I do live in Georgia so I'm sure some of the laws are different but last year September 30th my brother-in-law was in a very suspicious motorcycle wreck that snapped his neck off of his body and cracked his helmet wide open and he landed in the grass you can see from the skid mark his skidmarks stopped about 3 in from the grass and I guess that's just when he started to flip his girlfriend was supposedly following him but he got pulled over by a cop and it was some relation to her but we just think it's very suspicious. It was five days after he had his first child with her but she already had a boyfriend and our family seems to believe she had him killed and her van was completely fine there was nothing wrong with it but shortly after his wreck she had her bumper changed on her car and it was of course a brother-in-law of hers that worked at a Auto Parts garage and changed it for her and there was absolutely nothing wrong with her bumper. The most important thing in my opinion, is that he kept he calm, kept the encounter professional, and did not show any signs of disrespect. There are so many officers who simply lose their composure, which leads to abuse of authority, but this officer is very well mannered and professional.

Sadly the streaming tools are less then reliable still and I need to know I can rely on something. In tense situation I'll have multiple cams. My general approach is a password protected phone. Even if they impound it, they could not remove the video short of pretty much grinding up the phone. While that could happen, most officers don't want to mess with destruction of evidence. It's a class C felony. Also their car cams are recording. Bad things can happen, but I use the best tools I can, I start on my knees and stand on my feet. I would never willingly give them the video. People do not understanding how much asserting yourself over your employes changes the game.

You must've missed the content of the video, which focusses on the legality of the situation. This isn't some trendy sports video or some Miley music video. In this forum, fact trumps your "feelings"... so your comment is sort of illustrating to everyone that you voluntarily disregard the law when it applies to the majestic badge-wearers, and for some illogical reason feel compelled to criticize the outstanding citizen confronting this illegal activity. Indeed the cop was courteous. But being courteous should be a standard, not something that warrants exemption. Instead, you're disregarding the courage of the cameraman by condescendingly stating that he's "playing police officer" while inferring that "if the cop is nice, he can break the law". We need smarter people in this society to keep the law serving the citizens, rather than serving both the police who are enabled to act unlawfully by such ignorance of the citizenry and the courts who profit off of such violations of criminal and civil laws.

Gavin Seim I am not one to disagree that some of them don't know the law very well, if they did, they would be lawyers, and have way more money, but you may want to pick a different RCW to give them grief over, since as you can see that the RCW you quoted clearly has regulation regarding state owned vehicles, but exempts law enforcement vehicles. I can see that there would be problems with fake officers with a law like this. But I think that "The *department of general administration shall adopt general rules permitting other exceptions to the requirements of subsection (2) of this section for other vehicles used for law enforcement," pretty much will let them keep vehicles unmarked. I think it would be great if we could get a Lawyer in Washington state to chime in on this. Also, I read your no cameras blog, and watched the video, found it interesting as well.

RCW 46.08.065 Publicly owned vehicles to be marked - Exceptions. "This section shall not apply to vehicles of a sheriff's office, local police department or any vehicles used by local peace officers under public authority for special undercover or confidential investigative purposes" The simple basic word "OR" creates 2 different exemptions for Police. Gavin, I suggest that you stop ambushing hard working Police Officers and book an appointment with the Sheriff, Police Chief etc. to make such frivolous complaints. This way you can have a truly informative conversation. That is of course unless you are relying on someone not being 100% informed about your vague and obscure law arguments. As a former Law Enforcement Officer (LEO), you have a point! The way you go about it really stinks. I'm not sure if you have gone to the Departments Administration or to the city/county commission to voice your interpretation of that state law. If they are in violation of the state law, you now have it as a public record because all commission meetings are recorded. So at 2:29 in to the video he shows "See RCW 46.61.020" as his supposed law that he is quoting the officer. I live in Washington, and see all kinds of unmarked cars. I decided to look up that RCW, and it says nothing of the sort that he claims. It says and this is pulled directly from app.leg.wa.gov/rcw/default.aspx?cite=46.61.020 RCW 46.61.020 Refusal to give information to or cooperate with officer - Penalty. (1) It is unlawful for any person while operating or in charge of any vehicle to refuse when requested by a police officer to give his or her name and address and the name and address of the owner of such vehicle, or for such person to give a false name and address, and it is likewise unlawful for any such person to refuse or neglect to stop when signaled to stop by any police officer or to refuse upon demand of such police officer to produce his or her certificate of license registration of such vehicle, his or her insurance identification card, or his or her vehicle driver's license or to refuse to permit such officer to take any such license, card, or certificate for the purpose of examination thereof or to refuse to permit the examination of any equipment of such vehicle or the weighing of such vehicle or to refuse or neglect to produce the certificate of license registration of such vehicle, insurance card, or his or her vehicle driver's license when requested by any court. Any police officer shall on request produce evidence of his or her authorization as such. (2) A violation of this section is a misdemeanor. Basically, it has absolutely nothing what so ever to do with driving an unmarked car.

