When my father passed i administered his estate myself. I found the proper forms online, completed them and started the probate process myself. I outlined all his assets and ɓills on the propert forms. The judge named me as executor. My siblings did not object. I sold my dads house to my sister. Sold his car to my 2nd cousin and gave the proceeds to my sister as she lived in the same state as my dad and helped a lot with his care. I filed the tax returns. The estate was closed out successfully. I wouldnt recommend this for everyone but for my dads estate it was perfect.

My mother's husband had me in probate court for a couple of years. My mother did have a will in place. I've learned so much about this process. The will is public and useless, and the trust is the golden ticket💞💞..

My grandmother kept taking out mortgages on her once paid off 18k home that my grandfather bought her in the 1960s. One of those mortgages was a variable rate mortgage that totally screwed her & had her mortgage up to $1200 smh. She passed in 2008 during the housing crisis and her home has been vacant ever since. It now has a 45k delinquent tax bill so I gave up on trying to get it back. Sorry grandpa.

This topic is so CRITICAL for the people of Color more than anyone else. Yes, preparing a Family Trust (multiple flavors) is expensive initially (pay once up front) BUT it will save you more than if you go into Probate. Just have a very trustable and money conscious person to be your backup Trustee. Probate is expensive, time consuming and stressful (probate fee, court fees, bond, appraisal, infighting, etc). Just put some money away each week and at end of one year, create your Revocable Living Trust. A Will is fine but you still will have to do Probate. If you can do a Trust now, DO it with a reputable Estate lawyer. Depending where you live, as all Lawyers charge differently, if you are able to save $50 - $100 a week, for one year, you can afford a Trust. Thank you for the program.

We are having difficulty with family members who says they are the trustees but won't give my sisters and me a copy of the Trust. They even turned off home phone and cell phone so we could not contact our step mother. She died in November 2023, we were not told until April 2024 that she passed. Now they are violating the rules of any trust! I have secured a lawyer but they are ignoring his request on my behalf. The originating trust attorney is deceased also. What can we do at this point?

I like that analogy "a Trust is your alter ego." Spot on. And your secondary Trustee should be your alter ego twin. Good point also, make sure the Attorney gives you the ORIGINALLY signed Will or Trust, also make sure you read the Trust and you are named as the Trustee not the lawyer or some other person you did not designate.

Making yourself as the Trustee of your Trust will not protect you for Medicaid or litigation only Probate. Trustee should not be the Settlor or any Family Member. The trust must have its own EIN Number. Paying only $1500, I bet your trust is only good for probate.

We didn’t have a Will either when my mother passed and a lawsuit was pending so the settlement ended up in probate court and I was the executor of the estate. You can’t have felony and creditors came rolling in and Medicare. Medicare got their cut. Creditors tried but they were too late as the money was being set to be released. I split the settlement equally. No disputes or fighting in my case like the many other stories I’ve heard and witnessed from other families.

So glad to see this talked about. I try to get through to some family but they don't always listen. Currently having my kids (adults) at least do POA for health and hopefully finances so if anything happens someone can act on their behalf. Make sure you fully trust the person you choose. Fully Trust!!!! And can i just add stop taking word from people who don't work in that field or using a friend of a friend that knew somebody as their example of what they think should happen. It's a very case by case basis cuz we all have different circumstances. Last one...The price. yeah when she said $1500 I was shocked cuz i thought that was extremely low, paid that for a Will. I was quoted 4000-8000 so I agree with Attorney Barlay. You get what you pay for.

You really can only estate plan for your own affairs, with the hopes that sharing your experience with your family members will encourage them to do the same. It should not difficult appoint persons to operate a trust. It is the same main responsibilities as an executor. I always suggest looking to family and friends first and if not then to professional trustees (accountants, attorneys, banks, etc...). The main focus is to find someone competent. We try to write our trusts without using too much legal language, so a non-lawyer should be able to read the trust and follow the instructions. The trustee should also be capable enough to understand that they can hire professionals (attorneys, accountants, real estate agents, etc...) to help them handle their duties under the terms of the trust. My mom has alwlays told me that there is a will. My selfish greedy, sister went to the same lawyer that mom told me about. The lawyer sided up with her to say, there is no will. I asked the lawyer, how did my sister know to come to you, next to the fire station, my sister liveds in another state. The lawyer said, I don't know. The estate is divided up evenly, but there were accounts which was over 150,000 all taken by that wicked, evil, selfish sister.

I think lawyers prefer the word "shelter" than hide😊 but, there are several options. I think he talked about a few toward the end of this live. But you should speak to an estate attorney, even if just a few hundred dollars for a consultation. They can give you some alternatives.

You would have to get a will or a trust to make sure that happens. Perhaps the other way that is discussed in this video is to deed it to that one child now, but there may be some taxes incured that you did not anticipate. Never put insurance proceeds in trust, unless its for children. Neither put insurance proceeds as part of will since it's taxed. Keep insurance proceeds tax free for beneficiaries so they have cash to address unforseen tax issues, cash flow to buy a house, or for personal legal bills. Putting everything in trust, where trustees can cause problems isn't the best strategy

@ShaheedahHill My wife and I purchased our house for 580k in 2020 when mortgage rates were at a 50 year low. We have 2.7% which is unheard of. That rate allowed us to get more house. 4 years later the markets are all up and the house is worth 1 million now. My best purchase so far.
