Felony crimes are done at the state level and where the crime was committed will take precedent. Misdameanors or lesser crimes are done at the county level. An example is Knox County has decriminalized Marijuana, however it is still illegal under state law. So if all I get caught with is simple posession marijuana in small amounts then I either won't be charges or if I am cited then they will dismiss it in court. However if I get caught with Marijuana at the same time I get another felony or if I carry large amounts that would be felony then the state law takes president and I will be charged for it. If I live in Tennessee and commit a crime in Arkansas then Arkansas will charge me.
@gregwilde11194 жыл бұрын
I live in Wisconsin where marijuana is illegal. I can drive about 50 miles and buy marijuana in Illinois. I smoke it in Illinois no problem if I smoke it in Wisconsin I can get arrested. There is also a lot of federal land in the US. If you commit a crime on federal land within a states border you will get charged federally under federal law which has seriously harsh penalties. Indian reservations while within a state are all federal and simple drunk driving can be 3 years while you might get probation for 1st offense.
@tino47694 жыл бұрын
If you cross state lines and break the law, that can be an additional charge and they can extradite you, and if you bring a gun or weapon across state lines that that weapon is not registered in that can be very big trouble for people.

We do, however, often have some sort of road sign on major road-ways saying you are entering or exiting a state. These are often celebratory in nature and say things like "Welcome to Ohio!" or "Thank you for visiting". Some places are proud of their borders like those that make up the Four Corners and others that sort of make fun of it. There is a bar called Patrick’s Pub And Grill that is on the border between Tennessee and Georgia, which have different regulations on alcohol. You can buy it and drink it on the Tennessee side, but the county on the Georgia side is a dry county, meaning no alcohol, so the bar has a sign posted and a line painted on the ground on the border so people know if they are 'legal' or not... They also very conveniently provide a table at the border in case you need to cross the border to use the restroom! lol.

California has agricultural inspection stations on major highways near its borders, but you can get around them. I don't think they require ID or even ask who you are, they just make sure you're not bringing in firewood that might have invasive pests in it, or that your boat doesn't have barnacles on it which could become a problem if you use that boat in a California lake.

American attorney here: Determining the location where a crime took place is sometimes a major issue in court cases in the U.S. for exactly the reason you highlight. For example, some States have the death penalty and others don't, so if someone from a death penalty state were to be murdered, and the remains found in a non-death penalty state, it's very important to know in which state the actual murder was committed because that can seriously affect the defendant's possible punishments. Also, every criminal defendant has a right to tried IN THE STATE where the alleged crime was committed, and so that must be determined in order for a trial to proceed. There have been cases in which it took hours of legal arguments over the course of weeks or months just to decide this kind of jurisdictional issue.
@memesterjohnson14024 жыл бұрын
Wow. 😯
@danielmulyadi82374 жыл бұрын
In these sorts of cases, do the litigants and defendant get tried in a federal court since it involves more than one state?
@ajm50074 жыл бұрын
@@danielmulyadi8237 It depends. Criminal cases are pretty much only heard in federal court if the law broken was uniquely a federal law (like counterfeiting or espionage), or if the crime took place on federal land (like a National Park). In the example I gave, where a murder victim from one state is found in another, that would likely be handled in state court. Probably the charges would be filed in the state where the body was found, but if evidence indicated the murder had actually taken place elsewhere, then the case would be removed to that jurisdiction. In the case of civil suits, yes, if the parties are from different states, that's handled in federal court.
@keepinmahprivacy97544 жыл бұрын
It was also common practice back in the days of dueling to hold a duel on a state border, since dueling was illegal, to make it more difficult for anyone to be prosecuted for doing it. If a river was designated as a border between states, then you might hold a duel on an island in the middle of the river. After the duel your lawyer had a ready made argument that whichever state tried to charge you with murder was the wrong jurisdiction.
@noneya60004 жыл бұрын
Correct me if I’m wrong but they can only extradite you from another state if you commit a felony. For example I live in Kentucky right next to the Kentucky/Ohio border. If I commit a class d Misdemeanour in Ohio like loitering then left. Ohio can’t come across state lines to get me. I was going to to college for criminal just and have a couple of classes under my belt. I remember it was something to that effect. Because its a petty crime.

