lawyers use the term "attractive" when selecting jury personal. man or woman can be an "attractive juror/witness" so its not really out of place in legal setting. even pleasing; use to describe how a witness did on the stand. terms like "I like" or "he's good" is implicit in personal bias. using 3rd person adj's is preferable. even though, it standsto be said he was not talking to other lawyers or peers when he said this.

spongeintheshoe she lied about receiving her bachelors degree at antioch university when she didn’t and then she got into law school based on that lie. Even her own autobiography is filled with some big embellishments. Seriously read up on her, even some of her friends had some concerning things to say about her. I’m not saying she lied about the assault because the things that happened are known only to them. But I’m also not ready to condemn him without any sort of evidence and without really knowing anything.

Then again, alcoholism is pretty prevalent among politicians. Especially among politicians who have been in the game at a local level for a while, simply look at Iowa's Governor Kim Reynolds whose had several DUI's throughout her career

The accuser's story had a billion holes in it, and none of her own witnesses didn't corroborate it (some even openly contradicted it). He could've dropped his pants and shat on the judge's desk, and there would've been exactly the same amount of credibility in the case against him.

@@colzbroeffectboss4619 Let's be clear: as far as the "Devil's Triangle" thing, no reasonable person cares what Justice Kavanaugh got up to in his personal time 30 years ago -- indeed, we shouldn't care if he were still having Devil's Triangles every week to this day. Sex is not unethical, and while the media would surely make a whole scandal of it, it really wouldn't matter. No one should be mortified at the thought that he might have had a threesome in high school. The problem comes from the fact that he tried to fib about it. We now have a Supreme Court Justice who is willing to deliver false testimony under oath, and *that* is disgraceful.

We were sold some narrative that it's some sick gang rape ritual, to which, of course, Kavanagh denied partaking in. Of course, no reasonable person would care about Kavanagh's sex life, but people obviously cared to know whether or not he was a rapist or partook in gang rape, which is why he was asked about the "Devil's Triangle" thing.

I am discussing the very real crime he committed in front of Congress. We have a Justice with so little respect for the sanctity of a court of law that he is willing to lie under oath in order to save face. The Devil's Triangle is not a drinking game. Justice Kavanaugh knows it is not a drinking game. And yet he wilfully testified that it was one, because the alternative might make him look bad. That is inexcusable, and as a trained and appointed judge, he knew it was inexcusable. Politicians can tell little white lies. Judges testifying in court absolutely cannot.

When you look at how _different_ this episode of John Oliver’s show was compared to his 2020 episodes in general, but *especially* the Supreme Court one he just put out, the contrast is just utterly staggering. It’s like, yes, Brett Kavanaugh’s confirmation was completely terrible, and a disgrace to the Senate as institution (as if they needed any more help with that at that point), but you can CLEARLY tell that as a society, we still had some glimmer of....I don’t know, hope? I’m not sure if hope is the right word though. It might be more accurate to say that we all knew we weren’t at rock bottom YET, and things weren’t yet as bad as they could be. We were headed that way, and it’s clear we both knew it, and felt a strong sense of urgency that it was imperative to stop the bleeding/devolution towards full on fascism. You could see it in John’s eyes. But now? Now we know that there’s legitimately *no further down* we can go, without what’s left of our democracy completely collapsing, once and for all, like all democracies have done eventually. We also know that under this government, you and I *and every one of us* have no Constitutional rights assuming we’re deemed to be political enemies by the state (which, spoiler alert, if you watch John Oliver you 100% count, and as such will be treated like a treasonous domestic terrorist if you protest the government, the police, etc) Dissent is not permitted publicly, protests of any kind (EXCEPT for white supremacist, fascist, extreme Christian fundamentalist, and anti-Black Lives Matter protests-OH, and deranged anti-mask/conspiracy theory protests) are _violently crushed_ by militarized police no matter where you live, and in many cases, those police forces are actively, and unapologetically coordinating with _armed far right extremist militias,_ who have been fed/brainwashed with lies, conspiracy theories, and dangerous propaganda by Fox News (and much, MUCH worse) for YEARS, which has predictably and tragically led to the murders of unarmed peaceful protestors in the streets. Not only THAT, which is _more than way too f#%king much already,_ we’ve also watched our entire economy collapse in a matter of MONTHS! Not the stock market, because the US stock markets have become completely socialized (propped up by us, the taxpayers) and unable to fail, but the economy that affects the working class. We’ve watched jobs being lost, wages being slashed, and 60% of small businesses in America PERMANENTLY close, because of a virus. A pandemic that our government was both UNWILLING, and INCAPABLE, of protecting our people from, has proven to all that the US government is akin to a government of a failed state. Because America IS a failed state. No civilized, developed country, would allow people to suffer on a nationwide scale like this. *And you can see it all like a living history book if you just scroll through John Oliver’s episodes over the last four years, but especially from 2019 to 2020.* There’s only a microgram of hope we can latch onto at any given time, and things are horrific, yet we just have to _keep fighting_ anyway. It can always get worse, and we could all be dead. Be strong, friends. That’s all we can do.

