Photography of food is a separate art from general photography. It is absolutely a specialist area. From the treatment of food, to the substitution of various foodstuffs (mashed potato is substituted for ice-cream). Not just any photographer can shoot food!

Lol most food in pictures is inedible due to all the substitutions and chemicals used for the appearance. Thats why the picture of that juicy hamburger you want, never looks like the photo.

Food photography is all about the fine details. More credit to photographers that specialize in that. They know the right way to play something as chaotic as a burger and fries to look natural. I'll still to portraits and event photography.

Normally, JM's constant interruptions can be somewhat irritating but watching her relentlessly light into the defendant for being stupid enough to think that leaving dairy products in a "cold part of his studio" was a sufficient substitute for genuine refrigeration was hysterical. He was getting big mad, too 🤣

They both dropped the ball. She had at least one opportunity to go over and supervise the photo process he offered and she didn’t take it. The photographer should have taken the time to go over the project with her and get details in writing. A professional would ALWAYS do this with any business to avoid exactly this kind of situation.

she discovered that she could take her own pictures with her phone AFTER she already paid the photographer and she simply made up a story to justify trying to get her money back after he had already taken the photos and earned the money . its a simple case of buyers remorse and the defendant did not drop the ball .

Yep. Also I'm pretty sure they get a small payment also. Because sometimes I wonder why they even do it and I believe because everything's paid for and also they get a fee win or lose. I could be wrong though.

The other thing, too, is that *YES* she should have given him verbal and written instructions on how to care for her products before they were photographed, and *had him repeat the instructions back to her* so that she knew right then and there that he understood them. Seems a bit patronizing, but, no harm in double-checking for clarification.

I agree. When I have bought or sold something, myself and the buyer or seller would type out the item and details and then the other would agree and type the same thing back. If your not gonna have a contract at least go over what's going on through text or phone.

@@daniellesimone7939 the main issue was she dropped off everything and left. The photographer should have set aside studio time or just photographed at her bakery. They both are kind of at fault, but that's what caused the back and forth.

If I was a photographer and my client told me 'here is some frozen food, put it in the freezer and only take it out when you are going to photograph it', I would say 'please don't treat me like a baby, I've photographed food before, I know what I am doing', this guy knew nothing about photographing food and was too ignorant to know to refrigerate food...

While the baker breached the contract, and she didn't give proper instructions, you have to be a complete idiot to not realize that dairy will spoil if not put in a fridge or freezer. He just showed himself to be a complete idiot. Anybody over the age of 13 should know that! Likewise, any adult should realize what shelf-stable means.

Allergen friendly is just the opposite of what you are trying to say. It would imply that the business owner welcomes the use of all possible allergens. For good reason the business owner is very precise in her wording: nut-free, gluten-free, soy and corn-free.

I understand why the plaintiff had second thoughts about a photographer that didn't seem to have common sense about photographing food. But since money was already exchanged and a contract was entered into, she should have been more involved at that point to get the shots that she wanted - like supplying new food and being there when the photoshoot took place. She breached the contract even if he was lacking in common sense.

It's amazing how many so-called business people end up on here having never done a contract with their client. Even if you were on the smallest level of business there should always be a contract or agreement in writing. If there's anything people should learn from The People's Court it's: always have a written contract, and when money leaves one hand a receipt enters the other.

You cannot let a cheesecake sit unrefrigerated for a week and expect it to look fresh for photographing. Food can't just sit around for days, let alone weeks to be photographed. Unless you are doing a study in composting.

I did a photoshoot for KFC once, and KFC sent the art director, the marketing head, two graphic designers, plus a higher-up executive, and they micro-managed every tiny detail, including supervising the cooking of the food. It was the hero shot for a food delivery service, and we spent over two hours adjusting the food, and the art director and marketing director constantly over my shoulder at the computer as we took the shots. They didn't care how much time and money they spent to get the final shot, and they weren't leaving until it was perfect according to the way they envisaged the look that represented their product. I loved it. That kind of perfectionism is so easy to work with, and they liked working with a professional photographer with the high-end gear and ability to work with them that they required. Over time there would have been huge numbers of eyeballs on that image and KFC wanted them to all desire the food. What I dislike is clients like this baker. Too busy to turn up to the photoshoot, yet expecting the photographer to be able to read her mind. But then, 300 bucks is a low price, and she ended up getting the result that her actions created. Communication is the single most important element of any photoshoot. However, this photographer was a little short in the communication department as well.

The big mistake here was telling a photographer to "just take your time, no rush" when photographing fresh baked goods. They should've set up an exact day and time when she would bring the food and he would photograph it right then. And what's wrong with Photoshop? There's no doubt whatsoever that all the big name brands use it for their ads and packaging.

I think that she approached it incorrectly. She should've said in the emails that her deserts are getting old for retakes and that doesn't want to reserve another set of deserts to be only for photos. Then proceed to say that the proofs/unedited photos look like smartphone pics. Then mention that she has attached photos that she look with her smartphone (then say what it is). Then say that she still would've used their service if she knew that the quality of pics would be smartphone quality. She would've sent pics that she took and had them edit them. She could've leveled with them and asked to get a discount and just pay for them to edit the photos. They were probably using Photoshop (since that was pretty much the only decent/good photo editing software). Which that program for over 10 years has been on a subscription base only. So if someone else already knows how to use it and they're already paying for the subscription, then at least pay them for editing. Also, $300 is what a lot of people might just charge for editing, so having them edit your own photos with fresh deserts seems like a good option that she should've tried for...

