Any ships including non-military ships are covered by MDT as long as the causing trigger is an armed attack. We only have 7 warships and China has around 300 just outside the WPS alone so if we send our warships, they will send theirs as well. No one wants a military conflict in that region, not even the USA, Philippines and China because it will upset the economic trade route which will also heavily affect our.

@@jagsingh6410 I stand corrected. It's the Permanent Court of Arbitration (PCA), not the ICJ. First of all the PCA is not a fake court. It was created in 1899 and is the oldest institution for dispute resolution between States. 122 countries have contracted the PCA which includes China. The fact that China recognizes the PCA in arbitral resolution does not make it a fake court. It is within the Philippines' legal rights as provided under Article 287 par. 1(c) to bring its maritime dispute to a neutral third-party tribunal like the PCA. Second, It is correct to say that a sovereign state cannot be sued without its consent. That is why the Philippines brought a maritime claim under the provisions of the UNCLOS which China is a signatory. What the PCA settled was not the territorial dispute between China and the Philippines rather what was tackled was the interpretation of the provisions of the UNCLOS when it comes to maritime entitlement and the definition of what an island is under the UNCLOS. You may ask how did China give consent. China gave its consent when it signed the UNCLOS in 1982 and ratified it in 1996. Article 309 of the UNCLOS, provides that "No reservations or exceptions may be made to this Convention unless expressly permitted by other articles of this Convention." This means that China voluntarily submitted itself to be subject to the provisions of Part XV which covers the settlement of disputes which is compulsory. The exception to the compulsory applicability of Article 309 is Article 298 of Section 3 of Part XV of the Convention. China invoked such an article but was determined that it does not fall under the exceptions provided in section 1 of Article 298. The law provides that "When signing, ratifying or acceding to this Convention or at any time thereafter, a State may, without prejudice to the obligations arising under section 1, declare in writing that it does not accept any one or more of the procedures provided for in section 2 with respect to one or more of the following categories of disputes: (a) (i) disputes concerning the interpretation or application of articles 15, 74 and 83 relating to sea boundary delimitations, or those involving historic bays or titles, provided that a State having made such a declaration shall, when such a dispute arises subsequent to the entry into force of this Convention and where no agreement within a reasonable period of time is reached in negotiations between the parties, at the request of any party to the dispute, accept submission of the matter to conciliation under Annex V, section 2; and provided further that any dispute that necessarily involves the concurrent consideration of any unsettled dispute concerning sovereignty or other rights over continental or insular land territory shall be excluded from such submission; (ii) after the conciliation commission has presented its report, which shall state the reasons on which it is based, the parties shall negotiate an agreement on the basis of that report; if these negotiations do not result in an agreement, the parties shall, by mutual consent, submit the question to one of the procedures provided for in section 2, unless the parties otherwise agree; (iii) this subparagraph does not apply to any sea boundary dispute finally settled by an arrangement between the parties, or to any such dispute which is to be settled in accordance with a bilateral or multilateral agreement binding upon those parties;" None of the Philippines' claims fall under such categories provided under Article 298. So the compulsory provisions for dispute settlement apply. So your argument that there was no consent is not true. The fact that China signed the treaty means that it willingly submits to everything provided under it which includes recognizing the 200 nautical miles of all coastal states including the Philippines. Third point, China has no legal basis to invoke the nine-dash (now 10dash) line. Between a state that has a legal entitlement as provided by law or treaty, and a state that merely uses allegedly, a disputed historical claim, the treaty or law is superior. For example, I resided on a piece of land for some time which I later abandoned. Then after many years, I came back and there was already somebody occupying the property. And that person has a land title. So in your opinion who has a superior claim. The one with the land title or the one who alleges former occupation? The Philippines has Sovereign rights as provided under the UNCLOS. How about China? The 9-dash line which it continues to extend based on its whim. China signed UNCLOS and now they are trying to set it aside because it goes against its imperialistic goals. Why doesn't China voluntarily file for its territorial disputes with other nations like Bhutan, India, Indonesia, Vietnam, Brunei, and the Philippines? Because China knows that legally they have nothing to stand on. All they do is use their military superiority to exert their claim.

This happens when the Philippines does not send proper navy and coastguard boats armed to the teeth to do the resupply missions. These unmarked civilian boats are just begging for it. A show of arms, even if not used in anger, will dissuade the Chinese from doing these sorts of violent and threatening maneuvers. They will be forced to think twice.

The problem is that you can't fight them. It's an easy loss. I'd just make a deal with them so that you'd acknowledge that they can have it in exchange for some sizable % of the exports they get from local drilling and fishing, or make a deal that they have to move like 3% of their manufacturing plants here. I mean, I'm just throwing random ideas for thought. But something where you recognize China gets the islands, and the Philippines gets a large boost in their economy going forward. Because the only way to get respect is to simply build a military that no one wants to mess with. It's going to take at least 2-3 decades like China did. Focus on massive growth in manufacturing, AI, Green Energy, 3-d Printing and all the technologies that are trending. Then build new islands in the area later and give them the finger.

As much as I feel the Chinese are way out of bounds (literally and figuratively) in the West Philippine Sea, this video does NOT show the CCG vessel hitting the Philippine supply boat. It is really the other way around. The CCG vessel is standning still in the water and is not underway. There is no evidence of a bow wave nor a wake from the CCG vessel. To me it looks like the Philippine boat intentionlly clipped the bow of the CCG vessel for the sake of the video. Again, I despise the Chinese Coast Guard for what they usually do, but in this video it looks like the Philippiine boat is the aggressor.

The Philippines was a Spanish and then US colony. They set its boundaries but did not include any islands in the South China Sea as they knew the islands belonged to China.