Biases are important to self check for, and your last statement is kind of a blanket statement, not everyone who has implicit biases is going to be super cognizant of them or be open about them toward people of color they befriend.

I'm re-watching this in June 2021 and it's still stunning. He was belligerent, so freaking weird and entitled. The fact that he brought a calendar from 1982 to refute Ms. Ford's claim is so unbelievably insane. Like who keeps calendars for more than 30years? Where does he keep them? How many calendars does he have?

Watching this is Jan 2022 and its insane to comprehend this man is on the SC. Even if he was innocent, his entire demeanor is bizarre. Judges expect you to maintain demeanor when you are in their court. Agreed that you might be upset if wrongfully accused of something, but in their court you would not be allowed to behave this way. Blows my mind.

You know, I would have loved to hear a verdict from a jury or judge, but since there wasn't a full trial, I guess we'll just have to decide for ourselves to believe three people over one.

She remembers it in great detail, including the names of Kavanaugh's friends at the time. As to why sexual assault victims don't go to the police should be pretty f*cking obvious: no one believes them. How many people of power are currently in office despite many claims of inappropriate behaviour? This was a long time ago, where sexism - believe it or not - was worse than it is today. Even if she went to the cops, they would likely tell her not to press charges - then or now. You, yourself, don't believe her. Why would anyone else? Also, google is free. Search it up yourself if you really want to know. I don't have to spend my time educating you when you probably don't even think women are equal to men. If you did, you would take the time to consider Kavanaugh, a man, is lying instead of multiple women.

Which makes sense, really, because being a rape accuser, especially in a high-profile case, tends to mean not easy money, but having your life destroyed as you have to go through the courts while being dragged through the mud and getting death and rape threats from Alt Reichists. And that was my takeaway from the whole Kavanaugh debacle. Its why I had to wait a full 6 months to watch this episode because the man infuriates me so much. Even putting the allegations aside, he was NOT qualified for the position and only got it because he was young and conservative. If you recall, those were the only qualifications Trump was talking about before the nomination. "We want someone young, who's going to be there a long time." Or something to that effect. I'm STILL pissed Kavanaugh got confirmed.

And if he hadn’t been, you would have said he was cold and emotionless. And by the way, if Ford had spoken in a perfectly calm voice, you would speak about how strong and confident she is. Getting upset isn't proof of innocence, any more than anxiety is a sign of dishonesty. All hypotheticals aside (especially the ones about gender bias, power differentials, and whatever else we throw into the mixing bowl today), we have a credible accusation from a credible witness and we have a douchebag of an accused who seems more interested in playing the victim than addressing the accusations. If he wants to be taken seriously, he can start by acting like a judge. Even if he's innocent, he's so mercurial that I wouldn't want him anywhere near the Supreme Court.

