Looking at the family photo of Brian Drake with his family makes me feel so sad. Four children lost their father because his competition was a psycho.

This was so heartbreaking. One of my relatives was a patient of his. Their insurance referred them to Daniel after Brian died.😳 They did not go to him. Apparently there were 3 chiropractors in town, the dead guy, the guy who killed him, and the other guy. My relative ended up going to the other guy.

I don’t understand how detectives can be THIS stupid. There are many ways to ask for a lawyer and invoke your right. It isn’t always going to be “I want to invoke my constitutional right to remain silent”. “I need to speak to a lawyer” is the same damn thing and they KNOW that messing with this will cause them to lose the entire case… but they still do it 🤦🏻‍♀️

They do it because sometimes, it works. There's another case where the suspect said, "I want a laywer, dawg." The cops and the courts agreed that there was no such thing as a "lawyer dog", and sent the guy to prison.

With each video lately, I find myself saying the intro out loud, along with Dr. Grande. I wonder how many others do the same? 😂 Great analysis and love the funny puns, as always. It's a unique ability to be able to add jokes, while telling a true crime story without coming across as insensitive to the victims. You definitely balance that out perfectly though, as well as adding in teachable lessons from each case. ❤

Hey people, if you're ever arrested, never Never *NEVER* talk to the police without an attorney. In fact, the only thing you should say is, "I want an attorney." We expect police to know a lot of things, but one thing it seems they are incapable of is self-reflection. A suspect asks for his lawyer, that's it. They keep pressing, and it's a coerced confession. He didn't just ask for an attorney once, but several times.

My ex's boyfriend died of an overdose and we took him to the hospital because the person whose house they were at freaked out and we really didn't know what else to do. Homicide wanted to "talk to" us, so we went to the station. I described what happened and that they were shooting up opana and eating Xanax and that the guy (10 years younger than her) was t trying to keep up with an experienced addict. The detective said, "I guess I'm having trouble figuring out why you dumped his body at the hospital." I replied, "I really don't think taking him to the hospital and waiting until the EMTs told us that we could leave really constitutes dumping a body." **Grumble grumble** "You can leave."

@@SoulDelSol -Even in you're innocent- Scratch that, _especially_ if you're innocent, the first and only words spoken to police should be to ask for a lawyer. Even innocent people can be nervous or say something misleading under pressure. An attorney protects your rights and ensures you don't accidentally incriminate yourself (falsely).

@@Smithpolly Well if any such people happen to read this, just know that you have the right to request a lawyer even if you don't have one. If you're unable to afford an attorney and are being accused of a crime, a public defender will be appointed to you. However, if the police want to question you but aren't accusing you of a crime or arresting you, asking for a lawyer means they must wait until you obtain one, even if you never do. The other option when not being arrested or accused of a crime, is to refuse to be questioned with or without a lawyer.

It's true they can't charge him again with murder, but they could probably get some time for other crimes related to the murder, if those weren't charged at the time. Like conspiracy, or fraud, or even some civil rights violations.

I don’t care for violating Miranda rights. People can have confessions coerced by the police and since Miranda had been around 60 years this was minor league police work. Little league police work.

This may be a little confusing to some but this is what I gather. Because his Miranda rights were violated the confession can not be entered into evidence as proof of his guilt. However many things not admissible as evidence of guilt can be introduced for other purposes such as motive, intent or impeachment. Therefore if Dan testifies and only if he testifies can the confession be allowed. The jury would then be advised that they are not to consider that as evidence of guilt but only as evidence of a lack of credibility given that he has given contradictory testimony. Which is a bit like saying don’t think about pink elephants. Therefore he cannot testify in his own defense which I usually advise against anyway.

Hopefully one day this title can be updated to Into the Joint because this guy killed Brian Drake in cold blood. It’s infuriating the cops mishandled the interrogation because to me they have enough circumstantial evidence to convict and the cops didn’t need to overstep like that

Staggering that the police were so amateurish when it was clear he had in effect asked for a lawyer. Anyone in law enforcement knows that even a suggestion of that, if not acted on can nullify everything that is said after. This is really really basic stuff.

I was a manager in medical billing, and my specialty was chiropractic… I ended up getting engaged to a chiropractor. Whenever I was single, and I went someplace and there was a single male chiropractor. They always went after me. Of course, I didn’t tell them what my profession was.

I think he is guilty. I once went to work in a tiny rural town with this same kind of problem. An old MD in this small town was extremely resentful of the new young DO that came in town and was taking all the patients, everybody liked and cutting into his profits. So the old m d started slandering the young d o all over town and even libel. Every way he could. He even threatened to shut down the hospital. There was only one tiny little hospital with about 12 nurses. And he convinced the nurses to go with him and shut the hospital down. He tried to but the young doctor, his competition, recruited myself and other contract nurses in order to keep the hospital open. It was absolutely insane how nasty that old m d was to his competition. If we had not shown up people for hundreds and hundreds of miles would have not had an ER or hospital to go to because this MD was having to share patients. I don't know how that ever end up I think the d o moved.

The charges were dismissed because Idaho state police had NO EVIDENCE against him. The time of the crime is not 7:26pm. And the cameras and cell towers and witness statements prove it.

I imagine it must be pretty frustrating for those small-town police knowing that Daniel murdered Brian in cold blood, yet still walks the streets as if nothing happened, specifically because they completely botched the case by playing fast and loose with his rights. I imagine they learned a valuable lesson, but I highly doubt that has much of an impact on the shame and regret they feel due to their incompetent buffoonery. Yet another example of a police department attempting to abuse their power... only this time it resulted in the rare occasion where the outcome didn't go the officers' way. Hopefully, they at least know to keep a close eye on any new chiropractors that show up in town.

Hi Dr. Grande, I had no idea being a Chiropractor was so competitive. Daniel did ask for a lawyer while at the police station. By the police not honoring the request is the reason why Daniel is free.

It's interrest that such confusion over asking for a lawyer from LE led to a confession. Why does LE need a confession from the person before they arrest him. If they didn't have enough evidence, I guess getting a confession is all they need.

I think what happened is Daniel is a bit unhinged, got very stressed about the competition, just went for a drive by like an obsessive stalker, and was overwhelmed by an impulse to do some damage when he got there, shot at the window to break it and cause brian stress and hassle and expense to replace it.. but didn't actually intend to kill anyone though. If he did know brian was in the office, he was probably trying to scare him.

I have a white Tundra Truck and my paternal grandmother's family name is Moore! It is interesting how a technicality can prevent someone from being charged when the court of the public will need much more than that. Considering how limited most adult's options for activities are, it would likely be easy to limit the amount of suspects for any crime within that age group.

My question is did the police look for the evidence of the deposit in the alley. Did his defence lawyer go look and take pictures to introduce them as evidence?

No the police haven't done anything and the alley that is being referenced is not the correct alley- Dr Moore had bad diarrhea and took an emergency 2 on the side of Dr Moore's office NOT Dr Drakes alley. Also the time of the crime is not 726pm and Police know it
