LOL, I used the Leek and Dock joke on our Cadets FB page . As for the ferry Rules 15-18 apply, the US version of the ColRegs is silent on ferries and ferry tracks. So unless she is constrained by her draft, she should be the "give-way vessel" and you are the "Stand-on vessel". While they should have altered course/slowed down for you, you conducted yourself properly as the Stand-on vessel, take affirmative steps to avoid a collision. Rule 9 (b) of the INTERNATIONAL Steering and Sailing Rules might apply depending on what the chart in the area say about channel and depth. A ferry track marked on the charts is not the same as a Traffic Separation Scheme, although some crews think that way.

In Australia the rules state that ALL commercial vessels have right of way no matter where the pleasure craft is. Best thing to do is just keep out of their way unless you cannot maneuver because of limited room.

USCG looks at both of us as power driven vessels with no difference between us and commercial vessels or ferries. If the Cap couldn’t give way he/she should’ve made a passing arrangement with us over VHF.

The same in Europe. Commercial vessels have always right of way. But maybe US regulation is different and I don't know what the rules are in international waters. Calling on VHF is always a good idea, in my opinion, because recreational boat users do not always pay attention.

@@mvfreedom Shawn, having transited New York City multiple times on our power boat on the Hudson and East River, I can assure you from experience, the Statten Island ferries will neither call any vessel to get out of their way nor will they alter course as there's too many small boats in the water. After 30+ years of boating using common-sense, in spite of being technically right, is the best way to go. Really enjoyed the video. It's COLREGS; you have to give way to vessels that are limited by draft or maneuverability. Ferries fall into that category.

The Law of Gross Tonnage is an accepted nautical convention that when a sea-going vessel has the right-of-way as established by the International Regulations for Preventing Collisions at Sea, 1972 (72 COLREGS), it should nonetheless give way when faced with a larger vessel.

The ferry shoudn't have to make any manoeuver to avoid a pleasure craft when the difference in size is that obvious. One of the potentially dangerous situations those captains have to cope with on a daily basis is the meatings with all small boats in the fairway. Rule 10. (j) A vessel of less than 20 meters in length or a sailing vessel shall not impede the safe passage of a power driven vessel following a traffic lane. This means that a power driven vessel under 20m or sailing vessel should take early action to allow sufficient sea room to the other vessel. Brg Master Mariner

Here in Australia, I believe the Ferry would have the ROW as it’s operating in a charted ferry route but anyway it’s a lot bigger and heavier than you and you don’t want to mess up and collide as you’ll “come the cropper” ( to use some Aussie slang).

@@timhale4540 Maybe so, but on Sydney Harbour, the ferry's don't go out of their way merely signal with their horns. Yes power vessels are supposed to give way to vessels approaching on their Starboard side but the rules also say that vessels must do everything to avoid a collision and generally much smaller vessels are to stay clear of much larger vessels and if collision occurs, the larger vessel is going to be better off and probably fare better in any legal action.

@@johncanalese588 Yes, under COLREGS, if there is a collision, both boats are at fault. But if the give way vessel doesn't initially take action to avoid a collision, they will fare the worst in any legal action - size doesn't matter. The rules are quite specific: the stand on vessel must maintain course and speed until they believe the give way vessel isn't taking enough action to prevent a collision. And as I previously posted, I'm not going to play chicken with a much larger ship, but use VHF to communicate with the other vessel.

With twin engines you are running twice the maintenance (and costs) of a single engine installation. For coastal trips, I think you have the right configuration. Am I right in thinking that you have a hydraulic bow thruster and that is powered from the wing engine? Final comment - have you tried Rain-X on your windows? If the water runs off rather than dries- it will leave much less salt. As always- enjoyed the vid.

@@br5498 COLREGS doesn't mention or give any preference to ferry routes. When two power driven vessels are in a crossing situation, you have the stand on vessel and the give way vessel. The give way vessel is supposed to maneuver in a timely matter to avoid a collision and the stand on vessel is supposed to MAINTAIN course and speed (until such time as you don't think the actions of the give way vessel would prevent a collision). If Shawn had slowed and then the ferry boat altered course to starboard to avoid the original collision and they ended up in a collision, Shawn would have been at fault. Knowing that most ferry boats ignore the rules and bully their way, I would have hailed the ferry on VHF and agreed upon a solution.

Not what I learned. It is certainly not based on weight, and how are you supposed to determine that if the vessels are of similar size? I know that wasn't the case here but that can't be the deciding factor, makes no sense. Pleasure craft (Freedom is such) must yield to commercial vessels engaged in fishing. Having tackle out doesn't make the boat maneuverable. In this case, I think they had right of way, but seems like the right thing to do to yield to a ferry. I would have done the same.

I was shocked to hear you say that the ferry did not have the right of way. I'm from the Northeast and in my 22 years of captaining boats, ferry boats always have the right of way in established ferry lanes on the water. Curious to know why that is different in your part of the world??

COLREGS is his reference. There is also a link someone else posted below where a ferry boat collided with a pleasure craft and the Captain of the ferry boat lost his license and pay for two weeks because he was the give way vessel and failed to take appropriate action. But with all collisions falling under COLREGS, the other (stand on) boat was also fined for not maintaining a proper watch (boat was on auto pilot while the Captain was in the head) and failure to take action when the give way vessel failed to take timely action.

USCG rules do not give ferries or other commercial traffic privilege over any other “power driven vessel.” The ferry was the stand on vessel to us and should’ve made a passing arrangement over VHF if they couldn’t abide by the rules for whatever reason. They saw us on AIS a long time before crossing and had plenty of time to slow or change course to pass on our stern.

I would love to see a video that has your view when your driving for 15 minutes uninterrupted then 15 minutes from the bow, then 15 from over the side of the bow and to end 15 from the Stern. There are no distinctions between type of power driven vessels. We were both power driven in a crossing situation so we were the stand on vessel.

They do apply; Freedom just didn't have it. Ferries are restricted by draft and maneuverability, therefore other craft must give way.

No, but the stand on vessel still has a duty to avoid collision per COLREG 17- Action by the Stand On Vessel. Think most skippers with chops would have been refreshed about rules and actions after the collision between ferry Chetzemokah and vessel Nap Tyme that occured in December 2016. You don't want to be 50% liable for anything in a collision with a WA state ferry even if the ferry captain makes an error in judgement. See March 2017 issue of Passagemaker magazine.

@@jeremystoltz I'm a sailor, I frequently cross paths with WA state ferries both while under sail and under power. Despite Rule 18 being quite clear about who's stand on vs. give way in a power vs sail scenario, there are exceptions. it would NEVER occur to me to expect a ferry to navigate around me while I was under sail. I know you guys came from SeaRay but how was it coming from 20knots to 10knots? I absolutely love Norhaven, but I can’t get past the slow trawl pace. I know you burn less fuel, but how do you get anywhere quickly? Or is that trade off?

It was very easy because we had already begun cruising around 10knots in the Searay to avoid logs. We started to enjoy the slower and less stressful pace!

How was the cell service at Cypress? And BTW, who are you guys using for Internet now? Verizon, ATT, T-Mobile?

It was great, no issues at all! We have an AT&T hot spot along with a Sprint HS as backup, then cell plans from both Verizon and AT&T.
