Steve and Caleb take on a persistent line of thinking that's gone around for years: You shouldn't modify your daily carry gun. The theory is that if you shoot an attacker with it in self-defense, the modifications can be used against YOU in court. Is that true? Before we proceed, let's just make it clear the guys are NOT providing legal advice here. They are offering their opinions based on research and discussions with actual defense attorneys, rather than what gun writers and firearm instructors are saying.
Remember, there is a situational element to any prosecution. If you are charged in an anti-gun jurisdiction or get a judge who's none-too-friendly to the Second Amendment, things about the firearm may be brought up in the case against you that would not be used elsewhere. Still, the key question in court is going to be whether or not you were justified in using deadly force to defend yourself.
What counts as a modification? Changing the factory "iron" sights to fiber optic or Tritium night sights? Sights have no material effect on how the gun functions. What about a trigger job? If you have not altered a safety function of the firearm, a trigger upgrade probably isn't going to work against you. For an extra measure of CYA in court JIC, have a professional gunsmith do the trigger job for you. Or use a drop-in kit like those from Apex Tactical.
Modifications that HAVE been brought up at trial are cosmetic changes to how the gun LOOKS. Clever sayings on the inside of an AR-15's ejection port cover or laser-engraving "Smile, wait for flash!" on the muzzle of your pistol is not a good idea. Even painting the gun a different color can be brought up by an overzealous prosecutor. These are all things the jury member who doesn't understand guns can SEE. Don't make it appear to them you were "looking for a fight."
In the end, Steve and Caleb could not find a court case where the outcome went against somebody because the firearm they used in self-defense had been modified. So based on their research, the myth is BUSTED. A self-defense gun can be modified, within reason.
For those who want to be extra cautious but also want upgrades on a carry gun, consider a gun like the SIG P226 Legion. It comes from the factory with a ton of upgrades, but it's still a "factory stock" pistol.
NOTE: Products in this video are to be used only for lawful purposes, including hunting, self-defense, and competitive or recreational shooting. If you purchase any of them, you are responsible for understanding and complying with all federal, state, and local laws that apply to the purchase, possession, and use of these products.

Glock is the only brand I know of that people buy for the reliability, then spend the same amount of money that they spent on the Glock making it more reliable, then pay the cost of the Glock and extra stuff again to fix all the problems they created in the first place. I do think Glock is a bit over hyped when you compare it to any modern pistol from a reputable manufacturer. (CZ, Walther, Sig Sauer, Beretta, S&W, just to name a few.) and as far as 1911's go, I've never actually handled one that wasn't just as reliable as any stock Glock. You may never get the opportunity to explain it to the jury & even if you do they may not agree. There have even been cases where the very training of an individual has been brought into question. They will try to paint you as a wannabe Cop or Military Operator who was just looking for an opportunity to use what you learned in that 4-day pistol defense course. What seems reasonable to you, may not seem reasonable to a jury. Check out the Armed Attorney’s channel, they have a lot of good advice regarding self defense cases.

If you're in a jurisdiction where the judge or jury doesn't understand that some modifications help the shooter be more accurate and controlled, and thus safer for bystanders, then you're screwed either way and you probably should not have set foot in that jurisdiction, especially armed, in the first place. Going the technical-route for the prosecution is risky: the average lawyer knows diddly about intricate mechanical devices and runs the risk, themselves, of looking like the fool if the gun-owner on the stand knows his/her business and is smart about it. The lawyer looses the confidence of the jury that way, so they would tend to be less-likely to pick at that issue.