I read that as well. You are not understanding it correctly. These vehicles are exempt in cases of undercover work and Gavin asked the officer if this was the case and the officer confirmed that he was not in fact undercover. Officer explicitly stated that he was in fact NOT undercover and that he was pulling people over.

Not an expert on Law, only have talked to people who know their stuff but I'm still quite ignorant here. I'm prettyyy sure Gavin breaks at least 1 if not a few laws himself. Correct me if I'm wrong but I'm almost certain i.e. when a citizen stops any individual to confront them breaking the law, it is illegal for the citizen to invade personal belongings without permission or extreme cause. Gavin reach's in the car multiple times with his hand and denies a request to stop pressing against the window. Again, not an expert, pretty sure that's illegal. And if it is illegal, it kind of defeats some of his purpose of demonstrating proper law to the police officer. Even if everything he did was legal, pulling a condescending attitude is frustrating. The positive message of this video will be overlooked because of his attitude. This video could be a great message but instead it's a pretty good one with some crappy handling.

RCW 46.08.065 paragraph one states that law enforcement vehicles for the purpose of special investigations or on special assignment are exempt from the marking law. (1) It is unlawful for any public officer having charge of any vehicle owned or controlled by any county, city, town, or public body in this state other than the state of Washington and used in public business to operate the same upon the public highways of this state unless and until there shall be displayed upon such automobile or other motor vehicle in letters of contrasting color not less than one and one-quarter inches in height in a conspicuous place on the right and left sides thereof, the name of such county, city, town, or other public body, together with the name of the department or office upon the business of which the said vehicle is used. This section shall not apply to vehicles of a sheriff's office, local police department, or any vehicles used by local peace officers under public authority for special undercover or confidential investigative purposes RCW 9A.40.040 Unlawful imprisonment. (1) A person is guilty of unlawful imprisonment if he or she knowingly restrains another person. (2) Unlawful imprisonment is a class C felony. [2011 c 336 § 365; 1975 1st ex.s. c 260 § 9A.40.040.] By placing yourself practically half-way in his vehicle, you've also restricted his ability to leave, and knowingly done so. Technically, you're guilty of a Class C felony. Your so-called "liberty speech" is inaccurate within the realms of the law.

If you have a problem with an officer or department policy or procedure, you should file a formal complaint. You are seeking an audience, trying to get attention. You are going way over the top to gain support of people who don't like cops, and eventually it's gonna bite you in the ass. You happened to find a VERY polite officer, and why he didn't roll up his window and drive off when you started playing him is curious. Try having a little tact and, if you don't like cops, just stay out of trouble and don't engage them! *First*, never pull over unless a car is clearly marked. *Second*, try to pull over or into an area where there is a parking lot or gas station with many witnesses in case something is fishy. I once drove 8 miles *very slowly* (with flashers on) to the next exit that had a Mcdonald's, walmart, etc. so everyone could clearly see what was happening and explained just that to the cop as I don't trust any human being, *badge or not*.

