Bodycam: Teacher Arrested at School for ‘Drunkenness’ After Alcohol Was Smelled on Her Breath

Body camera footage captures the arrest of an elementary school teacher in Oklahoma for public intoxication after she appeared to be drunk inside her own classroom. Jennifer Davis, the teacher in question, was found by Tecumseh police with red, glassy eyes and slurred speech when they sat down with her at 8:45 a.m. on September 7th. Despite blowing a 0.066 on a breathalyzer test, which is under the legal limit for driving, Davis' behavior raised serious concerns about her ability to properly care for and teach young students.

In the footage, Davis can be heard pleading "Please don't do this," and offering to resign while asking for her sister to come get her. She claimed to have only had a glass of wine the night before, and denied drinking anything on the day of her arrest. However, the evidence of her inebriated state during school hours was impossible to ignore for the responding officers.

There’s a BIG difference between this story and the “drunken teacher” story from weeks ago…they gave the other lady YEARS to find someone to call as she slurred speech and FOUND remnants of alcohol in her CLASSROOM. This lady is just sitting here fine, blew a .06 and given nothing but jail

Exactly. The women from a few weeks ago was given so many opportunities to call a ride, I’d even say they were a little overly patient with her. This women cooperated the whole time and had a ride yet they just arrested her

I was thinking the same thing, you could tell the other lady clearly was drinking at the school. This one doesnt seem like she was. She seemed so nice and calm.

Such a sad world we live in. Getting caught doing something you shouldn’t and losing your job is devastating and humiliating enough. Having the experience blasted all over the internet just makes it ten times worse.

To be fair to the principal; for all we know they were suspicious of her drinking perhaps smelling alcohol on her breath before this day. It's usually not a one off. I've worked as a TA and teacher for 31 yrs.

Man, they did her dirty. Let her resign; no need to take her to jail when she’s under the legal limit and cooperating. The cop even said he could just give her a ticket. That other school teacher from a few weeks ago was way more drunk and NOT making it easy and they gave her a whole hour to call someone. So unfair.

I'm from Oklahoma and have DUI Investigator training, your not supposed guess the BAC in an official report, you are supposed to state what the numbers are in the intoxilizer at the station, not instinct or PBT

@@dougclark9921 she was on benzos too, which will not show up on a breath test. She was very much under the influence, and clearly enough that someone noticed and called the cops about it. This isn't her first time doing this, just the first time she got caught.

Taking a breathalyzer test voluntarily and being told "on another machine you would have tested higher, so you are under arrest" is why you should decline the test every single time.

Someone who is in denial or ignorant of their problem would have behaved more provocative. This day was likely a blessing in disguise as many of us just needed some sort of push or consequence to accept that something needs to change. Unfortunately cancel culture has ruined her job opportunities in that state - there is no benefit in releasing this bodycam footage it should not be on the internet.

Yes the blonde ‘Karen’ was absolutely loving this lady’s ordeal and she definitely wanted this lady to be punished to the fullest extent of the law. Losing her job and her licence to teach wasn’t going to satisfy her she wanted her dragged off in handcuffs and humiliated. As a teacher myself I don't think this needs to be shown as publicly as it is here. Her career in that school and district is over. Hopefully she gets help. However, I also hope other teachers take their careers seriously and not freaking drink on the job....Don't even risk it in the early morning. People don't realize the amount of quick decisions a teacher has to make every minute of the day. Being impaired puts that in jeopardy.

I don't know why this brought tears to my eyes. But something tells me this is a blessing in disguise. She's tired. She probably needs the time off. The people she was working around don't want her there, or they would've handled this differently. I hope she finds work that brings balance and peace. I was thinking that too. She's on Xanax and while under the legal limit, has a good amount of alcohol in her system for being at school. She is clearly suffering with depression. All of these teacher drunk at school arrests lately are really just highlighting how bad the mental health of your average teacher is these days.

She needs help, but she also needs to be held accountable so she gets help. Addicts are notorious for refusing to face their addictions. Consequences are the only answer.

I'm convinced those 3 from the school were the ones who set her up, talking about "she is not coming back" they were quick to pull out the paperwork to get her signature, smdh. The deputy who called the arrest needs retraining because he clearly is making the wrong calls. How is she getting arrested for being below the legal limit WITHOUT driving, without any obvious intoxication signs. This is insane, I hope she got an attorney and sues everyone in that room.

