IIRC, the 128.50 fine was only for using the phone while driving, it's a safety thing. Since then, a new law has taken effect against taking pictures of injured/dead people who are unable to consent. The fines are much higher, whether you're driving or on foot, this new law is about human dignity.

I‘m glad. It must be 500€ or more for a photo taken at a fatal accident imo, this is beyond disrespectful…it must really hurt!

I am so proud seeing this Police Officer bringing back SHAME and teaching drivers a well deserved lesson. I agree 128,50 € is too low a fine if people actively try taking pictures of accidents. For your information, that police officer‘s vest says EINSATZLEITER, so he is the highest ranked person at the accident site.

@@Tony-c7z9t if you didn’t catch it, the drivers who were beim colder came fromPoland and Bulgaria, so no one would expect them to be fluent in German. On the other hand, if one isn‘t from a recent eastern immigrant family, neither Polish nor Bulgarian are taught in German schools, so it‘s only logical to switch to English, which is the universal go to second language most Europeans learn and school and can be expected to understand on a basic level. The police officer also isn’t STOMPING ON THE PUBLIC RIGHTS, because in Germany we have a lot of rules around traffic behavior around an accident, like building a space for rescue vehicles to pass through any time a traffic jam forms, or not to gawk and take pictures at an accident sites. So he is implementing German laws, getting people to pay fines for their disrespecting of traffic rules and honestly, teaching them some much needed manners!

@lynnm6413 but there are irrefutable laws that no can get around regardless of language or culture or geo-spacial locality, so yes that rozzer was stomping his authority. Do as I say not as I do, expecting people to be slaves to his demands, if that's German attitude then Germany is doomed, oh sorry they doomed themselves twice in the 20th century, and have still not learned.

I'm totally with you. I was a first responder and a nurse. One day a friend of mine was in the subway, there was a big bang, the subway stopped half in the tunnel and the lights went out. I was texting with her at that moment and she was panicking, so I called her to calm her down. After a while police etc. came and they had to get out through a window and walk to the platform. The last thing I said to her before she had to hang up was "Look to the ground. *Actively* don't look! It's natural or even subconscious to look for what's going on, but not matter what, Don't. Look! You cannot unsee this and it'll be stuck with you for the rest of your life" (Of course those people in the video taking pictures and stuff is a totally different story, it was more about the thinking about the consequences of experiences like this)

It’s a shame, there should definitely be another 0 behind the 128,50 € . I’m German and my Husband is Welsh, our family works in A&E, they see this on a daily basis. And it’s not pretty at all… These drivers will never learn… But thank you for being so compassionate and understanding ❤ Much Love from South Wales and the North Sea Coast 🏴󠁧󠁢󠁷󠁬󠁳󠁿🇩🇪

Once, while driving back from field service, traffic was moving slowly in that city. After a few minutes I could see the reason: there had been a motorbike accident and gawkers were taking their time driving past while looking at the wreckage. Since I didn't want to be in another accident at that place I kept my eyes on the moving traffic - even the short glance I dared revealed what looked like a leg. Could have been a rolled-up jacket, but I wasn't going to slow down and investigate, that was a matter of decency and respect regarding the victim.

Three months in prison and confiscation of the phone or camera would be a fair penalty. Also it would minimize that disgusting behavior.

Where there even cases where families and friends found out about accidents thru social media. The police could'nt even go fast enought to them to inform them about the death in a respectful way.😟

And Kudos to you for your hospital job! I also work in the medical/health care field. I'm normaly not in danger to see people after a car accident or worse. But still I see people who suffer for different health issues. It's still something unpleasent and your mind has to deal with.

Great job by the police officer there he was being professional,without shouting or beratting the gawker despite being visibly upset by the whole situation. I mean why would you take pics. and videos of a dead person in a car accident , to post on the internet for all to see ? That's disgusting!

Well, Germanys biggest tabloid newspaper (called BILD / picture, but I call it only mud paper) had/ has a part for so called Reader Reporter. You send a picture of something "interesting" to them and get xx Euros for it. And social media is the other hell. You get likes and clicks for special content.

a policeman shared a story, there been a fatal accident, a couple got under a truck and passed, 2 kids were at home, when the policeman and helpers rang the door of the kids, they just said ye we already seen it on facebook... can't tell you how f that is!

