This is ridiculous to discuss when and if the US should get involved. The CCP is already conducting military operations and acts of war, building bases and conquering islands that don't belong to them, even building islands. Harassing and attacking ships in international waters is just a cherry on top. They will keep escalating until war erupts, but by that time, they have had time to build bases and prepare so the sooner America finds its balls the better the outcome will be in a military conflict. 1932 Phillippines Constitution specifically excluded the Spratlys from its territory. It was Spain and then US colony. When other countries claimed islands in the region, it was not independent, was not even a country. The Treaty of Paris, and Treaty of Washington and the Convention Between the United States and Great Britain all excluded these from Filipino territory. These documents gave exact coordinates of its territory. Cairo Declaration commanded and Japan's Instruments of Surrender conceded, that Japan return all stolen islands, including Spratlys (SCS), Taiwan, and Diaoyu (Senaku, East China Sea, belonging to Taiwan Province, which Taiwan claims too). Phillippines did not start claiming the islands until oil was found there in 1976, basing its claims solely on UNCLOS. However, UNCLOS only allows economic activity in 200nm of water, not any land or islands of another country. US is not a signatory of UNCLOS, meaning it did not wants to be bound by it. US occupies Guatanamo Bay of Cuba, but refused to return after Cuba terminated lease and demanded immediate return. So it is occupying Deigo Garcia. Both military. US always use excuse of its treaty it signed with other countries to threaten other countries (after losing Korean War and all wars after that), this is brazen violation of UN Charter and all the legal documents it signed, is illegitimate and is leading the world into a WWIII. As we know, US is just talking (as evidenced in Ukr. proxy case), however, after cold war, the world could be heading for a peaceful period, but for this irresponsible struggle to entertain a world that is unipolar, threatening new cold war and hot war, such nonsense should stop. China is but trying to protect its territory from encroaching. In BRI, China offered a solution for the whole world to be prosperous, hoping that the earth is big enough for all nations thrive, be prosperous and peaceful.
@SpicyDoc-y3lКүн бұрын
Why does US not want to enforce UN Charter, Cairo Declaration, Potsdam Proclamation, Treaty of Washington, which US signed onto, yet want to use UNCLOS, which did not sign on, to enforce something when it could not pinpoint which clause of UNCLOS China violated? UNCLOS gave rights of 200nm for economic activity, but did not give any rights to land of other countries, otherwise, Phillippines could claim the whole of Malaysia. UNCLOS doctrine: land dominates water, not the other way around. It gave no rights for Phillippines to any islands that was not its. This brazen violation of international laws itself tells how hypocritical this country is (do not follow laws it signed on, yet make up things for China to give up territory). US has been trying to contain China since Korean War and Viet Nam wars and lost badly in both to China when China had no advanced weapons. Those who believe US would win a war with China now when the gap is the smallest ever between the countries need to study history. Then why US wants to do this against international law, as the above two wars, as US CIA paying Dalai Lama salaries and train Dalai Lama's people in Colorado mountain (Google or KZbin) for rebellion in Tibet, as stirring up issues in Taiwan, Hong Kong, and Xinjiang, US is only interested in containing China. CIA has been involved in subversions of more than 70 governments. The answer is to keep a unipolar world, hegemony, and imperialism. As wars are being started in the world, as one small nation after another being destroyed economically through wars or sanctions, US government is squandering trillions of Americans' tax dollars to enrich the few rich behind the military industrial complex. With such corruptions, where did such huge amounts are being spent on wars, what such Governments do to strengthen this country's infrastructure, and competitiveness in the world as the debt ceilings again and again? Not much, the rich got richer. Hoping no WWIII, people.
@SpicyDoc-y3lКүн бұрын
US signed all those documents that made international law, but chose not to respect in order to choke off China's commercial shipping through South China Sea in the name of freedom of navigation. Wars around the world is stoked by this country - Europe, middle east, now Asia. US’s role in the conflicts in South China Sea has to do with US trying to choke off China's shipping lane in South China Sea (Imagine if China does that to US). Of course, China is not going to let it. Philippines was a Spanish and then, US colony. Treaty of Paris, Treaty of Washington, earlier Filipino Constitution and maps all excluded Spratlys from Filipino territory. Phillippines were not even an independent country, when Spratlys and other islands in other regions of South China Sea have been claimed by other countries. Philippine s only started claiming Spratlys after UNCLOS was enacted. However, UNCLOS never gave any country one inch of extra territory of other countries’. It only allowed use of water around its land for economic activity (doctrine of “land dominates the sea”, not vice versa). Filipinos are used as Russia's neighbor, or Taiwan, cannon fodders. It has nothing to do with them. The UNCLOS doctrine is called land dominates water, not the reverse. Therefoe, Filipinos have no basis for their claims. US just needs an excuse to make trouble for China.