I've been following the rule for my carry gun that for any modification that I consider making, I should be able to justify that it's related to safety. If it helps with aiming and accuracy, then it reduces the chance of hitting anything other than an intended target. If it helps with reducing time to the first shot, time between shots, then it increases my time to try methods of de-escalation other than firing the gun to stop the threat. And personally, I make my aesthetic choices tasteful and complimentary to my overall wardrobe, so I can make the case that in addition to simple aesthetic preference, it helps with the concealment of the firearm and is intended to generally reduce overall stress of those around me. Even my carry ammo choice is something that I think about as being something that should stop or slow down significantly to prevent damage beyond the intended target. Not saying that it's legit legal advice or has ever been tested, but I think that generally being ready to demonstrate your effort in total risk reduction is more valuable in a court room than letting a prosecutor paint you as only being ready for an armed attacker at the expense of being a general liability to those around you.

In the Kyle Rittenhouse trial the prosecution argued to the judge that the police did not measure the Kyle's rifles barrel length when they put it into evidence therefor it can not be assumed to be a rifle. He did this to try to argue that Kyle was illegally carrying a pistol as a minor to try to add another charge. The judge had the rifles barrel length measured right there in the middle of court and did not allow the prosecution to bring that charge.

According to my attorney and my personal principles. Modifying your carry pistol only succeeds in making his job harder. Although, he did say that out of all the mods you can do to your carry gun, there is one that should *_NEVER_* be touched - the trigger. Modifying the trigger in _any_ way, shape or form makes your argument exponentially harder. _"It's just not worth it"_ as he would say. He also echoed my sentiment which basically says. If you absolutely must carry a gucci gun, then I suggest buying one from a manufacturer that includes all the must-haves _without_ the need to modify _anything_ yourself. While I am not a fan of gucci guns per say, there are several companies that produce them straight from their factory _with_ a factory warranty. Shadow Systems, Danger Close Armament, CZ Custom Works. Wilson Combat, BUL Armory, etc. Whereas, firearms/defense instructors will always preach - _"Why not use every advantage available to you in a life threatening situation? If that means modifying your pistol to _*_win_*_ that gunfight, then so be it!"_ Wise advice but they are not the ones you should be listening to for legal advice. I prefer to listen to my attorney while still seeking appropriate training. You have to be cognizant that your choices inevitably have consequences. Stay classy my friends. *6:13 mark. Good point and one that I adhere too but completely forgot to mention. Any and all mods that are performed on my carry pistol(s) are performed by my certified gunsmith. He also signs his initials and date on the invoice/receipt upon completion. I have been doing this long before I even had an attorney. Sort of a CYA method. While that sounds contradictory to my previous statement. I can assure you that these "mods" were not gucci in any sense. For instance, on my G19 Gen 5 MOS, I had him install the CHPWS plate, iron sights and RMR all at once. Even though I can do this myself, it is my daily carry pistol. Therefore, these rules are non-negotiable. EDITED for forgetfulness.

Like you guys, I did some research several years ago on this topic, and I could not find a single case where the decision of guilty hinged on a modification to a firearm. In fact, the only time modifications came up were when the defendant claimed "it was an accident" or "the gun just 'went off'". More recently, cosmetic things have been mentioned in orals by prosecutors, but I've not seen much evidence that this has held any sway with jurors. If a feature of a gun is being used against you, call an expert witness to nullify it. I carry an M&P 2.0 Compact with XS Bit Dot sights. I used to carry a M&P9C with Big Dots and an Apex Trigger until the 2.0 Compact came out. I have been practicing with the 2.0 w/ red dot, but not proficient enough to carry it yet.

Glock 19. Purpose built and Modified because I enjoy target shooting. Happens to be my carry gun because I am good with it. Gen 3 frame. I filled the back strap and shaved the grip to a 1911 type angle. I learned to shoot IPSC with a Colt .45. I found the Glock presented muzzle upwards compared to my 1911 due to the bulge in the back strap so I changed the angle. Installed a Grey Ghost Precision slide and barrel, Trijicon RMR, Tungsten guide rod and spring, and a Timmney Alpha 3lb trigger. I practice and shoot as much as I can. I shoot for fun, not in preparation to shoot a bad guy. Reason for the Mods in relation to carry gun - more accurate so I am less likely to miss and hit an innocent. I wear glasses so the Red Dot gives me a clear sight picture and I can focus on the target compared to iron sights. Smoother trigger so again less likely to pull a miss. It's a tool, not a work of art or safe queen. I don't think about the cost if it ends up in an evidence locker. I believe with a stock Glock I might not be around for it to matter. 99% of firearm enthusiasts don't know the difference between a series 70 1911 vs a series 80, let alone some random DA, so you're carrying a gun based on your own preferences, not because the differences in internal safety mechanisms is slightly different between the two... that's just absurd.
@ScottAT

