Breakdown of the Situation: Two-Child Rule: The two-child rule was introduced in Maharashtra Cooperative Societies Act and Section 73CA specifically disqualifies individuals from holding positions in managing committees if they have more than two children. This rule was applied to most cooperative societies, including housing societies. Exemption for ST Members: Prior to the 2019 amendment to the Maharashtra Cooperative Societies Act, ST category members were generally exempted from the two-child rule. ST members could have more than two children and still be eligible to hold a position in the managing committee of cooperative societies. Implication of the 2003 Birth: If an ST member had their third child in 2003, this would have occurred before the 2019 amendment to the Maharashtra Cooperative Societies Act, which came into effect on March 1, 2019. Prior to the amendment, ST members with more than two children were exempt from the disqualification under Section 73CA. Therefore, if the third child was born in 2003, the ST member would not be disqualified from holding a position in the managing committee of a cooperative housing society because the two-child rule did not apply to ST members before the 2019 amendment.
