying them like the cash cow that you are?

This is heartbreaking on two fronts: Obviously it's sad to see a juggernaut go after someone who is widely considered to be one of the "good guys" (both in the value of his content, and the way he treats others) in the retro game community. It seems like once he did the dumper, they were all in on his channel. I'm surprised they didn't go for a third strike. I believe MVG had to fight them for doing the same thing. Had he didn't have the dumper, they probably wouldn't even bother him. Also, I thought when you get a strike that youtube would stop you from uploading. I hope he appeals because they can try to take down your channel. I would think Taki had issues as well. Nintendo are bullies and they are going to strike whatever they is a threat and they're petty. Even though, the tech is not illegal. Nintendo is known for teaching people lessons. That's why so many websites etc have been shutdown.

It's a shame how far Nintendo is going; basically they go against those, that grew up with their products through the 8 & 16-bit era which are no longer up for official sale; that is the same people that bring their kids (maybe even grand kids by now) towards the brand; hope their sales plummet as they deserve it, I won't spend another dime on them; even piracy shouldn't be an issue as some suggest, that would indicate that their catalog of the last 40 years still has immense value; it has not, what has value (especially for Nintendo) is our nostalgia and memories and they keep on dissapointing with their BS stance on game preservation.

If Retro Game Core's channel is struck down all the videos on that channel could become lost media. I always had concerns that the digital land scape is another big part of human history, history that's at a constant threat of being lost because of stunts like that. So many moments historical or not happen on the Internet that become lost to time and people usually don't think twice. The Internet is a big part of our history now whether people like it or not and it's concerning how much easier it is to manipulate history through it now.

About Russ - I would suggest blurring any such footage from older videos as well. Unfortunately it's not very plausible to be able to do that for all his videos before he gets a third strike. He can try the small claims court - most companies default on such cases - but he can only claim damages for up to $10K.

I don't believe in Patron, but I will back russ up financially if there is a safe way to do it. I don't like the idea of someone getting their platform away taking from them against their will unjustly. He helped me learn how to use moonlight, and opened up the door to a whole new world of legal handheld gaming. It's so good that i'll never need to buy a new console for about 7 years as long as 720p is still a thing on PC gaming.

What I find funny is that the guy must be the retro games KZbinr with the most original Nintendo games. I saw some of his videos where he shows his long and vast collection of cartridges. He always advocates for the proper use of retro games, so I don't understand why Nintendo is keeping such a close eye on him.

The problem with fair use and nintendo is that they don't know anything like that in japan. It would be interesting to fight it out. After all, if they publish outside japan, they would also have to comply with the laws of those countries.