@@JJ_SDWR absurd? Yes, it is based entirely upon preference. Series 80 firing pin block components represent a fourth safety device that increases trigger pull aka greater chance to miss. In it’s place, a Titanium Firing Pin and stock or extra power firing pin spring negates the need for such a device and improves lock time aka accuracy. I built this carry gun with my own hands. I as a lefty use an ambidextrous safety, and I put Maryland Gun Works high visibility sights on it and used Evolution Gun Works internals. I have my own line of what I call “Service Match” M1911-Al’s I build from the frame up. I have been doing this since 1991 and was an apprentice gunsmith, and I hold a degree in Gunsmithing as well as Aviation Technology as I am a retired U.S. Army Aviator. If something is based upon my preference, it is because I have been trained to know what is best, and I can explain that in court. In other words, without prompting I gave my series 70 pistol the same degree of safety as a series 80 without the need for extra parts and made it “California compliant” without prompting. The handgun is not frilly, just a glossy black with walnut grips and some skateboard tape across the front strap because I would rather masturbate with a cheese grater than spend hours checkering the front strap myself because I can’t stand doing it. I replaced my modified G3 G19 with a stock Sig P365XL Romeo. The Glock was purchased in Kalifornia where selection is limited. Due to my smaller hand size the grip was modified by grinding the finger grooves, reducing the hump, stippling, undercutting the trigger guard, sights, Apex trigger kit, and a 4.5# Ghost connector. Trigger weight and reset pretty much matched my stock P365 so I figured I could make a case for all these mods even though I did them myself. But I decided why risk it. So I bought the XL Romeo and got better sights for my older eyes, almost as much capacity and barrel length while sticking with a stock firearm. The G19 is now relegated to a bedside gun with the addition of a TLR3 light.

Depending on the weather I carry two options. In warmer temperatures I carry a Sig SP2022 stock. It's hammer fired and DA/SA so I can comfortably carry with a round in the chamber since it has no safety. My cold weather option is a Rock Island 1911 in 10mm and the only modification I did to it was to add a slightly flared magwell. Nowhere near a competition flare, but definitly a big improvement over the flat that is there on the factory 1911.

If you face prosecution or litigation for the lawful use of your firearm and they bring up your firearm modifications, the best way to combat their allegations is to defend them by stating that the goal of any lawful use of a firearm is to stop the threat in the safest possible way with as little risk to innocent bystanders as possible. Then explain that the modifications to your firearm are intended to do so, by making your ability to aim and fire the weapon as accurately as possible, while engaging an active threat to you and/or others. This includes things such as trigger jobs, night sights, lasers or lights, grip texturing/stippling, and even suppressors.

I also have a TRL7 light on it to positively identify what I am aiming at in low light situations. Hopefully I will never have to pull it out and use it. I don't consider it flashy, but you make some very good points about thinking from the other side. I might upgrade the trigger group if I can determine what is the best one out there. I would not want it to be flashy or bright colors, I would rather have someone not know it is a high end trigger until they fired it.