While I agree with most of your post, I have to nitpick part of it. The officer talks about the results of the eye test, which is the part of the test you don't have any conscious control over, and at least according to him, her eyes were all over the place. Granted, the reason the eye test is so foolproof is that even a little bit heavily affects nystagmus. I think that's probably why they always do it first. That being said, 0.066 is hardly anything, really. To throw around the word "intoxicated" is ridiculous. Yeah sure thing, buddy. .004 is intoxicated, anything but 0.00 is intoxicated. They might as well just change the definition of intoxicated to mean "any amount of alcohol remaining in the bloodstream." Seeing as how this is early in the morning, it's even possible the alcohol was consumed the previous night, but if that were the case, she'd gotten pretty hammered that night.

Something like three ipas could stay in your system for nine hours. That’s not even a “crazy” night, I think some people are just unaware of how long alcohol lingers. Obviously it’s wrong the woman came to work with anything in her system… but imo the punishment doesn’t fit the crime here. She needs a wake up call/to change/correct her behavior…but I wouldn’t wish this form of permanent public humiliation on my worst enemy

Idk man. I know plenty of cultured people who don't do that lol. My foster mother was from Germany. She lived there her whole life until she met my foster father and traveled the world. Her son in law, who I met often is from Italy, he came here as an adult and met my foster parents daughter and married and now runs an Italian street cart. None of these people would ever in their right mind go to work after drinking if they worked at an elementary school. It's not an American thing to see an issue with this behavior

This was so sad to watch. He was under the limit, very calm and respectful. She never committed a previous crime and that school principal just had a power trip. I’m appalled at the school officials. This lady didn’t deserve this. They could’ve had someone take her home and resign. I pray this incident doesn’t destroy her emotionally since she seems to already suffer. 🙏🏼

I'm a bartender and I've had employers pay for 2 weeks in rehab for an alcoholic and have the person come back the best employee they have ever been. I know that that sounds crazy to expect an employer to do that but it really works. They will be the most loyal hard working person in the bar/restaurant for years to come.

She should have stood up, and walked out of the building and gone HOME. WALKING, so they couldn't pull her over and give her a DUI. All she would have been in trouble for would have been walking out on her job. Taking a breathalyzer now gives them valid proof to terminate her employment. SMH. And she wasn't even legally drunk! So why was she arrested? I don't understand this at all.

You don't understand the implications of being impaired in a classroom. If anything happened in the classroom, and it came out that she didn't react quickly enough - or maybe her intoxication caused her to say inappropriate things - it's a liability issue. And lets face it - when parents find out that she was intoxicated in the classroom, it's going to be a nightmare. The officers explained that while she wasn't Legally Drunk, she was IMPAIRED. The district and local law enforcement codes make it an arrestable and bondable offense. My biggest problem with all of this is that she doesn't have a Union Rep with her, let alone Legal Counsel. She should have called for either before the Breathalizer and Interrogation and legally they have to provide time for them!

I would love to see it televised if she were to sue. How could she frame it that she had enough alcohol in her system just below the legal limit and the time that had passed before the officer had taken her breathalyzer test? Don't get wrong. Back in high school, there were a few times when I showed up to school on Monday morning, and I knew that alcohol was still in my system, but I feared my mother more if she ever found out that I had skipped class because I had partied over the weekend. The teacher is an adult. She could have taken the day off or maybe taken half a day off to give the alcohol more time to absorb through her body. As for the way her termination came about, I don't know what state law or federal law says about a worker showing up to work with alcohol in their system if there's a no tolerance policy for alcohol consumption found to be in the body, but maybe, just maybe she would have a defense for the way she felt pushed into signing that resignation letter? That was pretty quick of them to pass her that letter to sign without knowing all of her options and consequences signing any letter or form. I'm not siding with her, nor am I against her, but it would be a learning experience to see how her case would play out in court.

Perhaps you missed where the officer said 0.066 is DWI levels in Oklahoma and arrestable, and even more so later he said he thought she was around a 1.1 BAC. If she'd been operating a car, she'd still have been arrested. This shows how unaware you are of the real world. She works in a profession with small children. There are policies and politics around working with kids. One of them is that you don't show up in the morning coming down from being drunk the night before. She'll get nowhere with wrongful termination and slander. She blew a 0.066, a legally actionable BAC level. Even more important, 100% that impairment is addressed in her district's employee manual for drug policy. They got her dead to rights being above a legal limit in Oklahoma, and being in violation of district policy while teaching small children. Got any more bright ideas Einstein? If she sues, she loses, pretty quickly. I have no doubt this wasn't her first warning. This situation happened because this is what it took to legally dismiss her without any chance of lawsuit you suggest being successful.

