A civil altercation with a landowner at Little Shurdington near Cheltenham.
This road has been signed on the ground as a bridleway for a number of years despite being marked as an unclassified road (ORPA) on the various OS maps that I have access to, along with the rights of way map on the Gloucestershire County Council website.
A conversation on 08.10.13 with KP from Gloucestershire County Council's rights of way department confirmed that:
1. The right of way is incorrectly signed as a bridleway.
2. The right of way is a mixture of class 5 & 6 highway.
KP explained that class 5 highway is maintained to a basic standard for use by wheeled vehicles, and could be found at either end of the right of way.
Class 6 highway compromises the middle section of the right of way and crosses open farmland on a semi-defined track. KP explained that this was usually maintained to pedestrian standards, unmettled (unpaved) and is usually 'unsuitable for wheeled vehicles'.
This particular stretch of class 6 highway is too narrow for anything other than pedestrian, horse, cycle and motorcycle. It connects Little Shurdington to Cold Slad.
The landowner had blocked our path and we were both ready to turn back when an unexpected change of heart allowed us to proceed.
How do you think I handled the confrontation? Please be respectful to the landowner (you're welcome to speak your mind towards me!).

Great way to handle a negative confrontation. This could have easily escalated into something much worse but you were polite and in the end it paid off. So many times being kind and courteous gets you so much further than the alternative.

Diffused the situation!!! Lmao. The situation wouldn't have existed if the prick wasn't on the land in the first place. Her concern was one of worrying fouls and live stock and as you know, coming from an agricultural background, can be an offence all on its own. He was wrong to go onto the land once it was made clear that there were livestock wondering freely. And at the beginning!!! Such arrogance, personally I'd have buried you mate.

Driverguy999 It's a road, he's allowed to ride there, she just thinks she is the gatekeeper. She shouldn't be allowed to let her livestock run freely near a public road, who cares for an animal when a human life could be at risk. I'd go out of my way to constantly use that road now, just to fuck her off.

I'm getting sick of these landowners who are always trying to block off public access by using their own property as a barrier to public land - they put up gates - de-activate public roads payed for by tax payers, and place signs no trespassing signs in places that are in fact open to public - good for you for standing up to this sort of crap it's getting worse and these types of landowners need a wake up call.

First I thought she was being genuine. Eventually I realised she was trying it on. You were calm but stood your ground and tried to show her she was wrong. Well done. Land owners must realise that when they buy land that straddles a right of way, people are going to want to traverse it.

A role model indeed. If you are 100% confident in the lane you are driving, stay calm, you will generally come out of the confrontation on top. If you need to turn back do so , but be exhaustive in your reasoning first. Well done sir.

Smashing way to speak with this lady. Having ridden solo and with the TRF years ago, I can agree that speaking with landowners at every opportunity almost always clears the air about right of access for 2 wheeled vehicles on clearly indicated byways (some folk - trf riders included - forget that horse-drawn carts sometimes only have 2 wheels as well!) Stay safe and ride safe.

all of these people commenting saying that we would have shot you yes in your country but we are not in your country were in uk before you comment do some research and bike users are they really commiting an offence does it hurt anyone because they like a nice ride in the country just like people like to ride there horses in the country there is a minority that will go through there tear the grass up but to be honest grass grows back not to be a arsehole but its not like there destroying her crop they even had the politeness too still talk to her in a polite manor when she knew she was in the wrong because why didnt she take his plate or go get her beloved maps too prove she was right he did so yes you can have a go at the bikers but they had there proof and if she didnt believe them then she should of got the maps out and proved them wrong because how can you prove facts in an arguement with no evidence and top blokes these are

I walked the Imber path around Salisbury Plain a few years back and the signs didn't match the GPS, so I knocked on someones door and asked. Apparently some farmers don't like you using public paths on THEIR land, so they rearrange the signs!! Well handled!

