Yes, if it is markedly different. For example: if you grew a cannabis plant that is 54% THC and 0% CBD, it is extraordinarily unique to what naturally occurs (it has never been achieved). Very unique strains can be patented, and the process for creating a chewing tobacco alternative with cannabis CAN be patented, but if there is anything close in design already patented, then you are out of luck. Any process has to be non-obvious.

So would that mean if it happened, no one besides the company would ever be able to take the babies of the unique plant and cross it with one of their own plants? Like could you get a patented strain and a non patented strain and combine cross them. Or is that illegal

now its 2020 and i have a question, what if i had a cannabis product, say a chewing tobacco alternative, with updates in the law, is a product like that patent-able?