You swish and spit 😂 As I wrote on another post, be my guest and let your child ride in her car to school in the morning if you think she is not a heavy drinker. I was thinking the same thing -- she was not operating a vehicle so there should not be any comparissons made to DWI. Public intoxication is very subjective -- albeit, the officer mentioned her failiing the horizontal gaze nystagmus test -- so, I guess if it were to goto court -- that would be argued. I am not a lawyer -- but, the fact that she is taking medications could have played into a defense. Additionally, I thought most departments/agencies were suppose to wait 20min (or some other amount of time?) after any type of consumption before administering the breathalyzer -- she was drinking on the water bottle (was it water?) the entire duration of this incident. Neither of the officers asked when she took the last Xanax, nor did they ask about what was in the water bottle.. That too could play into a defense... If I were her -- I would had taken it to court. But then again -- from the sound of the phone call she made and then her knowing what time the court processes for signature bond cases (I think the officer realized that when he closed the car door -- I heard a slight "humph") -- seems like she knows from experience, this was not her first rodeo. With that -- her defense becomes only weaker. I hope she gets the help she needs either way.

You don't need to appear drunk to be drunk. If you stop drinking at 2 AM and are exhibiting hangover symptoms at 7am, you're still drunk. However, if she's in the classroom and supposed to be with children, that is a cause of concern. When it comes to children, there's no messing around here.

I also remember our german teacher drank vodka shots and smoked cigarettes with my friends on a trip to Germany when we were around 14-15 years old. In highschool (16-17 years old - different school), my female teacher also got shitfaced with a few girls from my class on a trip to Madrid. It's pretty common in Denmark, although i personally have never drunk alcohol. 🤷‍♂

What’s your point? Who cares where they are arrested. I doubt you know the locations of each and every arrest to even make that statement. It’s a huge red flag that she even has alcohol in her system while at work. She’s in charge of children for 6-7 hours per day and she is drinking and lying about it.

She needs to lawyer up.The school staff ganged up on her. The arresting officer was completely unfair stating that the breathalizer scores below the actual reading and especially after he had given her the option to call someone and leave. The officer and the principal sipped on an ego-trip infused Kool-aid. This was 100% unnecessary. There are far worst offenders given chance after chance.

If you keep coming to school being hungover eventually they are going to handle it appropriately. She’s had to be held accountable like everyone else. Road side breath test are accurate but not as accurate as police station breath tests & it’s always been like that since they been around. People will judge people regardless of who or what they done. Her fomer colleagues aren’t pleased with her because she came in drunk to school setting & that endangered someone if she drove home or went out to lunch.

I’m a teacher and I have worked in 2 schools now. This is just how they operate. Everyone asks why bullying is so bad. The teachers are terrible to each other. My first day at the job I was using the restroom and a co worker saw the light was on and didn’t knock so she just pushed the door open as hard as she could and broke the lock exposing me…. There could’ve been students or male co workers walking by and then she stood there laughing and called another co worker over and laughed with her. When I was younger I looked up to teachers and now that I am an adult I realize that most of them are nasty people. Most people I went to college with have left teaching altogether for similar issues and your principal usually is a micromanager and power hungry. I see both sides. I see why the public is mad at teachers and I see why some teachers are upset with the system. I definitely am going back to school to do something else if I am going to be treated poorly I might as well get paid higher.

This seems like it was preplanned by the school staff. They even had a letter of resignation on standby. She wanted to face her accuser and was denied that. The cop in the beginning wanted to let her go but after talking to the staff it changed. She's definitely going to sue and I hope she wins

I 💯 AGREE!!! I was not very pleased with this one..I seriously don't think she was under the influence and possibly her prescribed medication had a little something to do with it. She passed the breath test and the officer I believe was going to allow someone to pick her up until the other teacher stuck her nose in and pretty much PUSHED for an arrest..I hope she gets a good attorney and fight the charges

YES she had drunk alcohol. She should have stayed home. Yet I think the blonde lady in the background really had it "in" for her to cause the woman on .066 alcohol to lose her job. Standing meek and innocent at the back - the blonde, i think, is probably a nasty person. The police were VERY heavy handed. Yes I agree - the school employees were looking for an excuse to get her terminated. Bet there are BULLIES in the school employees. Hope she REMOVES her child from the school immediately. The Principal is a liar - the principal will probably be the ONE to try to HUMILIATE her to the MAX IN THE MEDIA.

Please tell us all how the co workers managed to make her blow .66 You're blaming people who are rightly reporting the smell of alcohol on a teachers breath and reporting it. If they didn't report her and somehow a kid died under her watch, you would then be blaming the school for not protecting the kids. Kids get detention in school for doing something wrong. Her going to jail is the adult equivalent. She wasn't going to go to prison, just get booked then let go.

