Trump can be given four years for EACH charge, not just four years in total. It's up to the judge whether he sentences Trump to serve those sentences consecutively, or concurrently. Theoretically, he can be sentenced to serve a total of one hundred thirty-six years.

It's a non-violent offense. Sadly, the NY courts let people out before sentencing and while a case is being appealed. However, it's possible he could be locked up for violating his gag order - although I assume that can be appealed too. Not sure.

The only mitigating factor for sentencing is technically first offender. Aggravating factors include no admission or remorse, multiple contempts of court, no expectation of changing behavior. There is not reasonable argument for not giving jail time. It would be a pointless case otherwise. The whole point is deterrence.

This may well happen, now we know what he will try with the SC! He has to go through the usual process for the time being but IF the Judge suspects he might try to overturn the jury verdict just because he has 'friends' in high places, I suspect Judge Merchan might stop that train with immediate effect. The Judge can order a prison sentence with immediate effect, by invoking the matter of the many breaches of the gag order for a start - which brings a month for each time he has breached it. The gag order is STILL in place! Every day he breaches it, it's potentially a month in jail, if the Judge wanted to take that route. The sentencing isn't until July and the Judge will be taking note of Trump's conduct during this period of time and the prosecution can call for a custodial sentence, based on his conduct of breaching the gag order almost daily - in order to protect witnesses, the jury and everyone else involved with the case. Ironically, Trump's mouth might do the job of landing him in prison a lot faster than anything else!
