I am pleased to announce that Sony has released the claim on my song/video that was mentioned in this vid. Thanks to all of you for the support, love and comments!!! I did hear from several of you that KZbin was showing ads the whole time, even though they said they weren't. I won't know for a few days if there will be any revenue returned, as KZbin did not indicate that it was being held in escrow. But at least it's good moving forward.

Hey glad it got released! Me and a bunch of other ambient channels deal with this too and we’re always talking about it. The issue for me is that the KZbin copyright detection is obviously an automated thing, analizing the waveform or something. So it could be one reverb tail, one square wave from the same synth plugin, who knows, and in addition to that, KZbin doesn’t actually get involved. Like your previous video points out, it’s always up to the claimant to release it or not. I think a large part of the issue would be resolved if the second level of dispute got someone from KZbin involved. So the first one goes to the claimant for release and most copyright claims can be worked out among the people. Then, when it needs further action, it goes to KZbin, someone (a real person) from KZbin reviews it, listens and realizes it was a detection mistake and releases it. I can’t be too much for KZbin to have a team somewhere in charge of these reviews. That way music creators could rest easy that at some point their work can actually get reviewed by KZbin and proven to be original. Maybe that’s the petition we should start. Anyways, sorry your revenue didn’t get held in escrow, I haven’t seen that happen before :( Also as I know you’re aware but as a reminder, always avoid having more than 2 in dispute at the same time. It would be rare to have 3 not released all at the same time and get 3 strikes, but you never know. I had 1 in escrow until yesterday, and another video with 2 detected claims on it, I’ve been waiting until the first one is released before I submit disputes for the other 2 so I don’t have 3 going at once. Frustrating but that’s the way it is currently. Hope your channels continue to grow, love your content! :)

Honestly an awesome idea, you and others should actually try and start a movement because I can definitely see some change happening there if a bit of traction is gained. There are countless youtubers ranging from hundreds of subs to hundreds of millions who would be willing to join in, just about every creator on the platform has been plagued by copyright issues at one point or another so you'd imagine candidates wouldn't be hard to come by once word gets out 🤔

There should be some sort of penalty for making erroneous copyright claims. Similar to how a channel can be removed after three copyright strikes, companies who makes more than three erroneous claims should be banned from making further claims.

Yup. Just like NHL Diving Penalties. In the National Hockey League (NHL), diving, also known as embellishment, is a penalty called when a player intentionally exaggerates their reaction to a minor or nonexistent contact in order to draw a penalty from the referees. They had to introduce that penalty because too many wimp players were exaggerating to try to get the attention of the refs. KZbin is diving and they need to get called out.

They failed to act as soon as it became a problem. This wasnt just a few kids sharing tapes. This became organised crime due to the Napster model. Yeah use of DCMA isnt great, but its a reaction and an exploitation.

This is an epidemic. I've heard of a number of musicians having this same issue. People are claiming others' music as their own in an effort to make money off something that isn't theirs. And then the musicians who created it have to fight to get their own music back. It's incredible. And AI is going to make things 1000x worse.

Perhaps you meant to say, "AI has ALREADY made things 1000x worse." The facts are very clear. AI is most definitely running amuck with the YT matching algorithms, and THAT's why we're seeing situations like the video above. A more simple mechanical algorithm would require very specific sonic matches to make a positive determination. But YT isn't the least bit concerned with accuracy. YT actually wants as much ERROR in the system as possible, so as to effectively demonetize as many videos as possible by making the original artists prove they are INNOCENT rather than the platform having to prove they are GUILTY. Yes, this should be a class-action lawsuit; but it will never make it to trial because somehow the content-ID system will miraculously begin working better within days of the class-action lawsuit being announced. Watch and see people... watch and see... We don't have a platform problem. We have a people problem. It is the PEOPLE running the F'ing platforms that are causing these problems. Stop blaming "platforms" and blame the PEOPLE implementing all of these things on the platforms. FACT

I’ve just received a fresh strike for using my own music on a live stream. I appealed the claim, informed them the track in question is published in stores under my name, and I have an actual video of me creating the track from scratch in my Daw, and I still lost. KZbin didn’t care that the claimant was Simply Hypnotic and hit me up with a Community Guidelines warning and a visit to copyright school. I uploaded the track again to prove a point, received another claim that was successfully appealed, informed them and they still refused to back down, stating uploads and live stream claims are different things entirely 😂

There are multiple things that have to be considered for something to be an actual PA copyright infringement. There are SR copyrights that could potentially ding someone on feedback, but not if it wasn't lifted from the original recording. This is why Swift is rerecording her earlier albums - because she owns the PA copyrights but not the SR copyrights.

This is one of my worst nightmares. It hasn't happened to me yet but I have lost sleep over my fear of it. Please continue to defend your music, and continue to share your music online! I believe that the social sharing of music is part of what makes music what it is. I'm not saying that this social sharing must be social media, but the sharing of original works on social media should be encouraged. Social media fails to achieve its aim when it discourages us from sharing our creative works. Defend your work. Stay strong, and keep making music. We cannot let corporations abuse technology to steal our creativity. Art is a human right! I hope everything is resolved in your favor soon, and thank you for sharing your predicament.

I had a similar thing happen to me! I played at an ambient guitar festival in Minnesota and as a favor to a friend filmed his single long piece set and uploaded it with his permission for future perusal since many people couldn't attend the festival who were out of state. It was content ID'd as being a Radiohead song "Paranoid Android" which bears NO RESEMBLENCE whatsoever to the ambient drone the friend performed. Weirdly, none of the other ambient pieces I filmed that day were claimed nor was the except of my own performance. So that being said, yes it was cleared up but it was a very strange thing. I just think youtube has an algorithm that has real problems with ambient music because it's aimed at detecting "today's pop hits" or whatever.