CPS taught us in parenting class that if you leave milk out of the fridge it can go bad. Same is true for bologna and cheese. Also you should but spoiled food in the garbage and take it out every few days.

In this case, why didn't they use the theory of habitability? I know they committed to a poor living environment but the law says you're supposed to have lights, water, and other aspects of a habitable environment. In part cases, the judge has given people their money back based on this theory so this one is a little confusing for me. Even if they paid, she'd grant them the return if they didn't have a habitable environment.

If I was the plaintiff, I would have told the defendant, "Make sure you keep my cheesecakes in a fridge or freezer until you're ready to take pictures of them." I still would have just reminded him, but Judge was right he is a grown man, and everyone knows you are suppose to keep food in a fridge or it will spoil and mold. It's common sense.

I think JM got this one wrong. Any idiot knows you refrigerate cheesecake, and I do think that had an effect on the quality of the pictures. He seems like the artsy type who would be very difficult to deal with. His way or nothing. I think the plaintiff had a legitimate gripe.

Actually no, because they had a contract and she had many options she could've went with to avoid something like that happening in the first place, like taking her own photos (which she eventually did anyways), hold the photoshoot in her own bakery with the guy so that she could watch over what he was doing and making sure it was right, finding a special photographer whose specialty is food photography, etc. The point is, they had a contract with each other that SHE breached, whether he did a good job or not wasn't a condition to whether or not the contract was allowed to be broken by law. It was whether or not he got the job done and he did. She doesn't get to stiff him on the payment when he did do the work.

Defendant was negligent , but not to the extent where he doesn’t get paid anything and have to return the money. He did spend the time and effort for taking the photos. Plaintiff is mistaken by thinking by having a web site and good pics , she’s going to be a big rich business . Anybody can set up a site ; but will anybody go to the site ? Usually not. She should try setting up a site with quick pics , and see if it’s doing something, then get professional pics. Business spreads by word of mouth.

I am somewhat wondering why neither semmed to commmunicate about storing the merchandise. She didn't tell him - and he didn't ask. I do agree that she was more responsible to tell him that. yeah its obvious that cheesecake needs to be refrigerated, but what about the other stuff? She also needed to be specific about what was wrong with the shots (she stated that the key lime pie crust had separated - but what about the other stuff? It sounded like she should have brought him all new stuff if she felt the food had spoiled in the photos something I've learned from JM that I didn't know before is : you need to give the contractor the chance to fix the mistake - unless there is something preventing them from doing it (like you are both angry) or if one side suddenly disappears (which it sounds like this guy might have done - but didn't get brought up as the main argument in the case

Yes, she didn't give him specific instructions. She assumed he was a reasonable adult who would know these things, and it turns out he wasn't.

... It surely is annoying for stuff that is cold when you touch it to just be left outside of the fridge or freezer. She says that she told them about that doing that. That part is out thrown of the window 'cause she at some point after pointing out that her stuff is looking like it's getting old in the unedited proofs she was sent when she then suggests bringing a whole fresh set of all of the deserts. I wouldn't offer that 'cause that's another set that's not gonna be able to be sold. Plus if I told them to keep specific items cold and they didn't, then why wouldn't they do the same thing with the second set? It took long enough for the pics to get done that even the non cold deserts were getting old. Agreeing to start from the beginning with a fresh set of deserts is what makes her lose. It's like after the new batch of deserts suggestion she gave, then she thought about it and realized that the proofs were no better than smartphone quality, her deserts were left to get which means she doesn't know if that'll happen with the second batch, and she doesn't know what the quality of the editing would be. That's what it seems like is what happened. Which is too late if she never explains that to them before saying that she wants her money back.

I thought it was odd that she wasn’t in a hurry for him to photograph perishable food. Then was willing to take him fresh pies. Why not just give him the shelf stable food and then plan a time for the shoot so she could take the perishable stuff when he was ready. She was really laid back about it and then suddenly she wanted her money back.

Miscommunications on the plaintiff. How about not. So he's saying that she didn't tell him to refrigerate the dairy products. So that's why he didn't do so? Ok. Then someone gives him a jug of milk and doesn't tell him to refrigerate that. With his logic, if he wasn't told to, then he's not gonna. So he would leave that jug of milk sitting out for days or more? Some things are just common sense. It comes in cold. So he thought on his own to not refrigerate it? It's sad that certain things that are common sense are things that people have to be told to do. People seem to love to use the "I was never told to" excuse for something that's common sense. Plus you have to get the telling them in writing since even if you say it and they don't it and that makes a big issue to the outcome, then they'll deny forever that you told them. So having it in writing shuts that typical go to excuse down.

I feel the photographer disregarded her instructions and left those boxes sitting out for weeks(according to him)before shooting the photos. My gawd, it was cheesecake and pies. What moron just leaves it in the corner of the room for 2 weeks before taking photos? Even more shelf stable foods like bread would look bad after so much time. The Defendant knew it was food, he didn't even take a MINIMUM of care with her food products. Not very professional.

So none of the plaintiff's arguments were working and then she decided to switch to, "He went to Italy, he wasn't answering any of his calls" at the very end. Too late.
