The initial response to the patron for denial of service was "there are no tables available". Dress code was not mentioned in the initial response. This denies the patron any knowledge of a valid pretext for service refusal. This in turn allows the restaurant to deny service to the patron in the future by withholding from the patron information necessary for preventing a future denial of service based on the dress code pretext. It was only after the patron observed and noted that the initial pretext, "there are no tables available", was demonstrably false that the dress code pretext was mentioned.

Just to address your pretense (no pun intended), "pretext," by definition, can't be "valid." 😛 But... to your assertion, maybe the restaurant didn't want to cause embarrassment or elicit a confrontation by saying "it's your clothing" and chose to give another, albeit potentially unjustifiable, reason in order to avoid (further) problems. Wilkins admits in another video that he was wearing pants "with a stripe" (i.e., track pants, possibly similar to the pants worn by the guy who walks behind the reporter in this vid (1:50)), which, according to the manager, is against their dress code.

This was covered on channel 2, I think, yesterday. The restaurant said the gentleman was wearing athletic pants with a stripe down the leg which is against their dress code. The basketball star even said he was wearing athletic casuel dress according to the news yesterday. They also showed many diverse diners at the restaurant. An African-American patron was interviewed and she said the restaurant's dress code applied to everyone equally. Shame on you Fox 5 for making this appear to be a racial discrimination issue. Even though there was a diverse crowd of patrons the restaurant manager still apologized for the man being turned away. Report all the facts Fox 5.
