@@richardcain7352 i mean in Charlotte we carry the rapid alcohol tests. Can use the blood from the IV flash. They are the same as the instant lactate tests for sepsis protocol and and instant tropinin for TNK administration

And that is why yous should always exercise your right to remain silent and refuse FSTs & PBTs. All of those are simply additional points of testimony or video evidence to be used against you.

The prosecutor is outrageous. Heaven help anyone who does not have a good lawyer going up against someone who tries repeatedly to skirt the rules. And he is attempting to get the judge to skirt the rules also. Sickening. Any represented by a less experienced or less persistent attorney than DUI would be in trouble with this prosecutor and his contemptuous attitude. I love the way Larry stands between the officer and the prosecutor during cross-examination. No hand or face signals available.

Damn you are good! This proves why someone needs an attorney. The prosecutor was trying to skirt the rules for sure. You can tell he hadn’t gone up against an attorney that actually tries hard to defend their client.

yep this prosecutor is out of his class when Larry has the defendant for a client.....I know one other atttorney in Louisville that was much like Larry....he is now Judge Brown. Maybe I will see Larry in his courtroom...which I think Brown is still a judge

I have noticed over time that prosecutors lose at lot of cases when the defendant has a good lawyer. And really high profile cases at that. I don't think prosecutors make good trial lawyers because most cases are plea bargained to rates about 90%. Prosecutors just don't have the trial experience a good defense lawyers have. They are used to just railroading people into plea bargains. It was obvious the DUI guy absolutely knows the rules of evidence and examination. The prosecutor seemed to be clueless at times.

I grew up thinking that prosecutors were the good guys looking for justice. In reality it seems like justice has nothing to do with it and they're just looking to get convictions however they can. This prosecutor isn't looking for justice. He's just trying to win however he can.

The number of DUI arrests and convictions are often tied to federal funding. Also a guilty verdict protects the municipality from being sued in a civil rights case. So judges often side with the municipality also.

Losing cases for any reason don't look good on a lawyers resume. But I think they could just dismiss i, for lack of evidence of a crime, and not lose face.

I am a psychology student, not a law student, but oh my goodness watching Larry is akin to being in a classroom with an amazing tutor. I just watched Larry come from the podium and stand in front of the police officer, which broke the officer’s line of sight, the officer can’t take comfort in seeing his ally, the prosecutor, and the prosecutor can’t give him non verbal support signs or eye contact. Larry is a genius.

The fact that the EMT doesn't appear to be one of their planned witnesses is extremely odd. It would be reasonable doubt #1 in my mind if I were a juror on this case.

It must be hard for the defence to determine if they should call him as a witness themselves. What is better? An uneducated cop making guesses, or an EMT with some medical knowledge that never did a real assessment if he was intoxicated? Now, when I write it out, I think Mr Foreman made the right call. But we will see when we have a vertict. Can't wait 😱

I wouldn't say that the fact he is not called as a witness is reasonable doubt in and of itself, but it leaves a lot of unanswered questions in the "lack of evidence" pile. You have to look at what is presented in court, and what facts are not presented in court (as Mr Foreman stated in his opening), but not who are and are not there. That's the reason for Foreman's long objection streak under the cop's testimony. The cop was kinda testifying on behalf of the EMT.

@@gagenater In the court of public opinion we can speculate about such things, of course, but I don't think the jury should. They should just look at the evidence presented (or not) in court. If I'm going to speculate, I think that the prosecution feared that the EMT could have some conflicting accounts of what happened, or maybe they didn't remember anything about it. He probably didn't do a fair assessment if the accused was intoxicated either way. In that case, it doesn't make sense for them to call him as a witness, because it's basically just another tool the defence can use to discredit the cop's story, and it doesn't do anything to prove guilt. In short: they had an extremely weak case.

@@AudunWangen That's sort of my point. There's 3 people who could assess Danny's condition post accident - the cop, Chyrstal (sp?) and the EMT. The cop made the arrest, so he believes his position. Chyrstal has some motivation to try and protect Danny. The only less interested party is the EMT, and the jury won't hear from them. The fact that they aren't being heard from makes the situation very uncertain - to the point that in my mind it's a reasonably doubt in and of itself.

The fact that concussion was not defined or part of the officers consideration is baffling. The lack of supporting evidence by the prosecution. The need for photographic evidence is a must, even for the officers.

If you visited Rockcastle County you would understand. A very poor county full of political shenanigans. An attorney would be treated like a rock star. There are several fine people in the county but they work big farms and take care of their family and neighbors. You won't see the good people have time to get into trouble or have any political interest.

Exception to the hearsay rule is not telling the jury that the EMT told him the guy smelled like alcohol. You have to testify ONLY to what YOU observed or noticed.

I should NEVER need a DUI/DWI Attorney, as I quit drinking years ago, but we seen people blow Zeros and are still arrested so these cops can get the Bounes Checks from MADD. I WILL hire this guy or someone he suggests to Defend Me Against the DA Office or anyone else trying to sue me from a DUI/DWI charge!! Just within the first 35 minutes of this video, The DUI Guy would be worth every penny paid to him for having to shutdown the Prosecution's unethical line of questioning regarding the testimony of this cop. The Prosecutor was doing EVERYTHING he could to elicit testimony that was on allowed by the court/judge

Is there a legal requirement to take FSTs in Kentucky? (I don't think there is.) I would never let the police or Prosecutor get away with saying I refused to do something I was not required to do... I would insist the correct term is 'Declined their request." "Refused" implies that I should have, or was required to, but didn't.

