James Freeman covers Auditing Erie County's investigation into the corrupt city of Dunkirk New York.
Auditing Erie County visited Dunkirk New York last summer to check up on the public servants. He found that they were rude, aggressive, and that there was absolutely no such thing as a complaint form for a complaints on police officers. The city brags about the incredibly low amount of complaints made agaisnt their officers, but Auditing Erie County found out that this is because the complaint process is a process by which the complaining party is bullied and intimidated by police, and that there is absolutely no such thing as an officer complaint form. The city makes him sue them just to get simple public records, and then offers him $750 TO STOP INVESTIGATING THEM. SOUNDS LIKE A BRIBE TO ME!
This story and fight with the city for transparency is still on going.

OK, riddle me this. Desk sergeant gives auditor a complaint form and he fills it out and turns it in and it's stamped. As chief of police I read the report, then call in officer John Doe for a conversation that goes like this. Hey John come on in my office for a second, but let's get a cup of coffee first. How's the wife and kids, hope everything is OK. By the way, one of those first amendment assholes with cameras came by and was taking all sorts of videos of our cars, and one of the poor babies got his feelings hurt and filed a complaint against you. Look, I hate those assholes as much as you do, but try to be nice next time. We don't want to get them upset again, but they hate all cops to begin with. We cool? Great, have a nice tour and we're done with this matter at this point. So I email the auditor that he was councilled and that the books are closed on this complaint. If the auditor tries to pursue the matter, well that goes straight to the shredder.

This is an area in which they have to bag their limit. It has to be shown that it is a pattern or practice. If multiple instances of this occur, the State Supreme Court will deal with the attorney, and the Governor will deal with the Mayor. That said, this guy has a recording of the city attorney telling him that HE will not get a response. That might be actionable.

@@al1383 Worst case for the attorney would be disbarment and recommendation for criminal charges. Best case would be a finding that the claims were unsubstantiated. For the Person who is in charge of FOIL requests (the Chief) it could be removal from office with a recommendation for criminal charges. For the Mayor, it could be the removal from office with appointment of an interim mayor, and a recommendation for criminal charges. It all depends upon the particular situation.

Police Complaint Forms should be online so the public can print them out themselves and not have to be harassed if they go to the department to request the form. If anyone gets their hands on the forms they should put it online so it could be copied by the public. OR write your complaint in a letter and have it notarized then sent to the appropriate department with a return receipt requested and or whatever forms the USPS has to prove that the letter was mailed.

Great point. Crime would probably go down because the people would appreciate the transparency and be on their side. I've heard that cops don't want crime to go down because then they can't justify their jobs. If that's true they would probably rather see crime go up. More crime means a bigger budget, more influence, and more power.

He was honored as being the "highest producing officer"... meaning he arrested the most people. Think about that... you are honored for putting the most human beings in cages.
