The plaintiff hired and paid the defendant to build her a new deck. Unfortunately, the plaintiff claims the defendant took off with her money and never did the job, so she’s suing. The defendant insists he told the plaintiff it was going to take time to obtain the permit for the deck, and all of a sudden, she changed her mind and demanded her money back.

The problem here is not how long it took. It’s the breakdown in communication. If you see a CUSTOMER calling you three days in a row the least you can do is respond by text to say you are busy and will get back to her. She doesn’t know you personally to know how long she’ll have to wait for you to respond. COMMUNICATE people. Effective communication usually solves 90% of our problems.

The plaintiff does realize he wasn't hiring on to be her personal contractor doesn't she? She was completely unreasonable in her self imposed timetable. I find as some individuals age, their awareness of time is off, they want what they want, and they want it now!

Well she did say she didn't know any contractors maybe she just didn't know th process. This has nothing to do with age, ppl like that are in all age groups. She may just not have known and will store it as a lesson learned.

She got pissed because her phone calls weren't being answered for a few days, and threw a tantrum. You don't get to break contracts because of your temper. I'm sure the contract had his email address...coulda tried that.

Absolutely! I'm married to a Contractor and during warm seasons he gets BOOKED by so many ppl..We use cell phone, home phone and email address bc of how busy it can get. The plaintiff was inpatient and overzealous when it came to contacting him. I would understand her nerves after a week or 2 then I'd get worried,,but jobs needing permits can take 2-4 weeks depending on jurisdiction..

With all the fraud going around I would have been nervous too if he didn’t respond to me after 3 days and I had given him $1,500. He should at least send a text acknowledging he got her message.

Yeah if I handed over $1500 and didn't hear from you after 3 days it would've made me uneasy too. It's easy to send a msg to say I'm booked and busy

I find it very funny that they have all this extra information after the case is over, just to say they didn’t get to share it with the judge. The other lady should have spoken up as a witness if that’s the case😩

Yeah, I agree with the verdict! Nothing and I mean Nothing really goes to plane with a construction project. 3 days, that's not enough time for the ink to dry on the contract.

permits only cost around 70 bucks and contractors are not allowed to ask for over 10 percent of the total amount of the job so this verdict makes no legal sense . i think the judge forgot alot of the laws and needed to brush up on them

If you can take a customer’s deposit then you can respond to a call, email, or text in 3 days. We’re all busy. The fact that a contractor can’t take 20 mins at the end of the day to respond to customers is BS.

i think if the guy didnt have a full mailbox for three days and if he simply just gave her one call back in that 3 day period then she would have been ok to wait longer but a full mailbox and not getting back for 3 days looks shady when it took him a few minutes to get back to her for that deposit money .

Which he knew because she stated that over and over. I think she panicked when she kept calling and couldn't even leave a voicemail, it was the only contact information she had and he couldn't even bother to call her back. All these people in the comments act like elderly people don't get scammed by contractors all the time.🤷🏽‍♀️

Plaintiff has no clue how city government works and obtaining a permit. Her attitude is like permits can be picked up like grabbing a hamburger at Wendy’s. Not to mention that she hired a man that is just him or a small crew that has other jobs ahead of her vs a large company with their own/outsourced crews. Her ignorance was the cause of her own troubles and that ignorance trickled down to hurt the contractor. Then she has the audacity to be self righteous in the hallway. It’s one thing to be ignorant. It’s another altogether to chose to remain that way, as the plaintiff has.

if thats the case then why are all these contractors collecting so much up front money ? why not get the permit first and then proceed from there ? the permit fee is only 70 bucks , so why is he collecting 1500 up front ? this judge is way off on this case .

No, it's highly NOT unusual in this line of work. When the busy season gets going, you'd be flabbergasted at how many calls & messages we get (a great deal of them being hang-ups).

It's not amazing it's quite common..My husband is a Contractor and during busy seasons it happens..What did she need to contact him over? It was literally 3days.. She was inpatient and unreasonable and cost this man other jobs

At the end, they said he texted them and even agreed to give their money back... that means they were in fact able to contact him through text. So there was communication. It for sure sounds like she changed their mind and was finding an excuse for why they should get their money back.

3 days!! I mean sometimes after the first visit with a contractor the next visit is like 3 DAYS!!! Oh my gosh...I mean we are talking about a deck here. For a busy contractor like this man, her deck wouldnt be ready for at least 2 months. Yikes..

Why are contractors allowed to not call a client back for 3 days? All other professions are held to a higher standard and expectation. I think the judge is partial because she has stated numerous times that she comes from a family of contractors.

Communication is important to me so whenever I am thinking about hiring someone, their response times make a big difference to me. The contractor who built our house was always available and amazing to work with so I have recommended him many, many times over the years.

Wow! This plaintiff is really impatient! She seems like a smart lady but 3 days and she's done?! No, I think she wanted his undivided attention and that doesn't happen in the contractor world. I agree with the verdict. If she wants a deck built she needs to be a lot more patient and the defendant needs to check his messages more often.

