It is the restaurant's definition of business casual. They are allowed to define their expectations of business casual. The restaurant just needs to be sure to word what is not allowed specifically and stick to it. They have issue with athletic wear not shorts or backless tops, they can do that.

More information is needed folks to give better informed opinions. What exactly is the dress code and How is it worded? Next question is where is the dress code displayed, how many places can this dress code be found especially BEFORE entering the restaurant. Is it on their website and front door? Once inside it should be displayed again at the host stand.

Being in the restaurant business for over 20 years including managing, you'd be surprised what guests complain about and expect you to fix it or do something about it. I wouldn't want to even dine at a restaurant that imposes a dress code. I find them to be very elitist. I understand denying people with no shoes or being partially nude but the way of the world has changed in terms of how people dress and what they deem to be nice. We live in a society that operates on wanting to be comfortable so jeans and t-shirt are what people choose to wear when they are not at work. Why penalize someone who has the money to pay for their meal all because they wanted to be comfortable and not feel constricted in dress clothes. Dress codes are an easy and justifiable way to discriminate against people for things that may not have anything to do with their dress code.

Believe it or not but sweat pants for bed are not the same as jeans. But business casual are not booty jeans lol
