This cop was more than likely bullied at school, so now he wears a uniform, he can get payback. Before being recruited, they should all be subjected to psychiatric evaluations. This type of cop is why people no longer respect the police. If a citizen asks them to answer a question, they are being confrontational and are harming the cop's fragile ego. And then they explode - costing the taxpayer a fortune, but still remain cops who get a slap on the wrist.

Most people in the military will have an out of state driver's license because they are not required to renew every time they move, which is often for many of them. What should have happened is this cop should have been shot in the face.

The entire 8 years i was on active duty with the army drivers license, car registration, and insurance were based in my home state with my parents adress. If this had happened to me the only way i could have proven i was residing at said adress would to show the cop my lease.

I disagree. It is impossible to know every law...even for lawyers. Yes, nitwits do don the uniform and the badge...but, I am willing to bet there are nitwits at your place of employment, too. It's a human thing, not a police officer thing. And, sorry....but, the regulations are strict on the officers. If you ever get the chance, talk with an officer. The police officers I've encountered were nice as can be. Of course, if I was robbing a bank or assaulting an elderly man, I'm sure those same officers would put me in my place. Our society is sick, morally. That sickness permeates everything.

Damn near every time, regardless of circumstances or even guilt - the state or local government, everywhere in the USA, consistently LETS KILLER COPS WALK FREE! I know there must be cases where such cops get prosecuted for actual murder, when they do commit actual murder (which they terrifyingly, seem to do fairly regularly) but I haven't read about a case like that for a long time! The case of Kelly Thomas (Fullerton CA) is a prime example of this when two jack-booted thugs in uniform, beat a homeless man, to death, in front of witnesses, while he screamed for his dad! The example of what happened to the cops, is what DIDN'T happen to the cops, because NOTHING HAPPENED TO THE COPS. The cops walked free when the police force is a gestapo, that does nothing to discourage cop's thuggery and murder and no "penalty for killer cops except maybe a paid vacation ("suspension") on the taxpayers dime while the local government waits a month for the public to forget the whole thing)... there's something very wrong in this country and it's been happening for a long time.

I went to highschool with a a very large overweight bully. When I was a kid, my parents told me that if I was lost or needed help to find a police officer. After several unwarranted and unconstitutional searches, verbal and minor physical abuse, I will not call a cop even if my own house is being broken into. There have been several good cops who have helped me, but there have been others who treat the people they are here to protect as insurgents and they act like an occupying army. Giving them military weapons and training does not help.

The fact that the cop blamed the victim and stated that he could have been justified in shooting the victim proves that the cop has a short fuse and was unjustified in chocking the victim. It shouldn't be illegal to tense up when being unjustifiably chocked. Shame on the prosecutor for taking so long to drop the charge of "resisting".

CaliforniaArchitect I don't get how you can not tense up. It seems like a normal reaction to suddenly being grabbed would naturally be to tense up to protect your throat/breathing ability. And that would be for a normal citizen. This guy though was trained repeatedly on what to do if choked. Until it became ingrained into him. I don't see any way that he could not tense up.

I was a teacher in the public school system. Some students would swear at us, push us, tell us “NO” , and completely ignore our instructions. We had to take it and we had nothing to protect us. So, we had to learn to use our words in order to deescalate the situation.

My mother was a nurse and was in a similar situation, but she was so protective of her patients she didn't care. They would overwhelm a patient who was combative by surrounding them with as many personnel as possible. They weren't allowed to even bruise a patient whom they were subduing, and police regularly bruise people just with the hand cuffs they use. Nurses were not allowed to sedate patients like in the movies because it is dangerous to knock someone out. An anesthesiologist is needed to sedate someone to the point of losing consciousness and then he needs to stay and make sure the person keeps breathing. Plus they often didn't know what else the patient might have taken and it would cause drug seekers to attack regularly. She has been threatened with a knife and she didn't shoot anyone, or kill anyone. Cops have turned into cowards. One two cops who broke that elderly woman's arm (stole flowers from Walmart) got his panties in a knot because he saw the female cop rub her arm. He was frantic, "Did you get scratched?" The SOB had just laughed at the sound of the elderly woman's arm breaking and he acts like a potential scratch is the end of the world. If teachers and nurses can deescalate a situation without killing anyone so can cops.

Resisting and obstructing arrest are almost always automatic charges for anyone dealing with police. They are impossible to defend against unless you have video evidence. They are trained to do this so that they get more money. The police are nothing but gang's that work for their states and cities to collect money from citizens through extortion.

Not knowing much about the neighbor, it’s hard to say. Says he hasn’t really seen the neighbor, and if they genuinely thought he may be an intruder, calling the police to check does not mean accosting an innocent person. The property manager in my community did not give me a heads up on the empty place next to me, and when someone was there I had no clue why. It was during office hours, so a call to them cleared it up, but they are supposed to give us a heads up, and I would have called the sheriff if the office wasn’t open. Im sorry, but you never know who you are confronting. In my instance, it was a a guy they hired to paint.

