jA byway in the United Kingdom is a track, often rural, which is too minor to be called a road. These routes are often unsurfaced, typically having the appearance of 'green lanes'. Despite this, it is legal (but may not be physically possible) to drive any type of vehicle along certain byways, the same as any ordinary tarmac road. In 2000 the legal term 'restricted byway' was introduced to cover rights of way along which it is legal to travel by any mode (including on foot, bicycle, horse-drawn carriage etc.) but excluding 'mechanically propelled vehicles'. On 2 May 2006 the Countryside and Rights of Way Act 2000 reclassified all remaining Roads Used as Public Paths as restricted byways. The public's rights along a restricted byway are to travel:[1] on foot on horseback or leading a horse by vehicle other than mechanically propelled vehicles (thus permitting e.g. bicycles, horse-drawn carriages, to travel along restricted byways), except in certain circumstances.

I can't remember if it's signed as a BOAT at either end, but it has always been marked as such on maps, and on the Council's own website. I think the man knows that it's a byway and wilfully chooses to obstruct it.
@ColdSpearo10 жыл бұрын
Yes they should be better signed but it most definitely isn't the cause of most situations like this. This land owner just like 99% of all other landowners who complain when people perfectly legally ride past their houses, know full well that it's a byway, and they've always known it's a byway. They just have some demented delusion that because they would prefer it didn't happen, they have the right and the power to stop it. Not quite how the law works I'm afraid. I would have handled it exactly as this fella did, except I would have immediately reported him for ILLEGALLY blocking a public byway, the second I got home.

Who do you go to to talk about byways being unofficially closed? One of my local ones ( only two in my town) have been closed out with multiple gates, fake signs about restricted use were put up and even the little red arrow has been removed ( still listed as a byway everywhere though) seems really unfair and I wonder how many byways we loose from this slow encroachment from land owners. I understand why they've added the gates at the ends, people kept dumping stuff on their access roads but there must be a better alternative.
@WiltshireByways7 жыл бұрын
Those are 'obstructions' in law and need to be reported to your local authority's rights of way team. Where is the byway? Can you give me a grid reference?

WiltshireByways Coordinates on Google maps are 51.7387695, 0.1004709 . If you utilise street view you can see that in that picture there's a blue bridal way arrow how ever it's listed as a b.o.a.t last time I checked in the public byways information folder in the town library. It's also listed as a b.o.a.t on bywaymap.com and when I checked on the ordinance survey app. Here's a link if it helps goo.gl/maps/XkMeoFmh5Bw The post that the blue arrow has been fitted is no longer there. Perhaps I'm in the wrong but seeing as everywhere I checked states it's a byway other than the signage its self it's seems that perhaps some jiggery pokery has taken place. Thanks for your time and assistance in this matter. It's really appreciated. The arrow at the other end of the lane is red ( albiet quite a faded red) which further adds to confusion ha.
@WiltshireByways7 жыл бұрын
Hello again. The interactive rights of way map on Essex CC's website tells me that the byway is recorded as Epping Upland 12. A cross-check with their TRO register: www.essexhighways.org/uploads/PROW/Long%20Term%20TROs%20on%20Byways.pdf identifies that the byway is subject to a seasonal closure affecting four-wheeled vehicles. Motorcycle use appears lawful all-year round, with four-wheeled use only lawful between 1st April and 31st October each year. The barrier should be unlocked during this time and the metal stakes are presumably in place to allow all other users access, including motorcyclists.
@freedomofmotion7 жыл бұрын
WiltshireByways Fantastic thank you so much . The posts have been installed for about 3 years now. The other end of the byway has 3 gates now that are shut at all times. The ones closest to the main road almost entirely close access. I can currently still squeaze by but it's not ideal. On my other channel I have footage where one of the locals stoped me to tell me I wasn't allowed on there. I engaged with them and showed my map and they left thanking me for the education on the subject of byways ha. You've been a great help though as it confirms that the signs have in-fact been out up by the locals with threats of motorcycle confiscation etc.
@WiltshireByways7 жыл бұрын
Well done - some people will try it on but most are willing to be educated. Any issues with access or signage can be taken up with the rights of way department, who are likely quite helpful. When people are unwilling to consider that motorcycle use is lawful, I get off my bike, crouch by my number plate and ask that they take a photo of my face (grinning, with thumbs up) to send to both the local police and rights of way. I'm told by rights of way in Wiltshire that they've not yet received any such photo.