Love your videos overall-this is a GREAT subject-the fault would be speaking to lawyers-not because they aren’t knowledgeable-because they get paid to argue all subjects from a 360 perspective. They will bring up all the things you mentioned and more-BUT the case centers around, as you point out, good or bad shoot. The rest of that stuff is smoke - with exceptionally little benefit. An argument could be made that a scary gun might stop somebody from committing a horrific act. I live in the worst state in the Union for guns-CA. I modify my guns grips, sights and magazine disconnect. Why? I am a 34 year honorably retired law enforcement executive. I have been trained and have trained others to make legal and policy conforming changes to their weapon to achieve the best result for accuracy. Not accuracy for hurting people more effectively, accuracy for safety purposes when training to build efficiency in shot placement. Every law enforcement professional I know does not own a gun without the magazine disconnect function disabled. Why? We are trained to be able to do a hot reload - and I sure hope like hell I can fire my last remaining live round if I have to when changing magazines to reload. I do agree with ignorant sayings on gun parts etc-because they will try to show intent and or malice with some idiotic saying or image on a gun. I have been carrying a gun legally since 1972, and fortunately have not had to shoot somebody in the line of duty, off- duty or in retired status…but I guarantee you that IF that unfortunate circumstance presents itself-I will be ready with consistent training and the safest and most efficient gun for my personal protection purposes-without regard for what my weapon looks like. Keep up the good work!

I completely agree. Changing trigger weight/sights/grip might be brought up by the prosecutor (remember how Binger tried to make a big deal out of Kyle using fmj ammo), but it is refutable. Simply speaking, putting an RDS on your Glock is not the same as walking around with a hand grenade with no pin. But the cosmetics is useless in terms of combat efficiency and is hardly defensible.

I carried a Glock 27 for years, even though I have had lots of experience “inside a Glock” I am not a gunsmith so I actually had Caleb do some minor enhancements to my carry Glock when he was at a gun store in Baton Rouge. I now carry a Sig P320 X-Compact that is 100% factory stock and will remain that way. I teach concealed carry classes in Louisiana, Although there are no laws that prohibit the modification of a carry gun, I always encourage my students to leave them original or have a certified gunsmith perform the work. A “stock gun” will not clear a person from a negligent shooting and a modified gun will not convict a person in the event of a clear self defense shooting but a modified gun can definitely cloud a clear self defense case. I carry a stock M&P performance center shield plus. Now! While I’ve never heard of a modification becoming an issue in a defensive shooting, I was hired as an expert witness for the defense in a murder trial (State v. William Thomas Gule, Jr.) where the defendant was claiming a modified trigger was the cause of him shooting his baby’s mama 4 times in the face. The pistol in question was a Glock 43 that the defendant said he installed a 3.5# connector in and that the modification caused the Glock to discharge unintentionally & fully auto. I explained how the pistol worked & test fired it to show both sides it functioned correctly, needless to say I couldn’t help the defense out so he paid me and cut me loose. But when the case came to trial, the state subpoenaed me as a witness. He was sentenced to 40 years.

This is sound advice but in the end, it all depends on if the prosecutor is after justice or a conviction at any cost. I have observed cases where a prosecutor went after a defendant that used ball ammunition because it could pass through the victim and injure more people. Yet, the same prosecutor will go after another defendant that used hollow point ammunition because it fragments, expands or "explodes" and thus causes more significant wounds. Some of these prosecutors will try to use anything to get a conviction.

And that is an issue that should be brought to the forefront of social issues. Trials, especially with firearms involved, have been turned into politlcal witch-hunts, where prosecutors attempt to win brownie points with the public or politicians (in an attempt to secure their job or a better one). Instead, prosecutors should be held to the standard to uphold justice instead of obtain a conviction at all costs. Unfortunately, most prosecutors are in their positions because they have political aspirations, or they aren't successful in a private practice. Very few do it because they are committed to upholding justice. The old joke goes "What do you call the person who graduated at the bottom of his Med School class? Doctor." Attorneys are in fact license, trained professionals. However most people's experiences show that good attorneys usually specialize in business, corporate, or high-profile criminal defense. Cases that are far more lucrative. A good lawyer is more valuable and is able to make more money, and the money is not in prosecuting (while they may live a comfortable life far exceeding the average American, they are by no means rich).
