The dealer truly paid the price for not returning the money. Instead they got hit with a lawsuit and had to paid 12 times of the original amount😂 I bet they learned a lesson

The dealers are so stupid. They do things like this to people yet let their inventory set outside unprotected. The amount of damage that can be done to a dealer online is bad enough, but they only think about the money.

I live in California. I recently made a down payment of 6k on a vehicle and made my first payment on time. Yesterday I got a letter from the finance company stating that my car loan has been denied because I had checked my credit score on Experian. Is this legal? Will I be able to get my money back? I saved up a very long time for that down payment.

I’m a dealer, and we work with customers if there is a significant issue that arises with the car early in the loan. We either will offer to fix the issue for the customer or allow the customer to return the vehicle. Depending on how long the customer had the vehicle , we may keep a small portion of the down payment that is equivalent to the prorated time of the vehicle’s use by the customer. However my dealership has more wiggle room to help customers than most used car dealers do since we have larger margins due to doing in house financing. Even though the dealer in this example was in the wrong , giving a customer a refund on the down payment can be a slippery slope depending on the circumstances. For example, let’s say that a customer purchases a vehicle but then several weeks later no longer wants the vehicle even if nothing is significantly wrong with the car . In that instance, the dealer should not be obligated to give the customer a refund of the down payment, especially since the customer signed a contract. This is not Walmart. That’s the equivalent of an employer signing a contract to pay you a certain salary after hiring you, but then cancels the job offer after you moved across the country to start your new job. Also it sounds like the dealer in your example didn’t have his contracts in order. Any dealer using proper contracts will have “as is no warranty” or “as is warranty included” notices that are signed. Also proper contracts should mention that sales are final. Nevertheless, the dealer in this example was wrong and should of at least given the customer all or most of his down payment back.

Why not have car dealership owners have a mechanic FULLY check every last vehicle on your lot to make sure there are ZERO issues with each and every car. That way, the customers and consumers dont have to make lemon law and auto fraud attorneys take all of your assets and surety bonds from the bond companies. Why not just be a car dealership with zero shady tendencies??? Why YOU CAR DEALERSHIPS MAKE US SUE YALL??? A 5,000 DOLLAR DOWN PAYMENT DEPOSIT THE DEALERSHIP is Bitching ABOUT GIVING BACK, SO WE GO TO COURT AND I GET $55,000. You car dealerships need to start thinking better.
@jwanders10 Жыл бұрын
@@Ro7777 many dealers do fully check and fix their cars. Some dealers don’t. There are two issues here. Used vehicles unfortunately are unpredictable. You can fully check everything now, but there is no way a mechanic can predict the future and know when each used part is going to go bad on a used vehicle. If a consumer wants a car that will have minimal maintenance, get a new car. However everyone does not get new cars because new cars are more expensive over time and everyone cannot get approved for new car financing. Even then, new cars have issues too, just now as many issues as used cars do. The second issue is that if used car dealers fixed everything on a car, that would drive the prices too high to the point in which consumers will not purchase. The reasons used cars are cheaper than new cars is because the used parts have limited lifespans and will need replacing. If a dealer wanted to sell a car that would hardly ever have problems, he would have to fix what currently is broken and also would have to fix parts that might break in the future but are currently not broken. The key word is “might”. So let me break that down from a monetary perspective. A used car would need to have the following parts replaced to be most reliable: battery, alternator, starter, fuel pump, timing belt /chain, tensioner, serpentine belt, spark plugs, coil packs, fuel injectors, and water pump. That’s several thousands of dollars worth of repairs that are unnecessary because all of those components are not currently bad. Even after doing all those things, there is no way to know when the engine or transmission will go bad. Therefore the best a dealer can do is fix enough on a used car within reason to the point in which the car does not have to be priced much higher than it’s market value.
