I worked with a fence company a long time ago. The 1 thing I learned was not to connect the home owner fence to the nabors back fence line, u can set the end/Conor post. Just inside of property lines 3:32 t 3:32 As long as you don't attach to the nabors fence. 3 inch in side home owner line

Kevin, this is exactly what happened to my sisters property. They had a fence set around the back property for the dogs and it was set back 6-10 feet in some places. Well the new neighbors started cutting the trees and brush on my sisters property. I'm glad I was there that day to stop them before any real damage was done. I showed them the property lines, and even marked it out with line. People really need to ask before they do. It's sad.

I love that you made this video! I had a very similar situation happen to me. When we bought our house the neighbors fence was about 6 ft off the property line and we wanted to close in the side temporarily for our dogs. With their permission we did with an agreement that when we install a new permanent fence in the next few years it goes on our correct property line. If we need to sell before hand for any reason, we will make sure and disclose this upfront. Thanks!

Just had a neighbor close an opening in the fence that allows access to a private road. Checked the state code and its not allowable without proper notice. This is a real conflict because once the fence meets a certain standard, it becomes permanent.

Nice! same situation with me! neighbor did not have the funds? so I allowed him to connect but only with gated door connected to my fence! I also have three feet of my property or (utility easement)beyond my fence. But they are trying to claim my property! after six yrs. in NY it could but its only been two and they placed a boulder on my property toward the back! Looking back even though I hardly ever go back there I would of told them no! Now I got too contact town clerk! Heed the warning new owners!

Why would someone install a fence to leave 3 feet of their property on the neighbours’ side? In U.K. we have a 7 Year Boundary rule that allows people to claim land they’ve openly used for 7 years or more. I know many US house plots are larger than in U.K. but even so, isn’t it always best to put a fence as a boundary marker, so any confusion is avoided?

Because there is a line of very large pine trees on my boundary line. Can’t install a fence on the line

Depends on how long your fence has been up. I believe in some places if it is over 10 years then, the 3 feet of land that you had owned beyond the fence might legally belong to your neighbor. That is to say, the neighbor had possession of the land which was "open, notorious (obvious), constant, continuous, peaceful and exclusive of the right of the true owner".

Similar issue here except my fence company said we go off plus or minus 8 inches. I told them I didn't want any issues down the line and want my entire fence for myself. I'm in new construction so it's a bit different. Load and behold all neighbors attaching for free without asking.

Very interesting, I’m currently trying to figure out if the fence between my house and my neighbors is mine or theirs. It seriously needs to be replaced and I’m willing to pay half, but my neighbors said they don’t have the money to pitch in. Can I build a new fence right in front of the crappy fence?

A survey is well worth the money. I learned that my lot was 12 feet wider with a fifth corner after my survey. I never would’ve known otherwise. It’s also cheap insurance when you go to install a fence.

In Palm Beach County a permitted fence is located right on the exact property line in most cases when it separates adjacent homes. Many times a fence can be installed in a right of way zone, where you own the land but a right of way is left for utilities or maintance. You take the chance of having your fence removed if necessary, but can reinstall it after.

I'm surprised your neighbor's fence installing company did not look for lot pins before installing the fence!

We had a developer remove lot pins illegally then sell the homes telling the buyers that our property was their property. We don't live in the home year round and before we even knew it a fence went up on our property and they cut down 4 trees. We had to get an attorney and we ultimately lost because we didn't stop them even though we lived over 900 miles away at our permanent home. We still pay taxes on property we can no longer use and now one of the owners is trying to use some kind of possession law to annex our property as theirs. All of this crap is funding lawyers and courts for stuff that should be common sense. Our lawyer sucked.

@@LivingInSouthernNewHampshire I'm learning this the hard way in new construction. All sides attaching to me for free. They get mad when I asked them they should of asked they said they don't have to because their poles are setup behind mine. So their 3 dogs use and piss all over it. I wanted 2 fences back to back double protection from their untrained aggressive dogs.

Ugghh! I can't believe i'm googling this. My neighbor recently sold their home and the new owner went straight to replacing the old worn out field fencing that my fence was connected to. I knew the fence was in bad shape, but now i'm wondering what i'm supposed to do with my fence. should i just ask them if i can nail my fence to their corner post or just add another corner post right up to the property line and have a small gap. What really urks me is they didn't even try to contact us to let us know they were replacing the fence. I let my dogs out and they both went straight towards the fencing guys who were on my property cutting limbs that over hang from the new owners property. i should have just bought the other house and rented it out. i was aware the fence was in bad shape. I repaired portions of it myself because my old neighbors didn't have dogs. some sections were only held up because the cedar trees grew threw it.

Red Sonja in my circumstance, I have large trees and very big rocks along the actual boundary line and could not move them to install the fence.

@@LivingInSouthernNewHampshire Similar, neighbor (from hell) placed fence behind 18" stump, expanding his enclosed yard. He got that neighbor’s OK but months prior he had removed one within his property that was at least 32" in diameter.

