The rule of law used to be based on what has happened, not what could happen. You could tow a 5000lb wagon through town with a pair of sketchy animals, each with a panicky mind of their own and not need any kind of license, registration or insurance. No one would have ever dared suggest that a free man would need government approval of such an activity. Then cars came along and lawmakers saw an opportunity to gain control of the movement of citizens, and naturally couldn't pass that up.
