You're right, but the judge has to take a little time to 'investigate' his concerns about his representation which are almost certainly a game of his. I've seen others do this as an idea to get a case dismissed, but it never works as the courts will just blame him for the difficulties. There are certain constitutional rights that even he has at this point that she has to make sure are followed through on. I'm sure she will waste a little time and then throw him into a cell, otherwise it would be too easy to appeal.
