Yeah, there's no question that this was the defendant's fault. I've seen drivers like him before -- they think they're all slick and want to show that they're able to merge into a lane at the very last minute, or they were in too much of a hurry to realize that they were in the wrong lane and just merged without taking into account other motorists on the road. That's the problem with drivers out there; they lack patience.

Yep. Honestly I forget a lot, what I do is immediately put my signal on for people behind me. Then I immediate slow down ,sometimes almost stopping if no cars letting me in. The issue is no one wants to be behind another car... always needing to be ahead... which sign of poor driving behaviors

If there's two lanes and a center turning lane, no one continuing beyond the next mile should be in the far right lane. You reserve it for the entering and exiting cars. This is true for the interstate as well.

That way, I allow plenty of time for myself and also allow other motorists to drive safely to where they need to go. I've seen people in the fast lane who cruise four lanes then reach their exit. If the defendant knew that he was going to the donut shop which was right after the intersection, then he should have ALREADY been in the far right lane behind the plaintiff BEFORE the intersection so that he could make a safe turn into the shopping center. The defendant was in the far left lane, and then foolishly waited until AFTER the intersection and then tried to hurry up and cut off the plaintiff to make the right turn into the shopping center. The accident is 100% his fault.

This is the first time I’ve seen both the plaintiff and defendant’s stories matched up giving an accurate picture of what happened. There was no need to figure out who was not telling the truth which is usually the case with these type of cases. Now after all the long explanation by JJ, what could have possessed the witness to stand up? The “SID DOWN!”came so fast, I nearly passed out with laughter!