KCK is mostly residential with small business and fairfax industrial district. KCMO has the two big sporting arenas for the Chief's (football) and Royal's (MLB). KCK has the arenas for Sporting KC (soccer), the speedway (NASCAR), and T-bones (hometown baseball team). Most people live in Kansas and work in Missouri. Most government statements are handled by county and not state. Yes Missouri has different laws that apply to only the Missouri half as the same for Kansas but locally all mandates are handled on the county level that encapsulates the 5 counties that make up the metropolitan area.

America has three levels of law: local, state, and federal. Yes states have different laws from each other but the federal law is the whole country. So for example if I followed the law of the state but not of federal, I would be sent to federal court and vice versa. Local law is law that is in the local town or city that u live in.

To answer the question about breaking the law along the river: let’s say a crime was committed and a body was found. Whoever finds the body will need to determine jurisdiction. Jurisdiction is an area of which you are responsible for. City police have jurisdiction over the city, while county sheriff’s deputies have jurisdiction over the county, to include every city inside the county, while state police have jurisdiction over the entire state, and every county within the state. Federal police have jurisdiction anywhere on federal land. Now, if a body was found, first they determine which state the body was found in. Let’s say it’s found on the Kentucky side of the river. Since it’s not in a city, the police that will investigate will be the county sheriffs office. The county sheriffs can always call in the FBI for assistance. If the criminal lives in another state, then the federal police (FBI) will be granted a warrant which is permission signed by a judge who has jurisdiction over both states who allows the federal police to execute a warrant which means they will send police to go arrest the criminal even if they are in another state. America is a country that has 50 states, but all the states work very well with each other. Each state is divided so to simply represent the people who live there. As people from around the world know, people like to live different lifestyles. It’s the same in America. People enjoy different things. So creating states makes more sense because the people in each state can have their own laws which allow them to live the lifestyle they want to live. For example, in California, you can’t have guns outside your home. But in Tennessee, people like guns. People in Tennessee carry guns to the store just because it’s cool. While many People in California have never even seen a gun.

It should be noted federal authorities do have authority outside of federal lands where a federal crime has been committed. This is the case for Yellowstone. You can't actually get away with murder there. It would be prosecuted as a federal crime if the state couldn't handle it.
@kylaluv84534 жыл бұрын
Also, we have Federal Laws which encompass the whole of the US. Then State laws which are state specific, county laws and then city laws. So minimum wage is set at the Federal level. But each state can set a higher minimum wage. And even some cities set an even higher wage. My state voted in allowing fireworks but most cities banned them. Alcohol is legal at the federal level but you can still find dry counties on cities. My favorite is day light savings. I live in the only State that doesnt observe it, but the Navajo Reservation in our State does. Which brings up the fact Native Americab Reservations make their own laws. But I would say 90-95% of all laws are the same everywhere. It isnt like, you cross the boarder and suddenly it is legal to run people over with your car. The differences are small. Like 5 yrs for stealing vs 8 yrs, or at what level is considered too drunk to drive. My state is a u-turn all you want unless there is a no u-turn sign. Another state would be u-turn only where designated.
@rawyin4 жыл бұрын
@@kylaluv8453 Oh dear god you want to explode his head lets talk Native American legal system. The reservations are sovereign territory but they are also subject to US federal law based on treaties. Very messy. But county and city "laws" (usually called ordinances) are subject to state law, and some state law is subject to federal law. But yeah this is constitutional law in the US where the constitution determines what control the federal government has over the states but all other laws are deferred to the states to decide. I once asked a woman on the res who was a lawyer about some of the nuances of reservation law. She told me about a situation where the local PD pursuit ended at the res. They had the plate and the reservation cops came out, met them, and then escorted them to the house. When they got there, they walked up to the front door, kicked it in, walked in and grabbed the guy, threw him in their car, drove him off the res and handed him over to the local PD. No warrant. No nonsense. Law on the reservation is different.

@@scabbedwings6548 I grew up in Metairie, know both of these bridges well (at least, the pre-renovation version of the Huey). The Causeway is kind of cool and fun, provided the traffic is light and the weather is nice. They actually close the bridge for bad weather or heavy fog, and I recall times where the cops would caravan cars across in groups. The bridge has it's own police detail. The Huey was another thing entirely - way high up, no shoulder, two narrow lanes, and a thin steel grill separating you from the edge. Not only that, there is a train bridge in the middle. Those rare times being stopped on top of the Huey in traffic while a loaded freight train comes through - now that is scary - you're sitting in a car way above the Mississippi river on a bridge that is shaking like mad... white knuckle time!
