This is why we have COURTS. If she thinks her friend was arrested illegally then you contact a lawyer, contest the arrest and if needed SUE the city for wrongful imprisonment. There are legal steps to take, this is not it.

@@randall5073 these ladies were trying to file criminal charges, and there is no choice in a criminal case. Public prosecutors have to prosecute criminal activity. So if they truly had a criminal case, it's not these women's responsibility to hire a prosecutor. The courts do that as long as a criminal activity is assessed. You are right though, they would have to pay if they wanted to do a civil lawsuit. Although, any attorney is going to take it if they think there's enough proof to get it through the court, 'cause "People versus City" is usually a good payday.

I can tell you FOR SURE this happened in California. I recognized the penal codes. (I'm a Police Scanner Nerd). On Behalf of California, I apologize for y'all having to watch this. Penal code 602 (Trespassing) is enforced when a business or citizen has an unwanted person on their property. Mostly the officers will just come, take their info, ask them to leave. Person Leaves, that's that. They don't arrest for trespassing UNLESS (1) The person is a d^ck to the officer (2) The property owner wants to press charges (3) this is a violation of a "no Trespassing Order" Legally filed by the property owner (4) The person REFUSES to leave. Trust me. PD doesn't like to deal with trespassing calls. I often hear the audible eyerolls over the scanner.

her friend was asked to leave and left (Officially tresspassed) and then he came back so he got arrested, which somehow she sees as kidnapping.... she also brought up that they can "strip them of their immunity" which is untrue. A police officer can lose their immunity if a court case rules on that law, from that point on law enforcement does not have qualified immunity in that state. These two were making no sense and did not have a foot to stand on. I would be hard pressed to believe that any lawyer would take that case.

@@randall5073 california penal code (415) (Creating a public disturbance) can be cited as a reason for someone being trespassed on public property. Then there's 415v which is where someone begins making threats of violence or begins to act violently (throwing things, hitting people etc). There's "415 Weapon" where the person has a weapon and is creating a disturbance without directly threatening anyone. Often the person may be arrested for another charge, then the police take them to the station, and reduce the charges...more of like a cool down period to de escalate. Keep in mind these "codes" are things I've heard on the scanner...California Penal code is the "602" (trespassing) and "415" (Creating a disturbance). @swan4163
@swan4163 2 жыл бұрын
The Karens do not have legal standing to challenge the arrest. Only the person who was arrested can challenge the arrest, which happens when the person goes before the judge. In the US, you cannot "file charges" on behalf of someone else, and you have to show in your lawsuit at the very beginning that you have legal standing to sue; if you don't show that, the judge will throw the lawsuit out from the get-go. In criminal cases, it's up to the District Attorney's (DA) office to file charges if they think they can prove the case beyond a reasonable doubt, so they'd have better luck going to the DA and not bothering the cops. Also, these karens don't understand the difference between criminal and civil law. If your rights were violated, that's a civil lawsuit, not a criminal one, and cops don't have anything to do with "enforcing" civil law. Plus, in most places, cops have "qualified immunity' which means they cannot be held liable for anything if they were acting within the course of their duty. But arresting someone for trespassing--even if the person wasn't trespassing--is something the person who was arrested can fight when they go before the judge. Bottom line is their friend was asked to leave the post office; they didn't leave, and the post office called the police to have them removed. At that point the cops probably showed up and informed them that they were asked to leave, and they would be arrested if they didn't leave, and they probably argued some bullshit like these karens tried and refused to leave, so they got arrested. Pretty simple. Their friend probably had to spend a couple nights in jail and pay a fine, unless they made it worse for themselves and acted out in court, which probably happened. lol

I admire the cops' patience. What these dopes don't understand is that the police don't have to establish guilt to arrest someone. The standard for arrest is probable cause to believe that the law has been violated. A verdict of guilty or not guilty is established by the court, if the case gets that far. Just because the police have arrested someone who is later released without charges doesn't make it a false arrest. And if the person did refuse to leave the post office, he actually did trespass. The police are 100% right in this case. These women could have tried to hire a lawyer, but they have a couple of problems. First, they have no case. Any lawyer would tell them it was a proper arrest. And second, they don't have standing. Even if it were an improper arrest, they weren't the ones arrested.

