Missouri is not a stop and ID state. Those statutes only apply to Kansas City, not the entire state.

Lowkey, in today’s day and age, the cop could have claimed that the guy flipping him off was racially motivated in order to cloud the facts, and many people would have jumped to his defense without question.

The bad cops do so much damage it’s impossible for good cops to make up for all of it

He said "you're being disrespectful" Um... That's what the 1st amendment is for. So you can say "down with gov", or "down with the king". Flipping off the cops is a perfect exercise of first amendment. The police telling the guy to RESPECT HIM is stupid. Cops DESERVE no more respect than anyone else. People can yell hatred at me, all they want. It's their right. The cop accidentally admitted to stopping the guys because they flipped off. This guy has the rank of SGT. I mean, with behavior like that, I think he got ahead, because of affirmative action.

During Jim Crow it was a crime for Black People. Being out in public during working hours with no visible means of employment was the excuse used to pick up Black People/sell them to companies for little to no money.

I honestly think "flipping off" the cop was the purest and most efficient form of audit i've ever seen. Literally while sitting on a park bench smoking a cigarette he managed to audit a cop driving by in his car. Brilliant.

I hate seeing this. I support police, but this is what causes the outward hate of police officers. The Sargent either did not know the law or he was banking on the two guys on the bench not knowing the law. Either way that a dangerous game and not what professional police officers should be doing. Before suiting up always leave your egos at the door...that is the general rule.

Sadly a large number of officers earn that disrespect. Better training in the law and regular psych evaluations would help I think. The offending officer had a previous infraction on his record which should have been a consideration in his investigation and ultimately led to his termination. This is a bad apple who will become a senior officer at some point and teach younger officers how to be bad apples.

I find it unfathomable that "aimlessly walking around" can be a crime. Especially in a country that likes to call itself the land of the free. Like, Nazi Germany maybe, but not even the worst of the communist countries ever had such a stupid law. Feel free to correct me if I'm wrong. What do you guys do with tourists in the USA? Do you make them have an itinerary and just arrest them if they stray away from it?

This shows just how far the police accountability movement has to go. The fact this officer wasn’t immediately terminated and arrested for intentional deprivation of rights under color of law (or similar code violation) is case and point.

Well the DOJ isn't doing their job. They are the ones who would have to charge deprivation of rights under color of law. The DOJ seems more worried about moms protesting how their schools are teaching their kids than actual police misconduct.

Right-on guys! Great job! Please inform us how this case turns out. As a Canadian, I do research for a large organization that compiles data for the Tourism/Travel industry. The information is then made available to Canadians, in our government-issued guides, and include topics such as 'the relationship between local police and the citizens'. It allows us to WARN and ALERT Canadians about which areas or counties, cities, towns, highways, etc, to AVOID. The thousands of Snowbirds who drive south, are thus spared having to worry about being pulled over ILLEGALLY by horrible cops like him. That cop needs to be held accountable - and FIRED!

I don't see them wearing Bernie Sanders or AOC t-shirts or carrying BLM or defund the police signs or asking the officers to use gender pronouns. "Hippie"? Hippies are in their late 60's, 70's and early 80's. These young men are too young to be labled as hippies. They definitely weren't born in the "Baby Boomer" generation nor did they come of age during the Vietnam war era. Looks like they were born after 9/11 to me. I have "hippie" in my username, and although I was born in the Vietnam era, I was not aware of what hippies were until the early 1980's when they were starting to call them Yuppies. "Losers"? Again what makes you think they're losers? Because they're not wearing a suit and tie or business casual? This interaction took place on a Sunday and I don't know about you but I definitely dress down on Sunday's. They do look and sound like stoners though and when I was their age I was a stoner too and still am, but I never partake unless my schedule is clear of any major responsibilities such as on nights and weekends. But I'm no loser. I've owned a house for 23 years that's almost free and clear, 5 cars and put 3 children through college without them ever having to worry about student debt. Don't be so quick to judge people based on a 16 min video under stressful circumstances.

