Ethan Newberg has pled guilty to making at least nine illegal arrests during his time as an active police officer-and despite damning video evidence, faces no jail time. Police Accountability Report returns to the case of Newberg with a look at two videos released as a result of the Baltimore District Attorney's 32-count indictment against Newberg. The footage demonstrates not just Newberg's capricious and often violent use of police power, but the culture of obedience and corruption within the police department that fosters and enables such behavior. Taya Graham and Stephen Janis discuss the wider implications of the Newberg case on not just the city of Baltimore but the question of police violence at a national level.

I live in Richmond Indiana and was an otr truck driver. From 2010 t0 2019 I came to Baltimore once a week to a place called Warfield-Rorh casket company on Patapsco Ave. Across from it was a car wash that everyone warned me about. I was told some of the roughest people in Baltimore hung out there and to be careful. My 1st night there I walked over to that car wash. I didn't find bad people, I found good people the cops labeled as bad. They were the ones that warned me to never call Baltimore police for help because I would be the one put in cuffs. They gave me phone numbers to call them if I needed anything. Through the years that followed I found out how right they were. If any of them read this comment I just want to thank them for all they done. They really were good people.

They decided the memorial for the ones that died in the downtown explosion was enough, so they removed everything else. I now work in road construction driving a dump truck. First, I want to say I really appreciate the work you do! It is very important to have people who are out there holding people accountable. This being said, I wish some of these statistics in crime were true here in Western Washington. We had the most homicides in history last year in both Seattle and Tacoma. Home invasions, vehicle theft, crash and grab robberies, and even highway shootings have massively skyrocketed since 2021. Rape & sexual assaults are unable to be properly investigated because we do not have a serial assault unit anymore due to unprecedented numbers of officers leaving from city/county/state agencies. Then there is the skyrocketing number of mentally ill and homeless we now have that are living like animals in encampments. It has more than quadrupled in the past 7 years and I believe the numbers are north of 25,000 suffering from mental illness and drug addiction. I like to think I have an above average EQ and as I see what is happening to what was my beautiful city and area I have called home for 25 years it appears nothing short of changing laws and dumping hundreds of billions of dollars to train much larger numbers of psychiatrists and psychologists and mental health hospitals with thousands of beds. Could you explain how the cities you mention can have these drastically lower number of violent crimes while out here it is the total opposite? What are we missing because I think everyone like myself wants to know. Could you or would you be willing to look into this? Thank you

Thank you for sharing this with me, first let me say how sorry I am that your city is in crisis like this! And my own city Baltimore had serious issues with processing rape kits, poor investigatory practices and even unfounding sexual assault reports, this went on for almost 2 decades and took a major push to fix. And you are right officers are leaving the force and not being replaced. I find it disappointing to hear that the department did not prioritize the restaffing of the sexual assault victims unit. In relation to the drop in crime across country part of this can be explained by the spike in crime during the pandemic because people were isolated and the social services programs that assisted them were no longer easily accessible. Now that these important programs have been up and running in their communities I believe this has constributed to the beginning of this crime drop, which as you noted is ironic as we are losing officers. (On a side note, we must find a way to fundamentally change how police are trained and recruited because we do need good public safety and community policing and trust is not given it must be earned. But back to your original questions.) There are examples specific programs that I have seen work in different parts of the country and putting them together in your city could help. The Group Violence Reduction program is reducing gun violence in part of my city Baltimore and has had meaningful results in stopping gun violence and catching repeat violent offenders.. I think Eugene, Oregon has a program called CAHOOTS to send mental health professionals and social workers instead of cops to non violent mental health related calls thereby making it easier on officers to focus on crimes which genuinely need someone with a taser or gun. But these are just a few small examples of programs, you are not wrong your state and others may truly need to invest millions in mental health care and beds for those who need treatment. We had many more Mental Health Institutions in the US but many were shut down and dispersed starting in the 1980s, the reasons are complicated to explain here but the end result is less care for more people. But instead listing individual programs that may help your state it might be better to address this more broadly. Some of the issues you are describing are coming from a deeper issue which is I think is at least threefold. (And this is a gross oversimplification.) First would be underemployment and poverty, once you are evicted from your home even if you manage to keep working and living out of your car everything is starting to slip away from you and it is very difficult to get back on your feet without help. For example you can't save up enough money for first and last months rent and you don't have an address to have letters sent which makes employment or government assistance very difficult. (A non profit for women I used to volunteer for had P.O. boxes for women to get their mail, I had no idea how important this was.) There is a huge affordable housing crisis, I witnessed it in Denver, CO and it sounds like you may have a similar problem too. People are being priced out of middle income and lower income houses and apartments. One very small example of something that could help would be an inclusionary housing bill where no developers in your city/state can get any type of tax break unless they agree to make 10% to 20% of the units affordable by the standards of your average lower middle class income in your state.(That is just an example of how they could determine the median income and price the apartment as 1/4 of those wages.) They can offer special tax credits and benefits for developers who do this as well to sweeten the deal, for example they can do away with impact fees or give developers a PILOT.(But these tax subsidies like TIFs and PILOTs can be misused so you have to be watchful.) Your city and state have to make a concerted effort towards creating affordable housing, as a very great activist in my city Jeff Singer said about helping homeless people, the best thing you can do is give them a home, a roof over their heads and 4 walls that belong to them; everything will be made easier to repair in their lives from that point forward. Second part of this problem is mental health issues and substance abuse issues which we all know are inadequately treated and that unless your state and city makes a concerted effort to get people treatment this issue will not go away. Part of the problem with both of those first issues is that there is a sense that somehow the people dealing with these issues are some how undeserving of help, your fellow residents have to decide as a whole that it is worth telling your government to put some of your tax dollars towards lifting these folks up. Sure there are always a few people who might take advantage of help but for the thousands it could help and the health it could restore to your community I believe it is worth that chance. Third there is a serious issue with the influx of drugs into our country and I would have to write you an entire thesis paper to truly answer your questions properly on that issue. Wow, you have given me so much to think about and again I am so very sorry for what the people in your community are experiencing. And I certainly would never say I have the answers to these important questions but I do believe that there are answers, there are ways to fix these problems there are programs and practices that can work but a community needs to make the commitment of the time and the resources to make them work. A community has to decide that they want every single person to be housed and healthy and that is their primary goal, and you would think that should be easy to agree on, right? No one wants their neighbors to be unhoused, unemployed or unwell- right? (However there are folks who believe that people in these dire straits somehow deserve it because they didn't "try" hard enough-- but you can't "try" your way out of catastrophic medical debt or a disabling issue like untreated schizophrenia for example.)But there has to be the commitment from community leaders, activists and voters saying loudly to your politicians what you are doing is not working and we demand meaningful change. You have given me so much to think about and I will make a point to look into programs that are working in other cities that are helping with these issues and maybe try to find a way to talk about them. We need to give people hope that we can solve these problems and make our communities and our neighbors healthy. Thanks again -taya

