It also doesn't acknowledge that the Government is essentially in "cahoots" with ALL the deranged cops by not correcting the systems that enable and empower them. This happened to me in Detroit rented a house that had been raided before I moved in and they thought it was time to write it again😢 took my son-in-law's tried to arrest my son and his girlfriend tore up my house I never had a warrant and we never seen the money again complain to get it back but nothing happened Detroit😂

My father-in-law won his lawsuit against Texas officers, even though ALL the body cam footage from 8+ officers “disappeared “. What they did was so outrageous he didn’t even need the video. I think Texas police are absolutely out of control!!

Under Texas law, a nuisance is a “condition that substantially interferes with the use and enjoyment of land by causing unreasonable discomfort or annoyance to persons of ordinary sensibilities attempting to use and enjoy it.” In other words, a nuisance is something that would annoy a reasonable person. The generation of sound from any identifiable source that exceeds 50 dB(A) at the property line of an offended person shall constitute prima facie evidence of a violation, how many dB do you think that speaker can output, do you think is just in the porch for show? And yes if the blue pigs did not previously warned them at least once they can be challenged in the court of law. Both are in the wrong IMO. for reference: 40dB: a quiet library. 60dB: ordinary spoken conversation. 85dB: a food blender. 88dB: heavy traffic. In my life I have seen this type of crap many times. I've also seen them coerce women into sex. I've seen them rob citizens. N mamy other horrible things. Decades ago I loved on the other side of the law n we were in biz with prolly half dozen cops. But at least these ones admitted they were crooked from day 1. They say it's a few bad apples....however I've been all over this country n it is literally the same everywhere u go. In my lifetime I can count maybe 3 or 4 truly honest good cops. So it isn't just a few bad apples. N then just like politicians we give them immunity. To me that's the biggest problem. Noone should have any immunity. Unless ur a witness. Otherwise either ur a criminal or ur not period

There was no noise complaint. The storm troopers were looking for an opportunity to raid the house and take one of the brothers as prisoner because of something that was botched in the courts or justice system weeks or months earlier. I have never seen an officer look to handcuff someone seconds after responding to a noise complaint.

I'm so glad I live where I live. My huge town is a whole 1200 people. We have 2 cops. They both do a very good job. They are kind and actually protect the constitution. Our chief of police is awesome. This stuff doesn't happen here.

This is absurd abuse of power. Warrantless arrests on private property. Each officer involved should not receive qualified immunity and should pay financially and should lose their policing authorities.

If what you say is correct, is this not a criminal act of armed intruders entering an occupied dwelling to kidnap innocent people using violence and force, while acting under color of law. So if you did this to a family what would happen to you? Why should the law apply differently to others. Civil suits require one individual party to take on the full resources of the state, overcome qualified immunity and try to get awarded a judgement that will be uncollectible from the officer and will be paid by the taxpayers. Why not let us pay for the criminal prosecution like we always do in every single criminal case. And actually prosecute the officers as the criminals they are. A conviction makes qualified immunity pretty much non-existent, making a civil suit much easier. In fact a settlement will be offered almost every time. The officers ability to be an officer, vanishes with a felony conviction just as the ability to own a firearm. The cop as an individual likely has very little as far as property or financial resources. By the time a civil suit gets filed and tried, the officer will have spent "everything" on legal expenses. All property will be in the name of others. So while you might get a judgement of $100 or $1 million, good luck collecting. You could spend years going back to court trying to get orders to collect. A criminal prosecution puts the resources of the state on the side of the victim not the officer. Make the system work for the people don't ask the people to work for the system.

When police believe the law is what they say it is not only are they a danger to the public but they are also a liability to the city. These officers should have been fired as well as criminally charged for their actions, they have committed so many constitutional violations, preserved as evidence by their very own body cameras, that the city should just settle now and avoid a costly court case they can’t win.

