Can the VA Reduce Your Disability Benefits?

If you're receiving disability benefits from the VA, you might be wondering if your benefits can be reduced. The answer is yes - the VA can reduce your disability benefits! The VA will send you a proposed rating reduction if they believe your condition has improved.
However, it's important to note that the VA can only reduce your benefits if you provide them with evidence showing that your condition has improved. The VA will not automatically lower your benefits without proof that your condition has changed
If you're worried about the possibility of a proposed rating reduction, there are a few things you can do to protect your benefits. First, make sure to keep any and all documentation of your condition - this can include doctor's appointments, hospital records, and test results.
Second, stay in touch with your doctor and keep them updated on any changes in your condition. This will help ensure that your medical records accurately reflect your current status.
Lastly, be sure to attend any VA appointments or hearings related to your benefits. These appointments provide you with an opportunity to explain why you believe your benefits should not be reduced.

@@FMD023 I must ask because I've been told that 100% qualifies me to apply but I was also told that in addition to being 100%, I must also be 65 which was the genesis of my question. I just wanted an opinion of someone who had applied for the benefit and what was their experience. Thanks.

Great advice CC! If you are 100 P&T you should definitely get treated for things you didn't claim, but don't file a claim. Just hold them in your back pocket if a veteran got reduced.

You are absolutely right on point! Years ago, I in-person appealed a lowballed rating at my local VBA. Less than a month later, and to my utter surprise, I was rated 100% P & T, plus the reviewing rater also awarded me SMC. Craig, this is excellent advice! I’m 100% P and T for 10 years now. I could claim more but I don’t for exactly this reason.I also do not go to the VA hospital anymore. It’s not worth the stress. I worked my way all the way up to the regional director and still couldn’t get basic care. I pay for private care. I want you to know, that 3 years ago I read the SMC regs and found out I qualified. The regs say VA is automatically supposed to award it so I claimed it and got back pay for 7 years. When u are 70, you should do the same.

I tell all of my veteran friends. If you are able to work any...try and pick up a skill or trade to open a business in the future because you cannot totally depend on the VA. They can change anything any time they want. Use the help as a ladder rather than a permanent solution. Everyone's situation is different, and some people cannot do any work period...that's understood. Just never close your eyes and rest assurance in the VA. You may get surprised one day.

Great viedo!!! I must consider myself very lucky. I was rated 100% P&T for one (1) condition, 35 years ago. 10 years later, I was 60% additional for several other conditions. I worked with the Disabled American Veterans (DAV). I filed a SMC claim and went to 110% not using VA math. But it was adjudicated to at least 60%. I qualified for SMC. Howeve, after watching your Viedo, I wasn't cognisent of how much of a risk I was taking. I'm 75 years old now, and in retrospect if I knew what I know now, I would have just left things alone.

This is true, if you do not go the VA may look at if your injuries have improved. In reality you are still hurting and don't like going. You are better off getting regular check ups with your Doctor at the VA, so it is documented. It is a once a year check up just like a family doctor. They will send you to the specialist needed. But every record is kept, and pains, I juries, etc... noted. Also there are some illnesses that you get that become automatically 100%, example ALS. The VA will come to your home, set up or wheel chair, anything you needed for service connected injuries. There is a reason you are service connected. Combat or non combat. Injuries. Keeping up with all the check ups will be beneficial especially if injuries get worse, and the VA would cover keeping you and your family any financial burden.

I was very surprised when I received the letter from the VA stating my compensation. I was receiving compensation for my H&T for 8 years and filed for PTSD in 2018 and received compensation for it after only 9 months of review. I filed for Agent Orange exposure at my VA doctors recommendation and was awarded the 90% P&T in just 20 days after filing. Miracles do happen!

Hi Craig! Great stuff. I’m 90 percent and have unemployability. In 2012, the VA awarded me 20 percent. I fought that and in 2014, I was raised to 40 percent. In 2016 , they rewarded me the housebound benefit. they then sent me in to do my back exam in 2018. I was at 40 percent as I said. Months later, they told me they are lowering me back down to 20 percent. Butttttt they wouldn’t lower my overall. So, I didn’t fight it. Then the tinnitus thing came to me in the mail. So I asked for an exam. All that came back and to my surprise, so did a response saying “oh by the way, we are gonna take away your housebound that we gave u nearly 6 years ago. But, because they didn’t explain that, they raised me back to 40 percent till I send in a response of what I’m gonna do. I’m perplexed. I don’t want to lose that extra $350 a month. Nor do I want to fight them and maybe lose anything more that I have. This frustrates me. Do u have any advice? I’d really just like to sit down and talk w these guys without all the hassle. Since they raised me back to 40 percent till the response time is over, I’m technically at 40 percent for over the 5 years in the cfr. I don’t know. Sincerely, sad, angry and confused! If you're receiving 100% you should be receiving smc-s (housebound) if you have one rating at least 100% and an additional 60% in ratings. This is automatic and does not have to be applied for. You simply need to make them aware you are entitled to it. Went through this a few years ago.

During my post, post-rating meeting with my VSO I mentioned this and inquired about resubmitting and was told exactly what you’re stating in this video. Because I have a 100% P&T rating it’s best to just let it ride, claiming those additional things would offer no tangible benefit and poking at it could change my current rating.

Combat Craig yes and no, for VA to reduce your disability you have to prove that you are healthy. If you have strong medical documents (service related), doctor follow ups, its really hard to get reduced. Adding a disability should not effect your rating. Especially if the disability is recommended by the VA doctor. It's about proper documentation. Once again if you have all your documents lined up and it's service related you will be fine. If it gets denied they will mark it as not service connected or service connected at zero percent. Plus a good VA rep will advice you properly. Once again it's key to have all your medical records scanned and all your medical conditions documented before retirement or separation. Be smart by documenting your medical conditions, ask for xrays and scans it's your right as a service member.

@@CombatCraig in other words, if I stop going to the VA for therapy, will they assume that I no longer need treatment for my disabilities and propose a reduction? Or am I able to cut ties with the VA and seek treatment through other options outside of the VA? Dealing w the VA is a constant stressor for me…

@@dillybar6561 I would continue to seek treatment at the VA and just be honest with them when you go in. My suggestion is to go them 4-5 times a year.

I get SMC. Is there a way to find out which one(s), specifically, I’m receiving?

Hey CC! Question. Im still within my 1 year mark of my award letter, if i file a supplemental claim for a condition that was rated service connected but low rating because i didn’t have proper documentation at the time. Will this reopen my other claims for a possible reduction? Or do they only focus on that one service connected disability? I received my award letter 6 months ago. Im at 90.