Cops are notorious for being filmed behaving unethically ever since the KZbin era and implementation of body cams. This cop is a rare cool one with patience. But it’s called a police fraternity for a reason. The bad apples are protected by even the good cops based on their “code”. The way they will lie and coverup for each other to extent of falsifying police reports, lying under oath, and have zero accountability. Supervisors/higher chain of command unwilling to implement a code of conduct which in turn creates the toxic culture. Disciplinary actions are essentially non-existent for officers, creating their sense of invulnerability to unabashedly commit unethical habits. Let’s not forget about the ever so powerful police union with labor contracts so heavily leaning in their favor it’s damn near impossible to fire an officer. Most popular forms of any punishment utilized - even for officers involved in deadly shootings - is either “desk duty” or paid leave. So they’re taught a lesson by being pulled off street and get to sit inside at a desk OR if really bad get to sit at HOME. Not house arrest don’t get it misconstrued. Paid full salary to stay home & off work. I mean if they decide to stay home...more likely to take advantage and go on a vacation. Protect and serve..,hmm yea I never called cops for help but seems they’ve harassed me half a dozen times pulling me over for traffic violation but somehow get more focused on marijuana in car or whatever stereotype and quota is that day’s cross referenced goal. And why are they so quick to get offended and bully people who question them and/or know their rights/law? The agitation it causes them is a sure sign of being drunk on power. Ironic it’s those who were bullied in school or felt internally inadequate growing up seem to find a way into becoming police officers. The most unfit to hold authority but seek it out and eventually exploit it once obtained. FTP

You weren't paying attention. He starts by asking if the car is being used to site traffic violations, and later goes on to say that is not legal to do in an unmarked car. That's why you mostly only see detectives in unmarked interceptors.

Protect us? Don't make me laugh. Every single encounter I have had with the police including the encounters my friends have had with them have always been bad. My friends and i have been harassed by police so many times. They're just trying to make money off of the public. I have never had a police officer legitimately help ever, I've always been harassed by the cops. They don't protect and serve they abuse and enslave.

I am? Okay then tell me if this isn't abusive authority. I got pulled over one night for turning into a center lane to merge on the hwy cop pulled me over for that asked if I drank anything. I didn't. Then asked if there was anything illegal in the car. There wasnt. So he decides to get me out of my car claimed I was acting suspicious and he detained me, put me in handcuffs and put me in his car while he ransacked my car to find nothing at all and since he found nothing he gave me a ticket for $300 all because I didn't "turn into the correct lane" now... how is that protecting? I have many more examples if you want more.

Because you're changing the grammar structure. Nothing in the sentence exempts them UNLESS they are working "for special undercover or confidential investigative purposes." Thank you. That was my interpretation of this. Sadly the bar has been lowered so much that the fact Gavin didn't get his face smashed in (or detained on false charges) puts the cop in a highly favorable light. Nonetheless I do appreciate the cop's patience and collectiveness, which all officers should be required to have. I do wonder though if the cop didn't know him (as it appears they've had these types of run ins before) if this would have went as smoothly.

At 2:50 you said that the officer is required by law to provide his ID at a stop? That "stop" that you did wasnt even a legal stop. So therefore he's not required to provide you with his ID. Citizens cannot legally pullover a police officer in a vehicle and harass them for ID like what you did. What business do you have heckling police anyway? Just let him do his job. I can tell Washington state law sucks because here in Florida, unmarked cars can pull people over. Its a strategy for effective traffic enforcement.

They might be unmarked, but they have to be registered as undercover(Which is legal in Florida aswell). And no, he said that a police officer is required to show his ID when stopping a vehicle, if the person being pulled over requests him to do so, people just don't because most don't know the law. "Just let him do his job".. How come you're so willing to overlook the law when the police officer is the wrong doer? These measures are all in place to prevent impersonators. Would you also like to "just let" random citizens pretend to be officers?

He provided his ID and proved that he wasnt an impersonator. Since the car was brand new and didnt come with any stickers on it, it was the only choice he had. he had to go on the road and do his job since the department failed to provide him with a temporary car until the decals were properly installed onto the car. so thats a failure on the department. thats not the officers fault. because regardless, he still has a job to do

Sooooo... You decided that you would fix the problem by stopping an officer, who ultimately had no control about when the decals, and such where to be installed? In a way, yeah. I see your point, but in another way I'm asking myself, if your intentions really where to make a change to the system. One would think you'd actually go down to the police department, and plead your case to the Chief? You know, the guy who's in charge? You talk about how you are concerned for your daughter, which is understandable, but I don't really see how you are truly looking out for her, when all you are doing is "stopping" officers who again, have no sort of role in the process of getting the proper decals installed, instead of making a push to fix the issue promptly by taking it to the brass. Again, is it a breach of protocol, yes, but in all honesty all you are really doing here is wasting everybody's time. You can't go off a fallacy in the belief every cop is a wrongdoer, and is driven by power trips. Seemingly there are multiple protocols I'd be concerned about that are being broken, then something as this. Point is, if you want to make a difference, instead of making KZbin videos of you puffing your chest out, go to the main source of it all, instead of finding officers to single out to try embarrass. Dude I live in Moses Lake, Washington. I go to Chief moses middle school. I’ve been watching your videos and actually learning. A while ago two of my friends got suspended for play fight like barely pushing each other. They even tried to tell them and even came to a consensus that they were play fighting which nowhere has it been written that you can’t do that. I think this is very unjust. If you could go back like your older videos and talk to them especially Mike Nordsten. My school district is very corrupt and is slowly. Thank you.