That he went into the subject's pockets at all is a 4th Amendment violation, based on Terry V. Ohio. The officer *MAY* have been authorized to do an external pat-down (my doubt is strong on this point), but going into the pockets is a separate stage of search.

I think you nailed it. Maybe you don't realize it though. The officer said " we have every right...." Implying that officers have rights. Can you name an office, title or position that is given rights? Does the constitution provide protection for the rights of any job, title, position, office or title? Rights are only for individuals. Positions have privilege, authority, obligation, requirements, policies etc, but not rights. The officers primary directive as an agent of the state within the United States is the same as the purpose of government, of the uniting of the states. The core essential principles that are the foundation of our common interest. The rights of the individual that are essential and necessary to freedom. To the existence of a free people. Without individual rights, there are no rights for anyone. Just privilege and authority for the few and subjugation of the many. It's a very big deal when officers confuse and conflate rights with authority. It is the inescapable obvious admission that the officer places rights as an inconvenience and hinderance to his use of authority. By giving himself and all other officers "rights" that no other person has he is denying the existence and violating the protecting of every individuals rights. RAS just happens to make this very easy, allowable and even expected. No officer you don't have that right but you also do not have that lawful authority. Watch the world around you with the thought that words are being misused and see if you don't notice just how much this is creating harmful issues to this country. From the misuse of gender, the conflation of feelings with facts. Officers who call the subject of suspicions a suspicious person rather than a suspect. The misuse of the definition of RAS etc. Laws are nothing but words on paper. We have ample evidence from police, prosecutors, politicians and even supreme court justices, of just how badly things can go when the definitions of those words or the meaning of those words are misconstrued to fit a desired conclusion. It's exactly how RAS and QI came to exist. Its why a vaccine is no longer actually a vaccine, a new strain of the flu a pandemic. Emergency authorizations allowed for things that are not emergencies within government purview. How a president and administration can say $3 trillion dollars cost nothing. I think you nailed it noting the officer used the word "right". He may have believed he had the authority or he may actually be so ignorant and constitutionally illiterate that he really believed it was his right. Sorry officer but even as a person, an individual, your rights are actually limited and restricted by your position not enhanced to super powers. Just some thoughts, maybe I'm way off but I offer them for consideration, a different perspective. Take them as you will.

I filed a complaint on a cop in a town of 10,000. Even tho i did like his sgt and knew the guy for years, he really made me feel like I was the only one to EVER do it in the 150 year history of the city by saying, "Yeah, I think this is the form. I've had a long-standing mistrust of police, but having now watched nearly 3000 videos of police interactions, that's also growing toward hatred. It's not because they're often wrong, but because so often they are unbearably arrogant and so sure that they are right when they're very obviously wrong. Even when it's impossible they were ever trained or ever read a law that would lead them to believe they could possibly be correct. "I literally have no idea, but I know I'm right, that's for sure."

Imagine if the cop went up to them and had an actual conversation. Just like, "Hey man, what was that about? You're not being detained and don't have to talk to me if you don't want to, but that hurt and I'd like to know why you did that and how I can help you not feel that way. I want you to feel safe in this community and not feel the need to do that." Then either talk or just walk away. Would have actually made a difference, as this just makes the guys double down on their hate. What a world.

I live in a Suburb or Detroit and I had a cop back into my driveway and hide behind my hedge looking for people running the stop sign, while I had no problem with him stopping people for that reason I didn't want him using my driveway to do it because In my area if you have anything to do with calling the police or allowing them to use your property to bust people they are going to come back and destroy your property. So I nicely went out and asked him to please move and I explained my reason to him. He got really pissed off and left my driveway and sat in the street. So about a week later the SAME cop while I was riding my bicycle around for my exercise ( I am a cancer patient and I try to stay in shape as best I can) stopped me while I was riding on the sidewalk and started searching me and asking me all sorts of questions that were what I perceived as a trap to get me to incriminate myself in some way and I told him that I knew who he was and WHY he was doing this and he told me it had nothing at all to do with why he stopped me, He saw me leave my house and followed me for about a half a mile before he stopped me. He tried to give me tickets for all sorts of bicycle infractions like no light, no helmet, no protective gear and the fact that I had my hood on made him as he said pulled me over because he couldn't see my face. I told him I am a disabled Veteran, and he said What Fuckin war were YOU in ? I showed him my military ID and a couple photos of me in Iraq on my phone that I keep and he told me anyone can fake pictures. I just told him go ahead and give me the tickets and I'll sure the living hell out of you personally, He ended up getting back into his car and leaving I wish he would have done something I could have had that particular cop FIRED for, Punk, and he is WAY younger than I am.