You have to be very careful here . Some jurisdictions Do No Allow Homeowners to Put Fences On The Boundary Lines ! They Must Be A Certain Distance Away From Said Boundary Line . Check it Out 😊

I want to put up a fence between my neighbors backyard and our property. Should I put right on our property line or should install it 3-6 ft off the property line? The fence guy said I should put it off 5 ft for room in case I ever need to work on my fence and I’m not stepping on their property to do so. My neighbor told me she would be mad if I put up a fence. Ugggg

When we moved into our home, there was an existing chain link fence between our back neighbors and side neighbors. This is a very old neighborhood so I have no way who put them up or if they are on the property line. My concern is that we built a wooden fence several inches inside our side of the chain link fence and I’m afraid that at one point the neighbors on the other sides of this will become the new owners of it. Can this happen? Should we be worried? Recently the neighbor behind us cut down the weeds that had grown between the 2 fences which was technically something I guess we should have done. 😮😮

I just bought my first home and one side of the fence is not shared but the other side is and it is really damaged and needs replacing. The neighbor is quite rude though so I'm worried about trying to figure out who owns what or if it is right on the property line. I feel he'd be mad if I ask him to pay half of that side. 😬

Be aware of possible Acquiescence laws. In Utah we have the following: "Boundary by Acquiescence isn't a law found in Utah's state code. Instead, Utah's appellate courts developed this doctrine over many years to help avoid litigation and promote stability. Any long-standing markers indicating where property owners understand a boundary to be located mark the actual boundary, even if a survey places it elsewhere. Boundary by Acquiescence requires proof of all of the following facts: Occupation of land up to a visible line marked by a monument, fence, or building Mutual acquiescence or acceptance in that line as the property boundary For more than 20 years By adjoining land owners The property owners don't need to formally agree that a monument marks the property boundary; acceptance or acquiescence is sufficient. This is shown by the actions of the property owners toward the location of the boundary. Finally, the disputed property must be occupied (by a fence or garden) or used, not simply claimed." So a fence could be enough to mark a boundary and if it is not moved or disputed for 20 years, that's the new property line. I had a friend who just won a law suit on this with a neighbor who didn't want him to do a new build.

I don't think I would want to allow it because of the liability issue. If someone happens to get injured on that section of property , you could theoretically be held liable. Have them put their own fence up.

My neighbor set his poles up right behind mine so technically he's not attached but he is using the entire 90 ft side I paid for. He refuses to pay for his own fence behind mine instead mooch off mine leaning stuff on it and his dogs pissing all over etc.

heres a solution...build the fence the way its supposed to be. ON THE PROPERTY LINE. Avoid situations like this. but the story turned out for both parties, which is good.

Actually it is a legal matter You have to lose a little bit of your yard if you want to put up a fence, Here's a way around that, Just talk to the neigbor! If he also wants a fence also and you and him agree on the details then you can install right I'm the middle! Nobody loses there yard! Also it's just a fence, if your happy with it just leave it alone I don't know why you would have to notify the sellers/buyers about the fence unless you want to tear it out and reinstall it, then just ask the neigbor if likes it if he would either pay half or allow install to be in exact middle. OTHERWISE you have to lose a couple feet of your yard if the neigbor didn't want a fence

A fence isn't necessarily supposed to be ON THE PROPERTY LINE. It usually belongs to and is paid for by just one of the neighbors. Therefore it's usually built on the property of the person who owns it.

Never built on your line. Usually the law is to stay 6 inches in on your side. Check with your town first.

Can adverse possession occur after a number of years? Or is your tree line part of your border indicated to your neighbor as agreed?

We had our property surveyed. Took out a bunch of trees. Neighbour cried that those were their trees... not according to survey.

My neighbor called the cops on me for replacing my fence. They said i destroyed their property… i should the police the county survey and that they hooked their gate on my post. My fence is a foot away from my property line and they’re demanding i fix their gate. Found a baggie of dog 💩 on my driveway the next morning.

Granting an easement might have been easier.Now a lawyer has to get involved and Draw up the paperwork. an easement can only be broken if both sides agree to it. It also must be registered in the book of deeds

What happen our people next to uss have a talk links fence we want privacy one becaue they dont like us they complain and always call codes my daughter wanted one thing she did well with school chores so we got a trampoline he called codes because we touched he's fence if we forget to tke out rake off from leaning on it next morning it we be nocked on the ground please help what can we do the guy next store is super mean and not to mention I do alot for my community i help with clothes home decor I run on donations i help 200 to 400 children get 4 to 5 gifts each Christmas I'm not a bad person I swear I just need up :( before my daughter losses the one thing that makes her happy thank you I live in upstate NY Hope to here from you thank you and god bless

Yeah there should be mandatory privacy fences in city's and towns. Chain Link looks terrible and there's no privacy between neighbors. We are fortunate not to have chain link fence between us and our neighbors. Currently we are in the process of looking to buy a bigger home there's two things that would kill the sale personally for me 1. Chain link fence And 2. T-bar ceiling in the basement aside from utility room which could be left unfinished for all I care. As I'm a drywaller anyway. Both look terrible and cheap.

Look at the deed to see if it has been surveyed if not pay to have done, that simple, also fences make good neighbors. Lol

by law the fence line is your property line that's for The Whole United States you can't move it it been after 7 years if you move it you go to prison my cousin's a lawyer he taught me all the law

They can’t. We put an agreement in place and it’s been filed at the registry. It follows the property at each sale.