I get a copyright claim, and also a shadowban, on every one of my live streams.. I have a full copyright license for everything I perform and it costs me a substantial sum of money. Whats far worse, is KZbin holds a copy of my licence, but for every single claim, the claimaint never responds,,, they just let the 30 day clock run out by which time any hope of monetisation is long gone.. KZbin does absolutely nothing to penalise these fake claimaints, and that's the abhorrent bit... Surely if you let the 30 day default expire, you should be banned from making any further copyright claims !.

Now that is very interesting. I have just uploaded today (10 Dec 2024) an ambient self composed improvisation live track that I created and recorded in my studio and SME have immediately hit me with a copyright claim. I listened to the supposed track that I have copied. I listened to the 15 seconds of ambient drone that I created and is apparently the same as the orchestral movie soundtrack! There is nothing that matches nor sounds the same. Maybe a chord is the same maybe a drone but bottom line this is theft and these companies are just taking the p*ss. This is a YT issue absolutely yet they wash their hands of it. Come on KZbin get your finger out. You are making a fortune out of us so take some responsibility.

I'm very sorry to hear that. Your channel is so awesome and deserve the monetarization. Somehow I heard this kind of story recently more often on YT. And even with my other small synth ambient YT channel I got this kind of copyright issues. The weird part was, that I repeated some pieces of it to make a very long video version and the copyright claim was not on the first time played the piece, but just on the last repeat. And when I listened to this music, it didn't have much to do with my music. This showed me that the YT algorithm has "a lot of room for improvement" (i.e. it sucks a lot!!!). After I got my disputes rejected, I stopped with my channel, even I never planned to monetarize it.

I pushed back, I've written explanations and they just kept rejecting my claims. Sorry to say, I've given up the fight. It's hard enough even trying to promote music. All I want to do is write music, play it and record it.

This is the only sensible response I see on here. We should be in awe of what technology can do, and that it works so well most of the time (Shazam, Soundhound helped me discover music). Of course AI is going to mess up at times. Indeed they could keep monetizing and arbitrate to whom the funds go once it is settled by humans.

It happens to small creators too. The manual review for me was denied twice. The third time I had to write an essay with proof etc. and threaten to get lawyers involved just for them to release it. Worst part is the song they claimed I stole sounded literally nothing like the claim. On my covers I don't mind claims as that makes perfect sense, but original songs is so infuriating. And I'm worried that anyone that I've let use my music in their projects will get hit with it too.

Content ID just generates the match, the system relies on a human at the other end to actually action the claim, a lot of these labels hire companies to scrape platforms and action every possible claim - it's actually an abuse of the Content ID and KZbin T&Cs, so Sony Music Entertainment is 100% at fault for breaking the rules on KZbin to steal from KZbinrs. It's such a pain...I've had to dispute content claims for using MY OWN MUSIC in my videos!...MULTIPLE TIMES!! Disputed, they disagreed, disputed AGAIN like, "THIS IS MY SONG!! I WROTE, PERFORMED AND RECORDED IT!!" and they were finally like, "oh ok." 🤣🤣🤣 It's a mess, man.

Basically this is the old way of doing things colliding with the new way of doing things. The old copyright and royalty system just doesn’t fit in the digital age. So much of the old world needs to be replaced.

The same thing happened to me. Moby's publishing company issued a content ID violation to me . Moby apparently has an ambient album that I was not even aware of. I had never heard of it and just disputed the claim. Of course that was denied so I went to listen to the track in question of which was only similar that both songs were based on drones in the key of A. I sent a detailed breakdown of both songs. Moby's track did not use the same instrumentation at all and I went on to explain that mine contained 40Hz frequencies as well as 3 layers of water sounds not do mention several layers of drones none of which matched Moby's in timbre and there most be 100's of thousand drone based songs in the key of A .KZbin sided with me and released the hold and paid me the funds they had held. Totally ridiculous!!!

This situation is getting worse and worse. I make some vlogs, I walk around talking and whenever I pass close to a restaurant or any business and some song plays in the background for a few seconds, the entire video gets a copyright notice. Recently I was making a video about a street festival and couldn't publish it due to the music playing. This is insane.

I had several of those claims on my Ambient channels. Always disputed them. Most of the disputes were solved after 30 days. Didn’t lose any money though - none of the channels were monetized. My experience is: The longer the video the higher the chance that content ID might strike. Like you I had copyright claims about 10 or 15 seconds in 10 hour tracks. After I closed all my ambient channels and reissued a few ambient drones on my channel - guess what happened... Yes: the same videos got claimed again.

I have been in similar situations with content ID and usually the big labels don't reply and 30 days later it gets released but the issue as a small channel is the video will be placed into algorithm oblivion during this time which it would rarely come out of. It only gets more complicated on the visual end now that they also have an AI monitoring system "watching" videos to determine the content and AI is amazingly powerful but inaccurate a lot of the time when it comes to artistic interpretation. Either way before I go off on a rant of my own. I hope everything works out for you and posting videos like this, when you have a large audience, is a great way to make things happen in the social media world.

I currently have a content match....a cover of Zeppelin's "Stairway to Heaven". Sometimes I think doing the occasional cover song is a bad idea, remember when I did Van Halen's "Cathedral"? Funny thing is my recording of "Plaisir d'Amour" which is a classical French love song written in 1784 by Jean-Paul-Égide Martini (1741-1816). The song was also used to create the song melodies for Elvis Presley's "Can't Help Falling in Love" (1961). It has never been content matched, you'd think it would be. I hope for you having great victory in these situations. Yes the original artist should get their fair due on covers but, just because you play 6 notes that sound like 6 notes from some other song that isn't right.
