@@billtate6962 there is no rule or law that says the prosecutor has to charge the officer. @confuse36714 ай бұрын
If the officer just said he didn't remember another officer being there.... Instead, he double down... If he said he didn't remember, you then question his memory about other things. How much was his testimony from memory vs. how much from his 'notes'? The doubling down - outch. Now the testimony suddenly turns from "incompetent" police officer to questioning the honesty of the police officer. I saw one trial start with the lawyer objecting to the officer reading from his notes... The judge said he was aloud to refresh his memory... The lawyer then asked "are you testifying mostly from memory or mostly from your notes" To which the officer said "mostly memory" (of course he'd say that). Then the lawyer basically shredded the officer because it was clear he had no memory of the stop. This was a traffic stop. The notes were the ticket and some notation on tickets. FYI, most police will have notation on the ticket for things like "Do you know why I pulled you over?" "do you know how fast you were going?" "Do you know the speed limit here?" and they will note how many people are in the car. When a police officer walks up to the car, the first thing he does is inspect the interior - noting how many people are inside etc. You can always ask the cop - what color is the interior of the car - who were the people in the car (in the above case, it was his two children in the back - which of course the cop totally forgot/didn't know). Bottom line, there are lots of details that the cop should have know, that aren't on the ticket.

At the end of 2022, I sold for cash a 35 acre operating farm in upper Frederick Co., MD. The purchasers were a multi generational family from Kentucky. They indicated that they sold ALL their Kentucky real estate holdings due to governmental and police harrasment. Nothing chills citizens' sense of safety and wellbeing faster than police as major revenue generating conduits. This lack of trust in the motivation of government, inability to gain redress through the judicial system, and poor training of local government officials and police on Constitutional rights results in citizens fleeing the pain and frusting of dealing with idiots and they are taking their skills and money with them.
