The People's Court

The People's Court

Күн бұрын

The plaintiff bought a car from the defendant. He says they agreed on a monthly payment plan, but then she started demanding accelerated payments. Then, one day, she stole his car, so he’s suing. The defendant argues the plaintiff’s first check bounced, and she had to pay the bounce fee. She says she had a right to take the car back because the title was still in her name.

The plaintiff is spinning big time on his property supposedly left in vehicle, mainly I think to put pressure on defendant for return of the car - ie he claims she committed major theft etc. See how he relaxed he is at end of case, there's no way he had valuables left overnight in location a repo guy could get at it relatively easily. Repo guys protect themselves from legal claims by recording anything like that - thats the photos the defendant handed over, The reason why JM is pissed at the end is both these people are BSing big time.

To clarify, if he missed a payment (which he didn't make the last one) fine, go the legal route & either get your money or the car back. However, it seems like she wanted both his money & the car back. You can't decide that someone broke an agreement after you've accepted their money. I wonder if this is the first time she's done this or if this is just the first time she's been caught.

I almost went back to the earlier parts of the video bc I swear I didn't hear her breathing like that until she mentioned the breathing problem. 🤣She needs mental help.

How could you repo a car if you have to get the owner’s signature? That’s ridiculous !

Note to self: If accepting payments for a private sale keep the items until payments are finalized. If it's a car maintain title & insurance until payments are finalized. Easier to repossess your car if it's still in your name.

No you hold a lien on the car, having it still in your name opens you up to law suits should buyer cause an accident. Defendants mistake was she should have used the courts to settle the issue not take the law into her own hands and commit forgery, fraud and auto theft !

@billmoran3219 Actually no, the owner of the vehicle isn't always liable. It's the driver of the vehicle who should be insured, which can be a requirement of the contract until they've completed payments for ownership.

I do not feel sorry for the defendant. Her whining is so irritating. You are not entitled to break the law just because you're old and life has been lifing.

At first I thought plaintiff was in the wrong but after the cross examination of the defendant and the inconsistencies in her testimony i can see why the plaintiff was suing her, she was a nightmare to deal with. He paid out $3000 for the year on the car and was late 8 times but this frightening old lady came to repossess the car 3 times then forges his signature and had an Agency take car back and hides it in another state ? She isn’t that old and frail and probably should be arrested for forgery, fraud and auto theft !

If you can only afford to make a payment of $200.00 a month for an $8.000.00 dollar vehicle then you're not likely to be in a position where you can really afford this vehicle which was clearly evident by the plaintiff's continual late payments. I would never, as a private seller, even consider making such an agreement to sell a vehicle & have it paid off over time, which in this case would take approximately 4 years. Especially with someone you don't really know. As for the defendant, she's just a little old helpless trustworthy white lady who could do no harm to anyone. Where have I heard that same nonsense before?

Never take payments from a personal buyer. Let the car lots do the the payment thing. She should've made him get a loan and pay her in full
