I think it’s important to understand the difference between “arbitrary” and “random.” A human being cannot perform a “random” drug search. The only way they could is to run each ticket through a random number generator, but that’s not what’s happening. There’s always the influence of the officers deciding who does and doesn’t get searched.

We know smarty pants. The issue here is whether these officers are solely applying race in that process. You may select on a variety of factors, race just can’t be one of them as per the 4th amendment and the Equal Protection clause in the 14th amendment.

It's worse in the UK, as they simply make a substance testing machine say that the person is testing positive for drugs. In the UK someone watching surveillance cams presses a button to make the drug sensor say "cocaine high", when people of color pass through. It's a Mandy Rice Davies thing, and they do rig the test results. One man who I would say is a person of color filmed one of his shakedowns and said it was his 5th time coming through, where every time the sensor says "cocaine high" for him, and he gets searched.

I've seen racial profiling happen right in front of me at an airport. I'm American and I was going through US customs after having been in Europe for the summer. I was in the line for American citizens, spouses of Americans and permanent residents, and green card holders. So I went to the shortest line and there were two men in front of me. The first man was wearing what I think was traditional Sikh attire and he looked Indian. Keep in mind the border agent looked to be of Indian descent as well. From the moment the Sikh gentleman walked up to the border agent, he had a hostile attitude and after their interaction, he was pulled aside from the line and his belongings were searched. The next person in front of me was an African gentleman and he spoke with an accent from Africa. He got the same treatment from this border agent and was pulled aside and searched as well. Then I go up. My mom is ethnically English and my Dad is Native American, and I look like a lighter version of my dad. I was expecting the same treatment and to be honest, I was ready to go toe to toe with the border agent. I was returning home and didn't have a flight to catch, so I had all the time in the world. But surprisingly, he treated me much better. I don't know why. I was kind of shocked to be honest. While, I've seen and heard stories like this, it was my first personal experience with racism from a government official.

This isn't racism - IDK how you think what you witnessed is racist. Do you have any idea where these men have traveled during their trip? Do you know if they booked tickets within the last day or 2 (or last minute)? Do you know if they visited any cities/countries which are hot spots for drug production/smuggling? Do you know if any of these people had prior arrests for drug possession, smuggling or any other felonies in any country? Do you know if these men might have just had a newly issued &/or "emergency" passport issued? Do you know if these men didn't have proper ID (possibly expired) and an exemption was made for them to travel? Do you know if either of these men are 2 or 3 degrees of separation away from a terrorist, drug dealer, cartel member, extremeist, etc (this casts a WIDE net & can drag in A LOT of innocent people who can end up searched) I could list about 100 other reasons these men could have been singled out when they checked in/ boarded (or even booked) the flight. You stating this is racism is so sad b/c you are only looking at it from a victimization point of view, one that is all too often exploited by people who are no where near victims (& are actually victimizers).

@@kde5fan737 I don't think you understand; we were going through US customs in a US airport. To make it clearer, we were in line to enter back into the US. We were on the same flight from Europe. Booking tickets doesn't apply here as the border agent didn't ask them or me for it. I was a few feet behind them. I heard everything. This agent was aggressive towards them from the beginning, before they even provided their documents, so there is no way to have known who they were, or anything of that nature. I know what I saw. They were dressed traditionally and spoke with an accent, and that border agent treated them differently because of it. If we were on the same flight and he suspected us of drugs, why didn't I get pulled aside and searched?

I would probably treat this the same way as a traffic stop. Do not consent to the search, but obey the instructions of the officer. If the officer tries to convince you to consent to the search, politely ask if you are being detained or if you are free to go. Afterwards, search of no, you can then contact an attorney if that is your wish. The problem is that hiring an attorney is expensive, which would deter a lot of people from pursuing legal recourse. Eric Andre has money, and I'm glad he's forcing the courts to look at how police conduct random searches at airports. I regret that Eric has to spend his money on this, and I hope he is successful in changing things for the better.

I'm a brown man (I have the same complexion as Eric Andre) living in Australia and this happens to me regularly. Especially when I go to the bottle shop to pick up some wine for my parents or champagne for a birthday party. I am so used to it now because Australia is really racist that it doesn't even bother me anymore. It's really sad.

Oh my god… several years ago I decided to treat my dad to a soccer game in Atlanta (we’re from Los Angeles) since the Mexican national team was playing Nigeria in a friendly. We only planned to stay 2 days, nice weekend getaway. A few weeks prior I had gone to a music festival and used the same carry-on luggage. The reason why I bring it up is because while I was packing for the Atlanta trip I kept getting random wafts of “the devil’s spinach” (I was a legal mmj patient at the time in CA) but I triple checked my bag and couldn’t find anything so I just chalked it up to lingering smell from the festival. I knew GA at the time was very much NOT ok with any sort of “drugs” so I made sure to be extra careful. I knew something was off when we got to LAX and I got another STRONG smell of it from my bag so I do yet another check of my entire duffle bag, again nothing! At this point I felt uneasy but I made sure I didn’t have anything so I just let it go. Cut to several hours later at the Atlanta airport we get to baggage claim, I grab my bag and BAM that unmistakable skunky aroma almost knocks me over it’s so powerful even my dad notices and he’s not “cool” like that. Also this happens not far from 3 ATL police officers. That’s when I glance down and notice the zipped up compartment I neglected to check where the handlebar of the bag collapses into when not in use, I open it and the biggest ziplock bag of weed is just chilling there like “yo whaddup homie where finna blaze this week? Where are we, man!?” I damn near had a panic attack! As quickly and calmly as I could muster, I wrap the baggie in an ugly worn out sock I wasn’t going to miss and I dumped that crap in the nearest trash can. Luckily I didn’t get in trouble but that could have easily gone sideways all because I used to be an idiot stoner.

Because his lawyers looking for a good payday said it was. Funny how that works. I think Eric was upset about the negative experience and tried to make sense of it. The answer he came up with was probably flawed, but he has enough influence and power to take a bold stance (whether it's based on how the police actually work is less known). The power dynamic the police had against him was very brief: he was never searched and he was able to go about his day freely, without further interference. Who knew Eric could be so fragile after all the stunts he's pulled? This really took me by surprise.

In articles about this, it comes down to civil forfeiture. They’ve seized a ton of money from citizens. It’s not really about drugs. If they find you have X amount of money, they go, “You could be using this for drugs so we have to take it” and getting that money back is highly difficult.

I condone 100%. I've been there before. It's disgusting that a cop can stop you and arrest you for suspicion of something with 0 evidence of anything.