John Rabson Jr You’re right that the demeanors of Kavanaugh and Ford can’t tell us whose telling the truth or whether Kavanaugh committed sexual assault all those years ago. Which is why we should look at the evidence. You say that there’s a crredible accusation by a credible witness. What’s your basis for saying her and her accusation are credible? My basis for saying it’s not credible include: 1) The suspicious timing of it. She didn’t accuse Kavanaugh for over 30 years, only for it to surface after his confirmation hearings but before the committee voted. This was calculated for maximum delay. If the Democrats could delay until the midterms, they believed that they could derail Kavanaugh’s nomination altogether. 2) The whole business with her fear of flying again seemed like a delay tactic. She supposedly has a fear of flying, so she has to drive across the country. “Fine,” the committee says, “we’ll come to you in California.” This offer receives no reply. But it turns out that she gets to the hearing by... flying. She just waits a few days before doing so. Then it turns out that she flies a lot. She flies for work. She flies across the Pacific Ocean to go on vacation on remote islands. She flew to Hawaii with a boyfriend. The boyfriend says that she went on a tour with him flying over mountains in a small plane (which most people with a fear of flying would find terrifying) and showed no sign of fear whatsoever. The fear of flying story is a lie to delay Kavanaugh’s confirmation in the hopes that the Democrats could take the Senate and stop his confirmation altogether. 3) She can’t remember any details except the assault. She doesn’t know where it happened (except she said it was near a certain club which would put it several miles from her home), she doesn’t know when, she doesn’t know how she got to the party, she doesn’t know how she got home. But she’s sure that it happened and that she had 1 beer. If she knew how she got home, there would have to be witnesses who saw this extremely upset girl walking several miles by herself, or someone who drove her home who could testify about how upset she seemed. Nope. 4) Of the people who she said were at the party, none of them recalled such an incident. Some of them said they don’t recall being at a party with Brett Kavanaugh. Her close friend said that she never met Kavanaugh and Ford never told her about this incident, although she did say that she believes Ford. 5) If it was simply about Ford’s testimony, I wouldn’t find it credible for the reasons listed above. But the Democrats took anything and everything seriously if it meant sullying Kavanaugh’s reputation and of course delaying the proceedings. Julie Swetnick had ridiculous stories about gang rapes. They brought out yearbooks and dissected what Kavanaugh wrote. There was discussion about what the phrases in the yearbook meant and whether he was lying about them. And of course, his demeanor during his testimony was seen as proof of his guilt. I mean, how dare he be angry after being repeatedly accused of gang rape in a proceeding that seemed to be calculated for political putposes? 6) You will notice that I’ve never said that Kavanaugh is innocent. How would I know? I wasn’t there. But many many people have stated that he’s a rapist even though they weren’t there either. The current theory is that you must believe any women who makes such an accusation because “women don’t lie about rape.” This means in effect that you have to convict any man who is accused, regardless of evidence or lack thereof. There was also a constant call for the FBI to investigate. So they did as best as they could. They interviewed the witnesses (again). And what else is there to investigate? There’s no crime scene, there’s no evidence to analyse. But there’s this perception that if the FBI just were able to “do a real investigation” they’d be able to find evidence that Kavanaugh’s a rapist. I swear some people have seen too many episodes of CSI or Criminal Minds if they think that law enforcement can investigate a non existent crime scene. You say that Kavanaugh is too mercurial to be a justice. I contend that you only saw him under very unusual circumstances, after he and his family had spent the last two weeks getting death threats. TL;DR John Rabson Jr. is full of shit.

I don’t know if it’s just a Midwest thing, but I remember playing the Devil’s Circle about 5 years ago. It’s basically a game where you sit at a table and you hold a quarter against the table and flick it, then the next person has to flick it again and keep it spinning, and the last person to flick it before it falls over has to take a drink. Jason Bolding the comment had no reference to his indignance. The comment took issue with the socially unacceptable act of dodging a question in a congressional hearing by asking whether the person asking the question had a drinking problem. They then went on to show that on a small, low stakes job, his behavior classifies him as unfit, much less a job at the highest court in the country, a very high stakes job that impacts the lives of Americans across the country (overturning legislation, determining the rights of American citizens, etc.). What legitimate issue do you have with this?