Cairo Declaration The Cairo Declaration, issued on December 1, 1943, by China, the United States, and the United Kingdom, stated that Japan should be stripped of all territories it had seized or occupied since the beginning of World War I. This included territories such as Manchuria, Taiwan, and the Pescadores Islands, which were to be restored to China. Although the Spratly Islands were not explicitly mentioned in the Cairo Declaration, the document commanded the return of all stolen islands1. After WWII, the US army helped the Chinese navy recover the Spratlys from Japanese occupation. Given that the document called for the return of all territories taken by Japan, it should have included the Spratlys1. Treaty of Paris and Treaty of Washington. So did the Treaty of Paris exclude the Spratlys as Filipino territory? Yes, the Treaty of Paris (1898) excluded the Spratly Islands from the territory ceded to the United States. The treaty defined the boundaries of the Philippine Islands, but the Spratlys were not included within those boundaries2. This exclusion was later addressed in the Treaty of Washington (1900), which clarified that Spain relinquished all claims to any islands belonging to the Philippine Archipelago lying outside the lines described in the Treaty of Paris.
@SpicyDoc-y3lКүн бұрын
EEZ There is no UNCLOS rules that says that EEZ extends to other countries' islands at all - otherwise all neighboring countries and islands could claim each other. The United Nations Convention on the Law of the Sea (UNCLOS) includes the principle of "land dominating the sea". Filipinos are trying to say because UNCLOS allows claims of water, therefore, we can claim China's islands (as described above). Not so. Water in the sea does not dominate the land. Here is the limitation of EEZ: Exclusive Economic Zone (EEZ) Extent: Up to 200 nautical miles from the baseline. Rights: Coastal states have the exclusive right to exploit natural resources, both living (like fish) and non-living (like oil and gas), as well as jurisdiction over marine scientific research and environmental protection. Responsibilities: Must consider the rights of other states, such as navigation and overflight.

China’s incursions into the West Philippine Sea and violations of international law reflect aggressive territorial overreach that must be opposed. In 2016, the Permanent Court of Arbitration ruled that the Philippines has exclusive economic rights in the area, rejecting China’s historical claims. China continues to assert control, undermining international law and setting a dangerous precedent for global diplomacy. China’s provocations, including ramming Philippine vessels and militarizing the region, threaten regional stability and violate sovereignty. The South China Sea is a crucial trade route, and any conflict risks global economic and security consequences. The U.S.-Philippines defense treaty highlights the risk of broader military conflict if China escalates further. Upholding the Philippines’ sovereignty and international law is essential for regional peace.

China asserts the South China Sea through a Historical claim. However, the fact remains that ancient maps from the Song Dynasty in the year 960 until the end of the Qing Dynasty in the 20th century, shows China's territorial claims ends in the Hainan island to the south. No ancient documents justifying China’s claim goes beyond those island. Moreover, the historical map of Murillo Velarde of 1696-1753 disproves China’s claim but instead strengthens further the claim of the Philippines. This was all presented and revealed in the proceedings at the 2016 Arbitral Court at The Hague which ruled in favor of the Philippines and nullified China’s “9 dash line” claim over the South China Sea. Chinese scholars and legal experts knew of this predicament of proving historical claims. This is why China refused to participate in the proceedings stating instead that the court has no jurisdiction over it. To counter the Philippines victory, China comes out with a new “10 dash line” claim over the Sea and uses military superiority and bullying against the Philippines to achieve their goal. This is a simple act of China’s greed.

They want war for these reasons: 1. Train their soldiers in real combat prepping for Taiwan. 2. If they have a "common enemy" that will distract their people from their internal problems. 3. They picked Philippines to be an example to Asean because they think the Philippines is "easy and dumb".