Well, he "heard others talk about it" and they were probably talking about how inconvenient they are and how much it costs LAPD or NYPD for their whole systems. He kept talking about a couple cameras inside the precinct. But come on, people know what they cost. We have ring cameras and wildlife trail cameras and people have recording devices all over their cars nowadays. We know that small dept just does stuff they don't want recorded.

After the guy refused the test, the cop arrested him, AFTER refusing the test, my question is why have him take the test in the first place if he was going to arrest him anyway ? If the guy had somehow aced the test was he going to let him go?, i mean with the strong odor and swaying body ?

Just goes to reinforce why field sobriety tests should ALWAYS be refused by the suspect. Field sobriety tests only serve to strengthen the officer's case, NOT to exonerate the suspect.

Dudes been on the road for 9 weeks. No way he has the experience to know the defendants speed, or know if he was under the influence versus medical issues after accident. It’s literally just this kids word. It’s wild a kid has this much credibility in court and judge overruled the motion for direct verdict. Commonwealth only had an inexperienced kid as their witness. That’s wild to me.

As a society we need to stop infantilizing those 18 years and older. They are not kids. They are adults. This why is why 30+ year olds refusing to move out and start thier adult life, because they are still refered to as kids. At 38 a male is just starting middle age. Half of thier expected life is over. They live up to what is expected of them. Treat & expect them to be kids, and they will continue to behave as such.

Was it everybody else's first day in a courtroom? I was waiting for the DA to say that he's "just a small county lawyer" and the judge can't even figure when and how long lunch should be. Is it normal to have to pull out your own podium?

Larry does it for dramatic effect and to establish his authority and show lack of fear. And he has explained this previously himself in at least 2 videos so I believe him. It also gets him closer to witnesses which is somewhat intimidating and alarming. Smart guy- our DUI lawyer!

I love your step by step explanation of how a trial is supposed to go. The DA is a damn moron. Maybe that bring just the cop and the good people will believe him move works (maybe) with other defense attys, but not with you. You can tell he gets away with it all the time. How the hell does this DA think he is getting a conviction with absolutely no evidence. I wouldn't be able to even bring charges against someone in this situation. I would be too embarrassed to walk into court and say well people we don't have any evidence because of a stupid rookie mistake, but go ahead and believe the word of said rookie when he says he did the rest of his job like he was trained to do. Really?? Maybe he thinks the people of his district are really just that dumb? Like I said, Moron!!

If I were on that jury, I would be put off by the DA not having enough respect for me to stand while he is asking questions. I think he is rude and lazy. It would make me wonder how much work he put into this case or if he just decided it’s easier to just testify and hope opposing counsel was dumb.

Under penalty of perjury. Did the judge forget he is a cop, not a common person. Cops dont perjure. They make mistakes and dont get charged. But if we do the same thing, jailtime

I am glad the defendant refused the tests. Coming from a horrific accident like that, I can't imagine passing any tests given his anxious state, brusing/injuries, etc. Like the defendant, I also would want to get out and see my loved ones and also try to calm down and be done with any blood tests ... he already refused the hospital and EMT folks, indicating a strong desire to get out of the ER.

I am always impressed by how you meticulously pick apart an officer's testimony. Though I've never been pulled over for a DWI offense, if that happened, I would hope my attorney would be as good.

Brilliant laying down of foundation when questioning of rookie cop. Very respectful...leaving the rookie with the knowledge of fault which was not ultimately, his. Whether or not the cop realized that at the time, but he started to be less tense and he was more forthcoming.

You can tell that the prosecutor prepared for this case by sitting down with this rookie and saying "this aint my first rodeo. Ill ask you why and how you arrested the guy. You answer my questions. We go home with a W for the county". They werent expecting someone to present an ACTUAL defense!

No evidence, guy wasn't driving or even in the car when the officer, the only witness here, arrives, guy leaves officers presence for hours, they meet back up at hospital because guy chose to leave, etc. No evidence to put him behind the wheel let alone intoxicated over the limit beyond a reasonable doubt, plus driving while intoxicated beyond a reasonable doubt... Although I still wonder which way the jury decided because juries always convict, it's like beyond reasonable doubt to jury means suspected of maybe being guilty.

You can carry in a courthouse as long as you're LE. But usually not for others/lay people. Where you CANNOT ever bring your guns, is in a detention or correctional centers.

@@GarryFishermusic you're not wrong, my ex is a Marshal in a large courthouse, of course they're armed ... the only place officers remove the arms & lock them up before stepping foot inside, is a jail or correctional centers. I'm sure you understand why no firearms are allowed on the inside of a secure facility. Literally NOBODY can go in with a gun. The prisons have guns inside but they're in secure places & only certain staff have access to them

This is the first video i have watched of you since Liz Amazing video. The hear say rule you are fighting for to me is correct. The DAs are known to bend the rules well past the breaking point. If they want to get it entered they need the EMT to their to tell it. You might be a much better attorney than i first thought.good luck and keep uo the great work!!
