The presence of Rev. Jesse Jackson in the courtroom during the murder trail of the three men accused of killing Ahmaud Arbery caused a scene. All three defense attorneys motioned for a mistrial because of him. #CNN #News

@tboneforreal2 жыл бұрын
@Tisk Tisk The cameras showed he never touched or took anything, he just looked around. The property owner said his cameras had seen others had done the same. Merely being on a property is not automatically a criminal offense. Technically under Georgia law what Mr. Aubery did by going into the construction was not criminal trespassing unless the property owner specifically either told him not to come on the property or have signs indicating no trespassing. If the police had been called, they would have simply told Mr. Aubery to stay off the property. Also the defendants never actually saw Mr. Aubery on the property, they pursued him only because they saw him running through the neighborhood and believed he fit the description of someone who supposedly had been committing crimes in the area recently. I say "supposedly" because the local police had no reports of such crimes having taken place. There was absolutely no legal reason or justification for the defendants to attempt a so called "citizen's arrest."

If he had started doing it in front of the jury then he could possibly be disbarred. Depending on his history. Mostly he would get a reprimand and a warning to clean up his act or face disbarment. Unless they change the rules this conduct, no matter how reprehensible, is legal. Racists of a feather, flock together, and this "defense attorney" seems to not care about how he looks as long as his client gets off in any way possible.
@CaminoAir2 жыл бұрын
Defense attorneys (and I am not trying to excuse these particular lawyers) will try any tactic to get a favorable outcome for their clients. They have clearly made a calculation about this. The tactic is obvious, which doesn't mean that it could not succeed. Basically that the presence of high profile black pastors will sway public perception of the trial. Yes, it's cynical, but that is how the legal system is set out: adversarial. If the judge over rules them, then what the lawyers said will remain on record and floating about in the public consciousness. It's a desperation strategy.

When a lawyer says with all respect you know they're about say something disrespectful.
@JeffSmith-pl2pj2 жыл бұрын
"with all due respect" means "I respect your opinion but your opinion is wrong." You still must be respectful. If you said "with all due respect, you have your head up your ass." you would still be taken into custody.

It's been my experience, as an old white woman, I'll refer to the late James Baldwin; " I hear what you say, but I see what you do". I'm not a racist usually means you are.

Southern backwater hate on full display. This trial has been a light shining on the racism & white privilege that is so taken for granted in Georgia. I moved to Augusta to work, & the black/white divide & mistrust was shocking to me- & I grew up in Arkansas! I left after 8 months & returned to south east Missouri- a Red state with its own problems, but absolutely chill in comparison. Will there ever be an awakening, an awareness, of the waste & lives destroyed by white fear & distrust?

@William Scott If you are living in America, if you were raised in the south, if you have lived and worked in Europe & Asia & Central America as I have, you can see it plain as day, every day in the US. So, yes. And so have you, Sir.

@William Scott I didn’t delete anything you wrote. I think I was snarky & edited my response, which was still snarky. If I were speaking face to face we would speak & then listen. Hard when feelings are so raw. I want more than anything for Kyle to learn. Mistakes were made. There must be some change in his awareness, or he will be set up to continue reckless acts that are disastrous. I apologize for my sharp tongue. Please review the postings & you should find they’re all there.

@William Scott They’re both on my mind, & you are right. I think of my own son & how he might have been caught in some similar horror. Both these trials are tragic outcomes. It’s hard to feel compassion but when I can, if humanizes me as well. Hard times

@Donald Thorpe no the defense attorney's racism is strong otherwise he wouldn't have pointed out and stressed their race numerous times , he would have just pointed out that they are well known public figures NOT emphasized the word BLK several times .

@@TheCut2009 where is Dr. Charles Stanley? Joel Osteen? Rod Parsley? Dwight Thompson? Scott Thomas? and others as if God only called them to the pulpit how can they watch unarmed black males and females murdered and not speak up, speak out and show up ? For the least of these? What kind of gospel they preach but no action on their part? Must Jesus bear this cross alone and they(pastors) go free? Just asking???

The defense was grasping at straws. They had no defense and they knew it. So, he tried everything that he thought would connect with the jury. That's what a good defense attorney does. In this case, that tactic seemed to only hurt them. Reprehensible, is an understatement. Some waters should never be tread. Sometimes you do drown. In this case, up the creek without a paddle.

I'm from near Jasper, TX., and that case was different in that Byrd was never accused or suspected of any crime - it was racism, plain and simple. The killers knew him. It was sad and terrifying, but also amazing in that the local paper did not attempt to "hide" the story - they put it out front and center to show they condemned it. All were convicted and two have been executed - the 3rd was simply driving the truck and could make a case that he didn't know what was coming, though I believe he's still in prison. The MOST amazing thing was the Jasper bank marquee reading "America, pray for us...." I cried over that, as an older white woman who grew up with racism in the south and hated it. We have made so much progress. This is more. Glory be.

@@pamelaleigh4225 we haven't made the progress you might think. They got better at hiding it. Black skin, hair, mannerisms, clothing has always been criminalized in this country. The difference is now it's being constantly recorded. It takes people such as yourself to lend your voice through letter writing, protesting, shining light and asking the difficult questions to put an end to this barbarism and the inhumane treatment of some of its citizens. Fight through your vote, hold your representatives to a higher level and make them accountable for when they fall short. Work today to make the small changes tomorrow.