Kinda funny, in Belgium we have what is called a "servitude weg" which basically means it can be private property but the owner is required by law to keep it open as a road to the public. You try putting up a gate or blocking passage... you get fined big time and if you keep it up you might lose ownership on the road itself...

WiltshireByways well you’d guess wrong, the tranquility of a farm depends entirely on how it’s running. I could have sworn she said there was livestock but hey ho, Not trying to pick a fight cause having watched a few of your videos you’re clearly not doing anything to rile people up on purpose.. however surely you have to be able to see it from her point of view? She’s lived there for 50 years, a public right of way is fine but there’s a massive difference between someone walking that route and someone using it on a dirt bike The point in trying to make is this is in no way comparable to living near an airport and not expecting planes, I’d suggest it’s almost the polar opposite. I work on farms - what on earth would I know? The road (not a right of way) was there in 1883 when OS surveyed it for their 1884 25" map, so has been in use well beyond the lifetime of any living person. Whilst the lady did say that the livestock were present in the fields, the subsequent video (also on this channel) confirms that no animals were present.

Killing with kindness... Had similar situation where police stopped us entering a legal right of way because the landowner (a woman) threatened to shoot any motorcycles that used it. My suggestion that the police should be dealing with the person issuing the threats should be dealt with was ignored by the police.

Thank you Eric. I hope you can understand my frustration with the people who choose to ride unregistered, uninsured and untaxed motorcycles in an unaccountable way. Thankfully they are a minority, but people still choose to hold me responsible for their conduct. To me, the motorcycle is all that we share in common. They are more 'criminal' than 'motorcyclist' to me.

Stopping for horse riders has never been an issue for me, and I have never spooked a rider or given one cause to complain about my conduct..

***** I enjoy legally riding tails as part of a longer ride. This trail saves a few miles of riding on the road and I had ridden it without issue before. I've never 'clashed' with horses - not in 20 years. Just this weekend I helped out at a horse endurance event with 100 or so horses. The horses, riders, and organisers are all happy to have motorcyclists help out because there is no 'clash with horses' unless you intend to cause one. I think this lady knew full well that a road ran through her property and that at some point people would want to use it. The horses she mentioned were not bothered in the slightest by our presence and in any case could be kept away from the road if she actually was worried about them.

Well done on staying so cool. Unfortunately we do have motorcyclists riding reckless that do tar us all with the same brush. And as a result we have residents on routes at the end of their tethers at times. Remaining calm and cool and polite, and proceeding. Well done.

A byway in the United Kingdom is a track, often rural, which is too minor to be called a road. These routes are often unsurfaced, typically having the appearance of 'green lanes'. Despite this, it is legal (but may not be physically possible) to drive any type of vehicle along certain byways, the same as any ordinary tarmac road. In 2000 the legal term 'restricted byway' was introduced to cover rights of way along which it is legal to travel by any mode (including on foot, bicycle, horse-drawn carriage etc.) but excluding 'mechanically propelled vehicles'. On 2 May 2006 the Countryside and Rights of Way Act 2000 reclassified all remaining Roads Used as Public Paths as restricted byways. The public's rights along a restricted byway are to travel:[1] on foot on horseback or leading a horse by vehicle other than mechanically propelled vehicles (thus permitting e.g. bicycles, horse-drawn carriages, to travel along restricted byways), except in certain circumstances.

I think you are being generous. The "misinformed" landowner was happy it seemed to be and stay misinformed. If it was little effort on your part to confirm the status of the way then it would have been just as simple for the landowner but it seems not in her best interests for 50 years. Personally I would have accepted her position to reduce confrontation, not taken her offer of access to make sure her blockade of the right of way was the result of the exchange then via registered post contacted her with a copy the documentation confirming the right of access and that you would be taking advantage of that access in the future. The video footage is all to the good in these situations.

Your knowledge and research is impressive. Your manners and basic decency are exemplary. Perhaps this, clearly distressed woman, really cannot cope with her property being on a public road. I feel for her but she needs to accept that the world does not revolve around her and that other people have rights as well. He doesn't need her permission to go about his lawful business. I can understand that no-one wants to encourage high powered enduro machines screaming through as if there is a race on - the vast majority of trail riders I encounter when walking the old byways are super considerate and as quiet as practicable - they also do a good job of keeping roads maintained.