Unfortunately these byeways are starting to see great change. If you revisited Old Coach Road - Wraxall you'd discover that the 6'6" typical byeway has been extended to nearly 20' in places, possibly more, with hard aggregate. This was 6 months or so after a brand new 'byeway, open to all traffic' sign appeared. Wikipedia would describe a byeway as 'often unsurfaced but legal to drive any vehicle along'. Old Coach Road has seen tall trees and hedgerows dissapear causing distruction to wildlife and once beatiful countryside in that area. I'm unaware if this area is included in Wraxall's status as an area of outstanding natural beauty however, I do know it's caused great concern to the local community. A wealthy businessman (name witheld) has bought up land off of part of this byeway and it would seem that development will follow, we're unsure? Am absolutely in agreement that vehicles and horses etc should be able to access these little gems of England but would anyone or indeed this channel owner be able to shed more light? I'm not a lawyer or authority in anyway on such things however I would appreciate the channel owner and anyone who may be able to increase our knowledge on what may be happening to our historical byeways pass comments on this and get their thoughts on new extremely wealthy landowners overdeveloping these? BTW! Enjoy your videos. Many thanks.
@WiltshireByways5 жыл бұрын
Hello. If the public highway (byway) is being unlawfully developed then the first place to report it would be Wiltshire Council's Rights of Way department. Typically, the width of a highway runs from fence to fence (or hedge root to hedge root) as this is also the limit of private ownership.
@ukbiker1631 Жыл бұрын

Good on you. Where we ride in South Africa you can get a mixed bag of landowners. Some don't have much issues having people use the roads etc if they behave and follow the basic rules by closing gates etc but some are extremely hardcore for a variety of reasons. If he is deliberately blocking the byway it is illegal. *Public rights of way: landowner responsibilities* As the owner or occupier of land with a public right of way across it, you must keep the route visible and not obstruct or endanger users, These rules apply to agricultural or any other land. *Find out if there’s a public right of way on your land* Your local authority (national park authorities, county councils, some district councils, metropolitan boroughs or unitary authorities) will normally have a ‘definitive map’ of your area showing public rights of way. Definitive maps are a legal record of public rights of way in 4 categories: Footpaths, Bridleways, Restricted Byways, Byways open to all traffic (BOAT). *Keep public rights of way clear of obstructions* As the owner or occupier of land with a public right of way across it, you must: avoid putting obstructions on or across the route, such as permanent or temporary fences, walls, hedgerows, padlocked gates or barbed wire, make sure vegetation does not encroach onto the route from the sides or above, bearing in mind the different clearances needed for users of different types of route, for example by horse riders. Obstructing a public right of way is a criminal offence. The highway authority has the right to demand you remove any obstruction you cause. If you don’t, the highway authority can remove the obstruction and recover the cost from you. You must not disturb the surface of byways, restricted byways and unsurfaced public roads, eg: by cultivating. *Field-edge and cross-field public rights of way* You must not cultivate (eg plough) footpaths or bridleways that follow a field edge. The minimum width you need to keep undisturbed is: 1.5 metres for a field edge footpath, 3 metres for a field edge bridleway. You should avoid cultivating a cross-field footpath or bridleway. If you have to cultivate make sure the footpath or bridleway: remains apparent on the ground to at least the minimum width of 1 metre for a footpath or 2 metres for a bridleway, and is not obstructed by crops is restored to at least the minimum width so that it’s reasonably convenient to use within: 14 days of first being cultivated for that crop, 24 hours of any subsequent cultivation, unless a longer period has been agreed in advance in writing by the highway authority. *Waymarking and warning signs* If official waymarking leaves it unclear where a public right of way goes, you may add informal waymarks to remedy this so long as these are not misleading. You must indicate the route of a reinstated cross-field footpath or bridleway. If necessary, use signs to warn users of any dangers that are not obvious, such as slurry lagoons. Note that erecting misleading signs (such as signs about absent bulls) is an offence and local authorities have powers to remove them.
@WiltshireByways7 жыл бұрын
Yes, it’s an obstruction pursuant to S130A of the Highways Act. Compelling a local authority to undertake their statutory duty is a much more tricky task to pin down.