It's also his fault. She's not privy to how HIS BUSINESS WORKS. He should have told her the time frame and Judge Milian comes from a family of contractors so her opinion is biased. The plaintiff shouldn't have brought her case here. Period.

That’s wild. I guess I could understand her getting worried when he’s not answering her calls/calling her back and she had no way to leave a message for him. He didn’t even text her back saying “I’ll call you at this time”. But once he called her and tried to work it out, I feel like refusing to go forward was kind of extra.

3 days isn't enough time, however..... She is older and he cold called on the phone originally to get the job. So then she gave him money and couldn't reach him, she got scared he was a scammer. He should have called her back, he seems nice, I wish he gave her half the deposit back though.

I'm not a contractor but I do work with them. Permits you can't really put a timetable on. When the city decides to look at it and issue it, it's all on them. I had a tenant that wanted an AC unit installed. My contractor told the tenant as soon as you give us the green light we will put in for a permit. This was in November. Now in March they gave the green light and expected the unit to be installed in two weeks. WTF the permit will take 6 weeks. They told the tenants it will take 4-6 weeks to get a permit. Now the tenant is calling the contactors hacks because they can't deliver on their timetable.

@@marleonetti7 Contractors can literally take whatever money upfront they and the customers agree to in the contract. I think you are conflating overrun costs - which are limited to 10% over estimates - with actual job cost estimates, not including change orders, etc.

As a contractor who has worked with home advisor I can tell you there is more to it to loose the account. One customer complaining like that with no ability to defend himself will not loose the account. Something else was going on.

JM missed it in this one because once he said he will give her back any money that’s what he has to do. I think she was wrapped up in the fact that her family has contractors and begin to give too much of her own feelings in regard to the case.🤷🏽‍♀️ Maybe if she stop talking and let the people present their case then it would have been fair.

My parents house burned and it took a year for the contractors to fix the home. A hurricane hit my home and it took the insurance 7 months to finally agree to fix my roof. And then it took another month to finish putting up drywall in the patio bc there was still leftover damage from the hurricane that hit 7 months prior. So yeah. It’s a waiting game.

He got away with this scam but he wont get away again...she didn't present her case well. She told Doug more than she told Judge Milian. He was a piss poor professional...

I’d love to know if the plaintiff ever found a contractor to do the work in the timeframe she wanted. Contractors are good at pushing work back by months, not just days. It’s frustrating, but it also keeps the price down. If you want to be able to hire a contractor to start work immediately, you better be prepared to pay wayyyyyy more.

I think judge should have questioned the plaintiff like she questioned the defendant. There was no stated pending date that materials delivered and work would begin? If contractor submitted scope of work to city and she backed out after and also trashed him on a web service he pays for after 3 days,then yes he deserves to keep her deposit . I think there was more to this but the contract was the binding factor.

I have had a contractor take my money 1 time and disappear once that happens you find it hard to trust and it was the 2nd job he had done for me!

It sounds like theres quite a bit more to this case - and It also sounds like JM was biased a little towards the contractor. If I just signed a contract and then the guy ghosted me for 3 days and I can't leave a message? I might give him enough time to call me back and then tell him : "if its going to be this way for the rest of the contact then we need to part ways" If you are so busy that you have so many VM that the box is full? either you need a bigger VM limit - or you need to figure out a better way to communicate with clients (maybe an assistant?)

she only lost because she only waited 3 days and most judges will find that too short of a time . BUT , the fact that he has a full voicemail where he does not check the messages and the fact that angies list had to cut him loose tells me that he deals with angry people all the time who want their deposit back so i do believe he was still gonna scam her and never do the job even if she waited a month to complain .

This judgment was BS. If i give you a deposit, sign a contract and then can't reach you for three days, I'd want my money back. Communication seemed not to be an issue until after he took her money. The judge was wrong.

The plaintiff just didn't kno how long stuff like this would take and it cost her in the end. Now she knows if u hire a contractor to do a job,gotta wait a bit before they start. Unless they have nothing else really before u

He tried to rush and draw something up for court purposes. He knew he was working for someone who was paying more than she was so he was working for them. Judge is always iffy for certain litigants. He should have answered his phone and actually COMMUNICATED SOMETHING TO HER! It’s HER money she gave him. Smh

Unless the contract is stating dates to have xyz done, it is not enough to break a contract because you get impatient within a few days.

Lol!! Harvey’s asking all these young people who probably have never hired a contractor (unless they all own new houses! Lol!!) Plaintiff has obviously not worked with “contractors” very much or she would know how long it takes those guys to even return a phone call! But as JM said, they have lots of other projects going on (not just yours!!) - I would be over the moon if a contractor ever returned our phone call within 3 days!!,lol!! People need to understand they are not the only ones in the world!!!
