Kevin, I think you fell for the main stream media trap, and got you talking about qualified immunity. That is just a distraction! If I kill one of your loved ones, would you worry about if you could sue me or not? Or would you worry about seeing me put behind bars where I would belong? QI is ONLY an excuse/defense during a civil trail. QI can't be used in a criminal court. As far as I know, there is NOTHING except the thin blue line courtesy that prevents DAs from pressing charges against LEOs that break the law. Using James incident as an example. There is NOTHING that would prevent the DA from filing charges against the LEO that broke into James' car, went through it, and took his bannana. That is breaking and entering, theft of a fire arm, etc. I am confident the police department wouldn't be able to find a written policy that gave LEOs authority/permission to break into his car and take his stuff under those circumstances. After all like LEOs love to say, if it is a crime or not, let the courts decide. Since it is next to impossible to legally force a DA to press charges the other recourse we have is to file lawsuits, and our great supreme court created qualified immunity to further shield the LEOs. I am pretty new to learning the law and how things work. At first I agreed on ending QI until I learned that often the plaintiffs attorney helps the defense argue for the LEO to keep his QI, that way they can go after the city/county instead who have deeper pockets. A better approach would be to have DAs charge LEOs with the crimes they commit while on or off duty, then allow the victim to sue the police dept and/or city if applicable.