So, they had no jurisdiction in law to do anything they did. @@douglashoward9616 Yes, but the cops will never be charged for it but of course the family likely has a civil suit. The Federal Government rarely prosecutes these cases under the 18 U.S. Code § 242 statute because of the four elements needed to prosecute, the one about not knowing the law is always the biggest challenge. They would have to prove that the cop knows the law regarding pursuit but willfully ignored it. If the family sues and wins, then in the future, we could assume that this particular cop now knows this court ruling but unless they can prove that he was taught this in his training, or had been sued for this in the past, they won't prosecute. The 1983 Civil Suit though could go forward because in the civil rights suit, it does not matter that the cop did not know the law. He and his employer can be sued.

The states of course can't prosecute people under 18-242, but if they fail to charge someone with it and the federal government thinks that there is probable cause, they can, but what stops them in most cases is the "Willful" standard required. The other three components are pretty easily satisfied in most cases but the "Willful" component is far harder to satisfy. The have to have evidence that the defendant must have had a "specific intent" to deprive the victim of a particular federal right. . If you are not famaliar with the "Willful" component of the statute, I would recommend that you do some research. The time that this is almost always possible is when a cop uses force because he gets angry, and not because it was prescribed by policy and often, they only use it if the victim sustained permanent or serious injuries, or particularly egregios behavior. A great example of this is the six Mississippi cops that essentially kidnapped and tortured 2 black males. This was clearly willful on their part and they were charged under 18-242 and have since plead guilty. Here is a great example where the Willful component is easily satisfied. No reasonable person would believe that this was some freak occurrence and that they knew the knew that what they were doing was illegal but did it anyway. It is not always easy to satisfy that component, but it is used many times a year in the US.

In TX (and everywhere else I've researched), "Disorderly Conduct" must take place in a "public place". And in the TX law, it specifically says the cops must give notice to the person in that public place of a noise complaint. These a-hole tyrants are wrong on two counts. It's difficult to follow, but the cops came by and told them to turn it off. They turned it down and all was good. Even though they had the right to play their music loud at that time. Then their buddy came back from the store and turned it back up without knowing about the warning, that wasn't valid. Cops came back and basically wanted to fuck them all up because they didn't do what they were told.

It's an illegal use of force. With a deadly weapon, well less deadly, but it still counts as a deadly weapon. Yet we see them brandished and used for compliance like here very regularly. There is a strong argument that if one of the occupants had responded with deadly force that those actions would be legal. Force that is reasonable and necessary to stop the imminent threat of serious bodily harm or death from the use of illegal force is justified.

You are so very right! Choosing your battles when you are in authority is the key. Unfortunately they felt that they could push anyone over almost anything. I am sure that these being black kids made the cops react even harsher. I have known some excellent cops. We are all human and we sometimes dont always do our best. But there is a difference in how you start out to do your job. I was once a housing inspector for the city. A small number of my colleagues got assaulted, threatened and shot at. In the 2 years after I left that job, my car broke down twice. Each time I was helped by someone whom I had taken to court- and gotten a fine against.. Each of them said that they appreciated that I had treated him like they were human.

Let me explain to you at your level of understanding: the behavior of the majority of policemen is similar to the behavior of policemen in a country in full tyranny. I grew up in such a country and the behavior is similar, except for the unjustified killing or even the public executions of police officers exposed online. It can be seen that you are not able to make the difference between condemning gratuitous violence, crime justified by frivolous excuses and appreciating other aspects of American society.

That was crazy and dangerous. The woman could have been seriously injured or killed from the needless assault. Those people only retreated as they were attacked. These cops should be in jail in my opinion.

You know i saw a video of a girl cop saying " ive been a cop for years and im telling everybody to please leave us alone." She was crying and stuff - my comment was now you know what it feels like- the public has been suffering from what bad cops do for decades

These videos need to be released and broadcast to the community in which it happened. The pitchforks would come out in short order. This hiding or destroying the footage and letting things cool off is not how it should be.

My only thought was thank goodness it was not a gun he was holding. Although Tasers if abused can be lethal, if that had been a gun, I hate to even think about it. Thank you for your comment! -taya
