My brother is an owner operator that primarily hauls containers in and out of east coast ports. There are a few ports phasing in the latest requirements that the truck needs to be compliant with the latest emissions standards or he won't be allowed in the port. Makes sense as allowing container ships that burn #1crude oil entry into the ports. There are business opportunities for companies to go into the ports and haul out the containers using compliant tractors, then charging the OTR trucks $150-250 per trailer. Getting to the point, where there will be no one willing to subject themselves to the BS.

I suspect there may be some sort if legal challenge wherein an ex post facto law prevents a citizens right by making something illegal that was legal. @@paullewis9490 I practice state criminal law and not fed, but there are interstate commerce laws that are governed by the feds. Pretty sure they can't deny a vehicle registered in a state where it meets legal requirements. Called full faith and credit. Otherwise you'd have to modify a vehicle for every state you drive through. I'm sure they'll try to pull some bullshit move to try to stop them though.

@@bigblocklawyer My bad, and you're correct. What cannot be done is to register that vehicle in the state. The State of California has outlawed vehicles it deemed "gross polluters". This includes a slough of older diesels used in commercial trucks. What can happen though is that when a California Highway Patrol officer who specializes in commercial vehicle enforcement, (yeah, they have them), pull a commercial truck over, they may get ticketed for not being CARB compliant with their vehicle. I do not know this for a fact and it makes me wonder how Cal. CHP deals with the influx of Mexican drivers and rigs from Mexico that Obama allowed to operate in the US.

Honestly? pWhat drives legislation is the urban centers. The manufacturing hub of the USA isn't in the heartland any more, it's the LA Basin. And in order for the LA Basin to have even a remote chance of liveable air quality, they need to have the emissions regs. I mean, that's 15-20 million people we're talking about. SF is kind of the same, and if you've ever been in Sacramento on a hot, high smog day, you can get an idea of how bad things used to be. IT'd be nice if the legislators took into account the people who live in the mountain NE of the state--where, if you're going to do the kind of work that living there requires, then you need a heavy-duty pickup. Maybe leaving emissions compliance up to the counties? But then you'd have dickholes registering their noncompliant trucks to a PO Box in Susanville, and keeping them working in Sacramento. What California needs is a nice little earthquake. THe climate's great but there are just too damn many people in the state.

All this smog stuff is garbage. My water truck has been down three times because of the garbage DEF sensors and related problems. Small spread 5 tractors. FYI where your chains are crossing you need to have protection, I used to use an old piece of strap folded over. Or if possible connect on trailer just a couple of inches offset then they will not touch. I prefer the padding.

For a commercial vehicle the year of the engine matters, not the chassis. Put a new engine emissions gear in a 1940 road tractor and all is good. Personal vehicles it's the opposite.

@@dougbrown7413 Not sure what you found confusing about my first post, the date the engine was manufactured determines the emissions compliance. Chassis has no bearing on emissions so long as the system does not get downgraded from what was equipped when it was first registered. It is illegal to ban old vehicles/engines based on emissions, however California has a federal EPA exemption allowing them to do as they please. Clean air act 209 waiver granted in 2000. Personal vehicles have different laws, year of the car is all that matters so you buy a new engine with no emissions equipment and put it in any vehicle made prior to 1973 and CARB/EPA don't have a thing to say. The difference between how commercial and personal vehicles emissions are handled in the law is what makes gliders possible in commercial vehicles, no such thing is legal in a personal vehicle.

The glider business is being killed because these older engine designs won't pass even with new emission equipment. Cali. trucks are for sale up here in Oregon because they can't reregister. California is saving the planet by making you sell your trucks to Oregon! I guess they don't know we're all on the same blue ball. That includes China and India, Pakistan.

Do you know if this CARB stuff applies to non-commerical trucks? We are looking at getting a 2006 Ram 3500 5.9 (can run on the non ultra low sulfur diesel found in Mexico etc). I want to warn you, working as a Port of Entry Inspector and Weighmaster, in the past. They will catch you one day and do what is called an AUDIT. Using funny math they will calculate how long you have been breaking the law, add a bunch of fines, interest and bury you. I had a guy come through, not knowing his audit was complete, and the screen flashed in red blinking numbers $266,000 dollars! His truck remained there for days until he had a program in place that satisfied the State. Good luck, your best bet is straight up honest. I quit because I could not stand to pass out the grief the job required.
