can you help me? there is an example: Sam´s car broke, he brings it to a car sales and repair service the seller (John) told Sam that he can come back in 10 days to get his repaired car however this seller sells the car to someone else and hands over a contract to the 3rd person, he also gives the 3rd person the documents which he found in the car when Sam comes back to pick up the car, the shop was closed and the seller put a sign on the door which said "moved to Argentina...." Sam, whose car broke sues the person who bought his car from the car repairer What is the legal issue here?

Hi Linda. The material issue, based on the information you've provided, appears to be if the 3rd party purchaser is bona fide. In other words, was the 3rd party aware that the car he's buying for valid consideration has another owner. In such an event, it may be unlikely that the 3rd party would have to return the car to Sam as there would be no way of compensating the bona fide 3rd party for the loss he would suffer monetarily since the seller has fled.