Yeah I got pulled over for being suspicious as well. This happened about 8 years ago. If I would’ve known at the time that I was being profiled I would’ve raised hell. I was to young to even know what was happening

At the end of the day the interaction will probably be used to support a lawsuit. In cases where the officer is clearly in the wrong it can work out but I get your feelings generally.

Think of it from their side for a moment. He casually threatened to take them to jail and they clearly started getting fearful. Plenty of instances of people being arrested and languishing for hours for choosing not to answer questions asked by a egomaniac. Cops know this and use arrest itself as a weapon to coerce compliance.

The cop should be reprimanded that... well... sadly people can say "fuck police" while being on a walk in this country/state/city. ​@@dlynnbennett8208 To be clear. I understand that firing him for getting irritated by kid showing "fuck you" might be too much, but doing nothing is actually admitting the cop was right. That's very shaky legal ground IMO for a civil institution. And much more concerning than a cop, whom we might even relate to. But an institution should represent constitution and their citizens a bit better, and can't be swayed by on-site emotions. I can understand one cop doing a very slight abuse of power. Of course it shouldn't be legal, but it wasn't an arrest, it was unlawful detention for being disrespectful, not condoning but not big consequences either. Not taking an institutional stance against it. That is super concerning because it inspires proliferation of incorrect behaviour.

The kid was well within his rights, and the officer clearly abused his power. However, this is also a perfect example of why the kid, or anyone even with those rights as a civilian, should not feel it is always acceptable to test the waters, knowing the probability that "gross" mishandling of situations by police could happen because people do not like being antagonized with the "finger."--whether it is justified or not.

2 videos in a row where ATA didn't comment on this. I think it is because *you have to invoke your 4th Amendment rights by stating **_"I do not consent to a search"_** or similar* which is BS, but the law is what it is. Otherwise the threshold is EXTREMELY high unless they make an arrest.

I had something very similar happen. I flipped off a cop and he followed me and pulled me over. He claimed my brake lights and license plate light weren’t working. I literally showed him they were. My car was just dirty and the light was on its way out. I was parked right in front of my garage when he pulled me over and he threatened to have my car towed because it was “blocking the alley” 😂 I told him I would just go to court and get it all dropped and he said “Good luck!” A few weeks later I went to court. Showed them pictures that my car was in proper working order and they dropped all the charges. The sweetener was months later running into, as I called him, Officer “Haircut” I called him this because of his “Hitler youth” haircut I told him he had. I had quite the victory when I told him I got all the charges dropped.

“Aimlessly walking around” Never has the 1A auditor catchphrase “Is that a felony or a misdemeanor?” been more appropriate. It’s hilarious that Officer Name’s-Right-Here doesn’t seem to realize that apparently he’s “aimlessly driving around” since he doesn’t appear to have been doing anything or traveling anywhere.

It's usually the people who really shouldn't be police officers who become ones. You want calm, logical, intelligent and respectful people in such a vital profession but those are attributes almost NO police officers have. They're usually the complete opposite; aggressive, illogical and reactional, incredibly stupid and disrespectful. My theory is that it has something to do with the thumb like heads 99 percent of police have.

There really need to be hefty consequences for these kinds of stops, where a cop just pulls someone over or stops them on the street for "disrespecting" them. How many hundreds of these stops have ended in wrongful arrest, injury, or death?

There was a Muslim lady in Chicago headed for a train when the cops stopped and beat her, the first thing they said was"she was walking with purpose". I tried to find the video but couldn't locate it.