You don't waylay a cop with a bunch of Google printouts. You get a lawyer. One of the judicial websites I maintains is for the Texas State Commission on Judicial Conduct, where you can file a complaint against a judge. There's a reason their complaint form say "Do NOT cite legal code or precedent in your complaint." You're supposed to state your Complaint in plain English, and the experts will interpret what legal codes are applicable. So you don't waste everyone's time with your complete misunderstanding of law.

Well damn, didn't know police had become slaves now. What the "Karens" weren't clearly getting, is the fact that the police arrested a private citizen inside a federal building. Karens should have called a lawyer, explained why they were upset about their friend's arrest and then I am sure the lawyer would have told them if they had a case or not. No matter how many lawyers they called. Now, depending on the reason for the friend or friends it sounds like, that were asked to leave and then the 1 who refused and was arrested, I don't know, I wasn't there. But, judging by the company they hold, probably just wanted them to shut up and get out! If they were not that way, well, you might want to think about some new friends.

No, the Karens do NOT have a point. From what I gathered, the arrested party was warned by U.S. Postal Service employees to leave a Post Office and not return. Those employees have the power to tell a troublesome person to leave the premises. Yes, it is a publicly owned building and generally open to the public, BUT that does not mean that members of the public can enter and act any way they want with impunity. Some behaviors will have consequences. While this happened on Federal property, the Federal employees realized that the building was also in the jurisdiction of a city. They called the local police, rather than one of the Postal Inspectors (who have more important things to do than file misdemeanor charges on some guy), and let the city cops handle the light work. The Postal employee in charge of the Post Office that day (on duty manager of some sort) made the decision to file charges if the man didn't leave. There was a warning issued. The man didn't leave, so he was arrested and forced to leave by the city cops. This was an "in progress" type call that warranted immediate attention.. No kidnapping occurred since this was a lawful arrest for a crime that happened in front of the police officer at the Post Office. He received the Postal employee's complain, issued a warning (probably multiple times), and finally resorted to making an arrest. Criminal trespass (or whatever that state calls it) arrests happen daily in every major city in the U.S. and most of the medium sized ones. As for the cop and supervisor on the video, in their place, I might well have arrested both women for attempting to make a false report of a major felony, and let the judge sort them out. There were probably other charges that would apply also since they were taking up the officer's time insisting that it had to be handled NOW when what they were complaining about was not an "in progress" type of thing. It had already happened, and could be dealt with by the courts at any time.

I don't believe the Karens had any point to make because there's common sense that they're disregarding. Any business, federal; public; or private, reserves the right to refuse business to any individual. If they ask someone to leave that is that person losing their right to be on that particular business's property. Continuing to be there is the offense of trespassing and they can be forcefully removed by law enforcement. You can tell how lose these Karens grasp of reality really is when they call the detainment of their "friend" (probably gimp number 37) as kidnapping.

She definitely should have used the court system. It's so easy to sue someone these days (at least in the US) that it almost makes me wonder if she actually understood that the arrest was legal but was having a hard time accepting it. I don't quite understand how she thought that this would make a difference. I understand that place to make wrongful arrests at times but the way she went about it just seems severely misguided.

The women are wrong. People have been 'auditing' post offices which is illegal unless they have permission. These people think they can't be trespassed if a building is open to the public. Then they claim that their rights have been violated in order to score money via a lawsuit.

The Karen wasn't right at all, if a person was trespassed off the property especially Federal property and a cop ask them to leave and the subject refused, they would be arrested. Plus she is quoting local and State law, the Post Office is under Federal Jurisdiction that request local law Enforcement help since the Federal building is within the local Police jurisdiction for response for help.

She is trying to say that the penal code does not give cops the authority to arrest trespassers which is BS. If they have a complaint against the post office they need to make it through the proper federal channels. These officers are local law enforcement not federal. These karen’s have no case and ought to be fined for call 911 falsely so many times!