Even after showing i.d and a MILITARY i.d at that, the cop still used excessive force.lol I have a question if anyone knows the legal answer please say it; Being that he was on his own property, under the Stand your Ground ruling, what would have happened to him if after being put in a choke hold and slammed to the pavement, he fought back and overpowered the cop and in the process, was able to get the cuffs on him and then called 911? He was totally in his right to defend himself...cop or no cop. Anyone who is at their own home and has properly i.d'd themselves to a cop has the right to defend themself against a rogue cop if the cop decided to attack them for no reason. As for the D.A who said that the cop was justified and the charges of resisting are justified .. well that is a huge shit pie in the face of that whole city. Just listening to Aquino and the way he talks you can tell he was probably an asshole to the cop. The cop got a call regarding a suspicious person at the house and confronts Aquino outside. the cop didn't know if Aquino just burglarized the house, killed someone, or some other crime. It was the cop's job to detain him and figure out what Aquino was doing and if he had a right to be there. I'll bet you anything, Aquino from the beginning was an asshole and gave the cop a hard time, forcing the cop to use force until he figured out Aquino lived there. I robbed a string of banks earlier this morning, but was caught and arrested while fleeing the 7th bank I'd hit. I was accused of multiple counts of armed robbery, based on clear and obvious video evidence that it was I who did it..... They found ALL the cash in my trunk, in nylon bags with each bank's name on them. 🤞🤔🤞 But..... when it came time to adjudicate, I acquitted myself of ALL charges, based on my own testimony that it wasn't me who did it! Case closed!!👌😀👍

All police in all 50 states NEED to be required to wear body cameras and to have them on in each and every contact they have with a person while in their official duties. Without this protection we Americans are living in a police state. Police often get delusions of grandeur due to the gun they wear and the official status they hold. Suing the police is the best way to keep them in line, as well as using your cell phone to record any interaction with the police. I am pro-police but there is a serious limit to my tolerance as I'm a Nam vet and a legitimate war hero and I don't want my rights taken away from me by anyone. StocktonRob

Is suspicious activity a misdemeanor or a felony officer? I was shot at and forced out of my house AT gunpoint because a neighbor called the cops about a light being on in my house when I had came home 1 day early from my honeymoon. Overzealous cops like this need to be removed from the police force. No evidence of a crime and this shit happens?

As a Navy veteran i can assure you that our standards of living, our morality, values and behavior are held to much higher standards than any civilian workforce, or other government job besides perhaps the POTUS.

Yeahh and not to mention even if the guy was being confrontational, its the officers job to De-escalate any situation so it does NOT escalate to use of force. But police do the opposite, the completely instigate and escalate every situation to justify using force and adding charges.

@Kurt Ogden To a point I agree. The only problem I have with that is you would be hurting the children of the officer, who are truly innocent and do not deserve to be hurt. Now I think that officers should be required to carry malpractice/liability insurance like a doctor or lawyer. Officers with no claims get a reduction in premiums and officers with claims get premiums raised. When the premium gets so high that the officer cannot afford it or the officer has so many claims that they become uninsurable then they loose their job. That is one way to slow get rid of the bad officers. Reward good behavior with decrease in premium cost and punish bad behavior with higher premium cost. Also that way the officer can't just go to another department or state and work again. If they cannot get insurance they cannot work. So several things would happen by doing that. 1) Tax payers wouldn't be flipping the bill for bad officer actions. 2) Save the local government money that can be used to better train officers or help low income areas. 3) Promote and reward good behavior and actions with officers. 4) Punish bad behavior and or actions of officers and hold them personally responsible for their actions. 5) Slowly weed out the bad officers by cutting out the protections of other corrupt officers and leaders.

Now switch the situation around: this air force captain asks this 'person' who he is and why hes on his property, then grabs this "officer" in a headlock and takes him to the ground. I guarantee you, he would have been charged with assault on a police officer and no one would have questioned it. But when a cop is the transgressor, good luck finding anyone to be on your side.

Defending his personal property would of course be justified. Were this situation to have happened say at a park or other public arena I might have a different opinion, Yet this was an individual with identification on his own property. The use of force was not justified.

MOST of the ones i know (including my family) want to make the world better. But out of millions of cops some are scum. And they havent for some reason learned they need to call out the bad ones.

Of course they defended the officer's actions. Cops will always, always, always side with their own, even when their own are obviously in the wrong. They have an "us against them" attitude. @deathrider Knowing this, the next time you are called to jury duty, suspect the government first and give the accused every benefit of the doubt. Make the state actually prove their case instead of just assuming that the guy would not be in trouble for no reason. There is now just too much evidence that shows that yes, big government is corrupt, and yes, when their cops screw up the heads rally behind them and support them even to the point of complete delusion.

Police training is 6 weeks in Ohio, it varies from state to state, most states have a 6 week course.

Danbury CT Policeman did that to me. He was sent by my EX (insane, as they found out) for a "Welfare Check" (she said I was suicidal). He grabbed at me immediatly, all I saw was a blur, and I was face down in handcuffs. Afterward they sent 2 Female Officers to tell me how it was not their fault. Then one of the Females told my ex my address (by accident) and they had to detain her 3 times befor finally arresting her (all in 2 weeks). I took a transfer and moved.

WTF???? A peace officer doesn't treat someone like this. Mr. Cop overstepped his authority and violated this man's civil rights. A line was crossed, proper procedure was not followed here. This is EXACTLY why the public does not trust law enforcement anymore. The cop should've been reprimanded and put on desk duty indefinitely, after being put on leave without pay. Curbing this despicable behavior will send a strong message that cops cannot violate the civil rights of citizens, especially the innocent.