A lawyer isn't going to just show up in the middle of a investigation. What she should have done is stay quiet and refuse tests. Sure she will get in trouble with the school but she's in trouble regardless. A lawyer won't get her out of trouble with the school. Yeah know your rights but knowing procedure should be included. Lawyers aren't going to show up to your traffic stop. People always say "I know my rights. I got freedom of speech" maybe start exercising your right to remain silent.

This staff is heartless. The fact that they wouldn’t allow someone to come pick her up is humiliating. I don’t think she had drank at school or that morning, I do think she possibly lied about how much she had to drink the night before. That last story the woman was physically intoxicated and had alcohol IN HER CLASSROOM. They gave her ages to have her call someone to get her.

Totally agree. I feel like this is over the top. They could’ve let someone pick her up and she could’ve showed up in court to plead her charges. I do not believe she had anything to drink that morning. She was answering things calmly & incoherently. My guess is she had quite a bit more the night than she admitted to. Very sad all around.

I simply felt she was very cooperative, very compliant, and could have received a ride home. She still would’ve lost her job, she still would’ve been charged, but could have gone home that day. The one that said she could have someone pick her up, and the one who said she was under arrest (his superior) were two entirely different people, and that was at the behest of the school administration, so blaming the first officer is misplaced. When the superior was talking to administration, it sounded like he was all for just letting someone come and take her home, but they were the ones who more or less insisted that they arrest her. Also, though, I seriously have my doubts that the pocket breathalyzer and the one they have at a station would have that big of a difference in showing the BAC as the Major claimed. What he said it would probably be would be about twice what she actually blew, and I doubt there would be that big of a difference even if the pocket breathalyzer showed a lower amount.

I get what you're saying... but at the same time, we don't know if this was an isolated occurrence. Plus, she's making decisions around other people's kids. If she would've taken them on a school trip & drove a bus or class van, then wrecked... we would all be singing different tunes.

as someone who's never took a drink of alcohol yet, (im 19, but that doesnt stop other teens from obtaining alcohol), im doing alright. its not hard to stay away from abusive substances when you have a life to maintain. so no, i dont have empathy for the woman. she should get fired and sober up, and find a new profession. tired of kids having to deal with drunk teachers. that isnt right

The officer admitted that the breathalyzer device was not accurate. Then made up out of the air, some random number basically falsifying evidence to get her to confess in some manner, and certainly accept the situation total entrapment.

This woman was so calm, polite and respectful. They could’ve easily let her resign and let her leave with some dignity. Like another commenter said, this ordeal is humiliating enough for her. This is why it’s important to know your rights.

I think this is an inappropriate response from the police and school staff. She did not deserve being humiliated and arrested. The responsible approach would have been to suspend her and provide her with resources for helping people who have issues with addiction. My perspective from watching this is that the school personnel are extremely narrow minded and rigid.

I'm honestly okay with the firing-- there's a high bar when working with children. But the overall response was cruel, and that public intoxication charge had more holes in it than Swiss cheese. I hope a good lawyer sees this video and reaches out to her, because she might have a case.

@@Drippppppppp I think she was grossly mistreated, but for her part, it's unacceptable to show up to work with kids with alcohol in your system. If you disagree, you're in the minority. Regardless, school policy trumps anyone's opinion anyway. As someone in the human services field (far more underpaid than the education field), we all know from the beginning that it is a non-negotiable to have zero alcohol in our system at work. Don't know what to tell you.

Their responsibility is ensuring a safe environment for the kids. They should be commended for taking action and not covering it up. That lady is the ONLY one responsible for her arrest.

If she drank the night before then she would NOT be blowing a .066 the next day. She obviously drank earlier that morning to blow that level. Instead of blaming her for what she did wrong, you are blaming the administrators for doing their job and reporting it. Are you serious!? This is what is wrong with our country. Those other school employees had this planned and had everything ready! The resignation paper, the items they needed to take from her, everything was prepared. They definitely had it out for her. She shouldn't have been intoxicated while at work but this was all unnecessary and uncalled for. I was in a similar position once. Some of my coworkers reported me for being "high." My boss lied and told me that my name was chosen for a "random" drug test. I gave them the urine sample and was walked from the building and told that I would know the results in 7-10 days... of which I would not be allowed to work! My coworkers chins almost hit the floor when I walked back through those doors!! My drug test came back clean, I kept my job, and I was paid for all of the time I had off. And my boss was disciplined for the way he lied and dealt with the entire situation. That whole experience was pretty humiliating and embarrassing, even though I did absolutely nothing wrong. But they definitely set this lady up!!

I really don't understand why those other staff members were in there listening in and why this got broadcast on the internet! Everytime there is some headlining case, footage has to be found and allowed to be shown....or it doesn't exist supposedly. But here it is, a front & center video of this woman's medical information and her full name. Smh!