How was he being an asshole? And it doesn't matter whether or not the law is obscure or not, the officer should still uphold the law regardless of what that law happens to be. There are some seriously fucked up people that drive around in unmarked cars posing as police. To make this law more common knowledge is helping to protect the safety of the public. And "arresting him for being an asshole" is the exact reason why a lot of people have problems with cops. Unless the guy had a legit reason to be brought in for arrest, the officer would be abusing his authority for doing exactly as you say and just lend more credence to why people don't trust cops.

Gavin, I need to understand this law a little more. Now the way it is written is not VERY particular. It does state "...used in public business to operate the same upon the public highways of this state..." but does that excluded local public roadways? The way I read it, it is specific on highway use, but does not explicitly exclude public roadways within a county or city. Can you help clarify?

From reddit: RCW 46.08.065 says "Traffic control vehicles of the Washington state patrol may be exempted from the requirements of subsection (2) of this section at the discretion of the chief of the Washington state patrol." The first subsection (the part about marking your cars) at the end says it has the same exemptions as section (2) mentioned in this quote, thus if you consider a traffic police car to be a "Traffic control vehicles" (which I'd like a LEO to let me know if this is the case) then they don't need markings unless the chief says they need it. TLDR the video guy is wrong and needs to read the entire law he's citing before he tries to arrest an officer. Also, my own notes... back the hell out of an officer's vehicle if he tells you to. This guy pisses me off so much it hurts.

Travis A This. My read is that this law is intended to require the right markings for traffic control vehicles in construction area for the safety of all. The state patrol is charged by this law to make sure these vehicles are properly marked, IE: flashing yellow lights, decals, etc.

People have to understand that the RCW quoted has different sections that apply to different vehicles. Section 1 applies to vehicles NOT owned by the State (WSP). There are 3 exceptions to Section 1. Vehicles owned by sheriff departments, vehicles owned by local police departments, and vehicles operated under public authority for the purpose of investigation. The vehicle driven by the deputy was obviously a sheriff department vehicle, so it falls under the first exemption of Section 1. Section 2 and 3 don't even apply to this situation.

Meh. The guy was within his rights to flag down the officer and ask him for ID, but then to sit there and say "I'm going to educate you about the law" is ridiculous. If you think the officer has broken the law, then go and file a complaint against him. As we are seeing in the comments section here, the law is pretty grey. So many people think that laws are black and white, but they are very grey. One person says the officer didn't break the law, while another says he did. This is why we have lawyers and judges to interpret the laws based on their knowledge of precedence.

Cars unmarked out of the specific application are out of compliance. If the law enforcement observed a civilian vehicle out of compliance, would there be any hesitation to cite such a vehicle for the infraction?? Mr. Seim apparently has a valid argument against law enforcement breaking the law in the performance of enforcing the law. With the right kind of timing, the cars could arrive and the striping could be installed to insure the patrol car takes to the streets in compliance with the statute...nothing the law enforcement dosen't require of civilian drivers.

I went through the Washington law and it says: "This section shall not apply to vehicles of a sheriff's office, local police department, ***OR*** any vehicles used by local peace officers under public authority for special undercover or confidential investigative purposes" It doesn't say "that" in the place of "or". After the "or" is separate from the police and sheriff vehicles. An example of "any vehicles used by local peace officers under public authority for special undercover or confidential investigative purposes" would be an impounded or private vehicle that would be used in an undercover drug buy.

Can someone explain me to what extent a police vehicle must be "marked" in order to legally pull someone over? I probably have this the wrong way, but is it illegal for an "under cover" police vehicle to pull you over? i.e. no police markings, light bar? There are many of these in the area I live and I have never heard of anything that requires the police vehicle to be marked.

In WA that is illegal. See the blog listed linked in the notes. If you live in another State it would be a matter of Sate law, but if it's not illegal it needs to be made so as it's a very real safety issue for the public.
