Given how prepared Lopetegui was before coming to WHU I can't believe he wasn't well informed about the Paqueta situation. Football insiders probably know more that we the public know.

Typical West Ham luck Mark. The FA need to prove that Paqueta was complicit in people on Paqueta island opening online betting accounts AND betting on him getting a yellow card in the four fixtures. However, I doubt the FA would have charged him if they didn't have irrefutable evidence of his wrongdoing. If Paqueta is found guilty then he deserves whatever comes his way. However, if the FA has no proof then Paqueta and the club should sue them

The FA are fishing! If they had something on him, they would have charge him well before they run out of time! So they charge him to give them more time to find something. That's my thoughts.

This is what will happen: They charge him He appeals and wins FA say they tried so Paq man then has no grounds to sue West Ham stick by him and he then gets a move to another club

What worries me is what standard of proof is needed to ban him for this. You'd think it would need to be pretty clear evidence if you're making a decision that effectively ends someone's career. But as it's not a criminal charge, I don't think the burden of proof is that heavy..?

It’s not, all they have to show is the balance of probability- not beyond all reasonable doubt.

I think that the FA charging as an, excuse the pun "a get out of jail" seems extreme and opens up damage to reputation litigation. A well balanced video well done! No good will come of this

@TonyHammer61 No. Under what jurisdiction. Conspiracy to defraud Betway would be a possible but where do they get the evidence unless it's on Paqueta's laptop. The police probably wouldn't touch it.

The non cooperation piece is the FAs thing they can lean on to make this charge look less frivolous bearing in mind they have little to no evidence. A matter of opinion that they can make stick. This is what he'll eventually get done for, fine, short ban, Paq has his career back, West Ham dont have to sue anyone and the FA save face. Mark my words!

Mark. Someone said to me on a, chat the other day that the IRC can find him guilty on the balance of probability without concrete evidence of communication he had with the people who placed the bets. Wondered if you know if that's true. If so seems unfair.

That is the case if it’s seen as a Civil case. In criminal it’s on the basis of ‘beyond reasonable doubt’

To accuse a player of spot fixing is something the FA would never do without evidence and quite frankly the evidence is there. Spread betting on his home island back home in Brazil jumped over 300% on the four seperate occasions in which he was booked. Somehow all this money went on Paquetta receiving a booking and that is what happened and like you say no smoke without fire. Remember Paquetta does not personally have to benefit from these bets to receive a punishment and he hasn’t but his family and close friends are said to be the main beneficiaries of these bets and reports are he has done everything in his power to hinder the investigation. Of course Paquetta will deny these charges and West Ham have to back him but I don’t see him beating these charges and I feel a hefty ban is inevitable.

The law moves very slowly so I wouldn’t dismiss the fact that it’s taken them a long time to collect evidence.

The Fa, in my opinion, have limited evidence but this delay has been agreed upon between Team Paqman & FA as punishment behind da scenes. .

i once was advised to not be co-opertive as it was down to them to find my guilt when i was innocent !!! got a nfa .. so its swings n roundabouts depending the evidence i guess . if he can be found guilty on probability that i do not no ..

Team Paqman does NOT have to help FA investigation find him guilty. It's up to them to do it themselves. Don't be nieve. He MIGHT be involved in other things not pertaining to investigation, he does NOT want known.

Can West Ham sue the FA for a failed legal action which has caused a financial loss after his failed transfer to Man City or at the very least the difference between what we were offered and what he is now worth in the transfer market eg. Consequential Damages

I’ve watched the clips of the bookings and it doesn’t look good, wasn’t the bets placed via his home town and via Betway, the only hope for us is the burden of proof, can they actually prove the link let’s hope not

Well he has a bad temper so it's likely anyone that knew him previously would put a bet on him getting a yellow. Same as if you saw a good horse in a small race and backed him in a big race for massive odds