I was sexually assaulted over the course of a year and when I told my school about it, I gave specific dates that they could look ok their cameras and find him groping next or forcing me against a wall. I did not press charges since that would force many of my friends to get involved (some who even told the school that I was correct and they had seen the guy aggressively assault me and talk about wanting me dead after I reported him). The guy’s testimony was a lot like Brent’s. Guess what my school said? “It’s a he said she said situation.”

It can take a very long time to come to terms with what happened. Even then, there's the constant public discourse of "he said she said" which permeates all discussions. Regardless of the personal views one may have, the fact that Kavanaugh was so disrespectful and poor at answering prepared questions should concern everybody. As his job requires him to be better prepared and more composed, regardless of how targeted the allegations would be. Furthermore, he must try to at least appear unpartisan. As it is now his confirmation would further call into question the validity of the supreme Court.

If they are clearly false then steps should be taken to punish the person clearly spreading false accusations. But that does not mean to dismiss every allegation on face value because no hard evidence is present. Investigations are meant to find that evidence

No. I'm not an interviewer, anyones boss or in a position to interview someone, yet the answer is still no. If I were in such a position I would not hire someone like Brett Kavanaugh & that's regardless of whether he actually committed the crime he's been accused of in his teenage years. That said, I do think he's guilty of rape & not just because of Dr. Kristine Blausie Ford's compelling testimony.

In my opinion no, due to how he was highly emotional about the calendars, that would have made more sense if his father was dead and not sitting behind him, along with how he said he was innocent but refused to take tests that would prove his innocence. Numerous studies are coming out showing women repress and reframe because "it's my fault" or "I don't want to have been raped" is still a theme. Thank you for sharing your story. I experienced trauma as well and although it wasn’t sexual assault the effect on my thought process was to reframe it as something that was my fault. Traumas effect on your brain makes it really hard for victims to come out with their stories because of fear or even repression or reframing of the memory of the traumatic event. Stay strong. As a judge he ruled Polygraphs can be used. As a Supreme Court Nominee he said they are unreliable. So he should either retract his initial ruling and reverse any penalties levied on citizens based on a polygraph test, or he should retract his second statement and take the polygraph.

TheHurby He said no he didn't take one, he didn't say no he wont take one. There is a difference. He didn't take one because it is unnecessary and it can't be used in crime cases. The supposed victim took it because she was told to but we don't know who took it for her and how credible or who verified it as credible, it was done behind doors with no knowledge of it by anyone but the lawyers who wanted to make it seem like a valid proof when it isn't. It just show your stress level when answering questions, it doesn't show if you are lying and tell you what the real answer is, it is not a tv game show.

Aside from all the objections brought up here, let's not forget that Kavanaugh is on the record with the opinion that a sitting president should not be subject to subpoena, prosecution, or indictment while in office. He also refused to state whether or not he believes a president can pardon himself. I presume these facts were not unknown to President Trump when he selected him.

To be honest, I can’t think of one teenage boy who felt up girls, had crazy sexual experiences each weekend, used girls like Kleenex, etc... I am a few years younger than BK, so perhaps AIDS made our sexual experiences a bit different. To me it sounds more like these young men were from a very wealthy and privileged life where they could act like dogs and get away with it because daddy was rich / powerful and could clean up and messes these boys made.

Get away with what? Ms. Ford's testimony was completely contradicted by her witnesses and she had literally no evidence and barely any recognition of the event at all. The only thing she consistently knew was that Brett was the one who did it. She doesn't remember the date, she got the location wrong, she was inconsistent with the number of people being there, she doesn't even remember how she escaped. Just be honest and think for yourself. Don't just believe stuff because your friends told you to. You need to be independent, not reliant. Again, think for yourself.

Even if she did lie, which is hard to ascertain given how the Republicans set up the hearings, we still have someone on the US Supreme Court who, during his confirmation hearing, perjured himself over trivialities (the definition of "devil's triangle"), misrepresented witness statements, evaded questions with simple factual answers, dodged questions with an obvious right answer, and lost his temper in a manner unbefitting a judge. Quite apart from the truth of the allegation, his reaction to it itself was damning enough. Even a false allegation shouldn't have provoked this kind of reaction from someone fit to be on the US Supreme Court.
