The offence is in the reason he used the legislation. Section 26 refers to using constable powers for the benefit of ones self and/or other persons. In this case he's using the legislation to nurse his bruised ego

The location is Catford Police Base at Aitken Road SE6. PC Woolston needs to be instantly dismissed without pay and while waiting for it to go to court and should be should be taken off public facing duty without pay. The police MUST hold a must higher threshold and can not feel insulted and can't use the Public Order Act as an arrest. You MUST not settle this out of court and get a personal claim against him for a minimum of £250,000 plus costs otherwise will take it to a higher court.

Remember folks when they are recording you and asking questions it is an INTERVIEW WITHOUT CAUTION so be careful what you say. If it wasnt recorded they cant use it in court but because it is recorded they can even though you havent been informed of your lawful rights, putting you at a serious disadvantage.

"Officers and staff are reminded that ALL BWV footage is subject to disclosure and may be relied upon or referred to at any stage during an investigation or prosecution of a case." The notion that the cameras are there to keep them honest is secondary to the evidence gathering capability.

But as you can see in my reply to the other comment, Merseyside police BWV (Body worn video) policy 2020. Section 8.2 Collateral Intrusion. "Officers and staff are reminded that ALL BWV footage is subject to disclosure and may be relied upon or referred to at any stage during an investigation or prosecution of a case." So it appears they use it and rely on it whenever they choose in both investigation and prosecution. If there is some finer detail in law that restricts it that is not reflected in the sections of policy i looked over and if there is a greater restriction i'm missing it would put the polices policy in direct conflict with the law. Again, i'm happy to be corrected if there is something i'm missing or not understanding

Don’t forget to goto the ipc to make a claim for wrongful arrest that compensation is a separate claim from the court. This is the problem with the police these days the standards are so low, anyone can join and they all think they are the law, when they are not.

Marti, don't accept an offer to settle. Take it all the way, even if it results in a much reduced payout. They want to drag it out and make you earn your compensation. So make sure it costs them AND goes to trial. At least afterwards there will be a court ruling that you can call a cop an "idiot" without fear of being charged or issued a fine.

Nothing wrong with going into a cell, it just increases the compensation you can get from them later. Also, going limp upon arrest is legal, makes their job more difficult as they have to get more officers to come and carry you into the police station.

Nothing has changed since the sixties then. Just finished work and popped in a shop for a drink. Came out to find a large sausage MET OINK standing by my bike. Demanded my licence but was disappointed to find all was legal. Then did the usual, create a crime search routine. Oooo! found a screwdriver and other tools in my tool bag. Invited me to the local for further investigation, declined. Then threatened to arrest me. On what charge i asked? Not going "equipped" surely? An embarrassed red faced IDIOT OINK walked away into the gathering gloom.😂