Yes, she's a good person with valid concerns. I've since chatted with her husband having used the road and found that we have a fair bit in common.

Expertly handled. If only more people could deal with confrontation so calmly and politely. The gushingly thankful card was a bit much though -- I'd have written one to the authorities complaining about the incorrect signing. :-)

Not when I last used the road, some nine months ago. There are other unmade roads within the county that are signed as bridleways and footpaths, though thankfully they're not.

You appear to have the legal right to ride along that path and could have insisted and pushed your way through. What you actally did was show restraint and speak calmly and logically to the lady. I think the confrontation was handled very well, considering. I am glad that, on this side of the pond, we don't see the need to wave firearms at each other to resolve disputes.

Thanks, though I had no right to move her even if I had felt so inclined. Touching her would have technically been an assault/affray, which is a much more serious offence than Wilful Obstruction of the Highway, which I think in this instance would probably have not been worth police time.

Not really a difference of opinion, the motorcyclists were being objective, and the land owner with either given incorrect information on the right of way or she knew but did no want people using it.

I do not understand why people want to upset landowners, who's animals are in their own fields, for what reason, a few minutes churning up their tracks, how would you like it if it was your garden/land?

It's a public road, as the land owner well knew. Most farmers and land owners respect public rights across their land. As it happened, there were no animals in the field (it had not been churned up). She has lied.

Cheers John. I didn't push them on the sign because I didn't want it to become a contentious issue. Being impassable by car or carriage means it's only really us trail riders who might be confused by the signing. I think everyone else concerned knows full well that it carries vehicular rights. Maybe someone in Gloucestershire could help?

@@MistaJayLJ Wow your comment shows how ignorant you are, It's is a public road, it's marked down on the map and the owner with surrounding land does not have a say on it. they are not cutting across land they are using a road. I suggest you do some research before talking about something you know nothing about. This road is marked as an unclassified road, a step up from a byway, therefore it's also maintained out of tax payers money. They have every right to use it.

Wonderfully handled. Unfortunately the landowner has now locked the field gate and covered it in barbed wire, preventing use of the route even as a bridleway. This was to my chagrin yesterday as I cycled down from Cold Slad; walkers are signed down the stream bed alongside the field behind barbed wire, but that is utterly impassable to horses, bicycles and trail bikes. Alternative routes are thoroughly and securely fenced now.

The Shurdington end of the field - bottom of the hill. It’s the next gate you come to after the gate in this video.

I wish I’d taken a photo now to show you - there’s only a wide field gate which is securely locked, so far as I could find. There was no adjacent equestrian gate.

As a horse rider myself i can see why she isnt allowing you to enter. Horses are timid animals and can spook easily making it a hazard to other people around or riding the horse. This woman had no reason to stop you from dirt biking there as it is a public field. If she was so sure, why didnt she want to go and look for a map she had or even when he showed her that anyone can go in there she still didnt let you go throught which she had no authority over to stop you.

I wish more road users - and motorcyclists in particular - were more understanding of the vulnerability of horse riders. I can pass horses without incident, so other people should be able to too.

***** the cavalry do not except timid horses, the ones they do except go through training on active service the same idea they use for people training for the services,and some are rejected (similar to some people) I have had horses myself in the past and used to train them for the roads by first leading on footpaths then progressing from there so obviously not all are the same temperament and should all be treat with caution

The biker was spot on he wanted to show her on the map. Everybody saying it spooks the horse it's her land etc the woman bought the land or rents it before doing so you would look at the deeds in doing so you would see the byway. There for unluckly the biker has every right to use that road within the law. It's like buying a house next to the motorway and then saying to the council to stop the cars on it cos there to loud. But well done bike you were respectful even if you did have to compramise on your route