No, there is absolutely no scenario where it is okay and justified to take pictures of an accident if you are not the police officers at that location. None whatsoever.

I can understand people who shoot a glance sideways when passing an accident - not stopping, not taking pictures, just passing - because that's just human curiosity, they want to know what happened. But gawkers, even taking pictures, and endangering the rest of the traffic by slowing down or even stopping, or even attacking the emergency services are just [self-censored and way longer than this] a**eholes.

This policeman got some crapstorm his way... Many people were on his side and some were saying he's gone too far... I'm 1000% on his side - they have to be treated this way. Someone died there and they want to get pictures for the internet sensation...

The fee of €128.50 is not for takeing pictures. It's a €100.00 fee for using his cellphone while driving, plus a procceding fee. If a non-driver is taking pictures/ filming, the police can do nothing.

Always hated these idiots, even before it became such a problem, I remember driving on the Autobahn a long time ago and there seemed to ba an accident on the other lane, my bandmate in the back told me to slow down to get a good look ...I chose to speed up.

Hey Dwayne! Great reaction! Gawkers are terrible. I hate them. In my opinion Gawkers have to pay more then 128,50€. Respect to the police man that he react calm in a situation like this. Theme switch: I would like to see your reaction on Falco. He is a great musician. He is from Austria but he speaks German. So i would say he is a german artist. It is not against German law to take pictures of the accident scene. Two things are against the law here, first is to take pictures of people without their consent, second is to use a handheld electronic device while operating a vehicle. In this case the drivers were unable to see and take pictures of the person who did unfortunately not survive that accident. The body was on the right shoulder of the road covered by the truck. They were not taking pictures of Individual people as well, most likely just from the accident scene. The fine this police officer is talking about is 100 % certainly for using a handheld electronic device while operating a vehicle. The regular fine for that violation of the traffic code is € 100 plus € 28,50 in administrative fees. So a total of € 128,50.

128,50€ plus 3 points and taking the driving license away for at least a month. If it happens again within the 2 year probation, much higher fine and 6 months without drivers license. I get when you’re looking if you’re not sure if it’s an accident or what is going on. But once you see a police car / fire car / emergency just look straight. Let alone don’t touch your phone.

Ich bin in der freiwilligen Feuerwehr in unserem Dorf. Wir sind ca 150 Bewohner und ca 25 sind in der Feuerwehr. Wie ist das bei Euch…Retter pro 1 Einwohner = na…??? Wir schaffen das…Ihr auch? Viel Spaß und viel Glück. Nur Ihr könnt das Segel rumreissen…

I am with the police officer, especially since there were instances, when relatives found out through social media of the passing of a loved one, even with pictures, before authorities had a chance to reach them. That being said, I also have heard of transport companies insisting on proof/pictures of traffic delays, accidents , etc, when their drivers, who are always under immense pressure anyway, take longer than reconned. So its possible some of them took a picture of the accident in general, not knowing that there were fatalities. Still illegal, still morally reprehensible, but a bigger issue than just some idjits void of empathy.

Not a reason nowadays….traffic jams get monitored in real time by all the mobile data stuck closely together, there doesn‘t need to be foto evidence of a crash, also radio keeps giving major traffic delays every 30 min, if the employer wants, he can have someone note down those jams

The only reason to slow down or stop at an accident site is when you think you can give first aid. When there's police, firemen and an ambulance on site you should just pass at a safe speed and keep driving. I hate that we have straffic jams all the time because of stupid aholes who need to gawk and see. And it's disgusting to me that there's even people who make things difficult for the first responders because they want to get up close. Disgusting!

i saw many reaction to this video. and i see the problem with traffic on the other side which slows down because the drivers wanna see what happened, which off course leads to more accidents - so i get why "we" have a fine for that. but if i would be ask to take near by pictures i totally would get into it: to post something unique on a gore board