The narrator is incorrect assuming police officers know the law better than laypeople. They absolutely violate or show ignorance of the law on a daily basis. That said, these women are crazy town. They're wrong. Use the court system if you disagree.

If you get arrested but don't think you did anything wrong, you GO TO COURT. Post bail, prove your innocence, then get your money back. For someone trying to be smart and superior, she obviously doesn't understand the very basics of the criminal justice system. All those papers and the laws she's trying to argue... that's what you do in COURT.

she's confusing the post office's rights to have her friend removed from their premesis by the officers who enforce the trespassing law. once her friend refused to leave, the officers arrest them for the crime of trespassing. she's a good example of someone living a privileged life who doesn't understand how the rest of us live. (in her mind, they have the right to refuse leaving federal property when asked to do so; she must have not gone to any protests)

Where she lost me was she was calling a line used for emergencies. EMERGENCIES Karen like actual emergencies. I can't think that this qualifies as no one is in harms way, suffering a serious medical issue and there is nothing on fire. He went out there to acknowledge them and let them know when someone would be able to address their concerns and yet...... it's all about them. Speaking of which, why are they the ones bringing charges? Shouldn't that right go to the ones actually arrested for trespassing? This is why the one who was arrested, if they want to pursue this, should get legal council. If they were arrested they obviously will have a chance to go before a judge and plead their case. That's when you can bring all of this up in their defense. Although I'd make sure these two weren't there in your corner, they try this tactic with a judge he could have them arrested for contempt of court. Ooh, then again that could be fun to see.

Those women are wrong on every level. So rude, so obnoxious. So entitled and condescending. Their main problem is they don't know how to communicate. They don't let the officers answer their questions or even finish a sentence. They don't listen at all. Their only objective is to prove themselves right and everyone else wrong. Women like that are disgusting.

She is confused. Trespassing is a local law and the local laws were handled by the local law enforcement. But now that it has happened the courts will handle it. I just wonder how these women would have handled living in a black neighborhood in L.A. in the 90's where hanging outside with your friends would get you thrown to the ground and searched.

Sorry Kabir, but I do not see both sides. The ladies were 100% wrong, and feel a sense of entitlement because their friend was arrested. The post office asked him to leave... he wouldn't, so the police were called and they arrested him. Now you take it up in court. The police here took the time to listen, but they were never allowed to speak, so they did what any level-headed person would do... they kindly walked away. The "we are your masters" was so degrading.

Even if the arrest was unjustified (and I don't know whether it was or not) she is not in the right here in that the officer is not guilty of "kidnapping". At most it is wrongful arrest and there is a solution to that problem and that it to file a civil complaint. It's possible they can have the record of the arrest vacated and if they can prove damages can be compensated. But again, there is an established procedure for that. Likely if he was released two hours later there was never even a formal record of it. Google is not a lawyer, people.

The Supreme Court has determined that it is not against the law to be disrespectful, swear at, or use profanity or vulgar language toward a police officer. That said, the women are way out of bounds. You're quite correct about contacting a lawyer. That would have been their best avenue for dealing with this situation. Since we don't have any video of the interactions of their friend at the Post Office, we can't tell if the arrest was lawful of not. They could be playing for clicks and likes on their video, and so think that it will be more popular the more belligerent they are. Some auditors take pictures or videos of public areas in public buildings because they are testing whether the staff or the police will follow the law, as the Supreme Court has also determined that it isn't against the law to video in any public space. Police will often use excuses to stop them and will occasionally arrest them, but if the auditor follows up with a complaint of false arrest, the auditor can be awarded monitary damages.

She should have contacted an attorney first. Or, better yet, discussed her concerns with the attorney who was going to be representing her friend -- and leave it in his/her hands. As is, she was just being a loud, self-important loose cannon. And the "Karens" don't seem to actually have a valid point. Visceral anger isn't a good baseline for judging the truth of a proposition. Their anger might more appropriately be directed at her friend who was arrested. But they seem to be even more stupid than he was.