What makes bad Policing possible, it starts with the Supreme Court. Good thing video doesn’t lie, since we know Police do, that needs to change, it needs to be a crime for the Police to lie and when they do lie, they need to be punished. Also, no more resigning or transferring while under investigation. If you commit the crime, your pension is on the line. Obviously abolishing Qualified Immunity as well. The Supreme Court could change Policing for the better, but they rather help support bad Police.

And having to listen to your story, it's completely heartbreaking! I remember going to the Kroger that was next to U.C. campus. I went there to buy medicine because I was sick. As coming out the store, I turned and spat. An officer harassed me saying that he could write me a ticket for that and what would happen if you walked in it and then walked into his house so that his kids can walk in the same spit... this is why we need to teach the younger generation about exactly what their laws are! Taya, will you consider covering the case against 19yo farm worker Aguilar-Mendez accused of murder when a cop dies of a heart attack after what clearly appears to have been an illegal arrest and vicious behavior by the St Johns county, Florida deputy. Mendez was declared incompetent to stand trial, only speaks Mam, an Aztec language, and has been held since May. Recently a motion was finally filed to dismiss.

Excellent point! When an officer sees a crime or at the very least misconduct in office being committed and chooses not to speak out, are they still a good cop? If they didn't do the harm, but they did nothing to stop it aren't they an accomplice in some sense? I think there need to be changes to state laws to insure a "duty to assist" if another officer sees one causing egregious harm or violating policy or committing a crime they must try and stop the situation and report it. Tried this in uk. Zero tolerance broken windows tough on crime etc always means targeting those who live in the poorest neighborhoods. Used to hear it all the time “ you are in a high crime area “ as a reason to stop you. Which basically meant you are discriminated against because you were not rich enough to live in one of the best neighborhoods. Therefore you have - are - or will be committing a crime. Poor training or the general dumbing down of training means that you are more likely to be arrested for littering than murdering your spouse!!!

When I was 16 I was coming home from a party at 3 in the morning and i was high and drunk and this cop pulled up to me got out of his car and grabbed me put me in handcuffs and said if you tell me you did not do it i am taking you to jail. I never had any Police contact and was really scared so i did not want to go to jail. I told him i did not do it but if i said i did you will let me go, The cop said yes and so i said i did it and he threw me in the car and arrested me. when I went to court the judge new me from caddying at a country club and said this case is last call. when my turn came up he said to the cop who was there I know this kid and he works all summer at the country club i belong to caddying everyone come to my chambers. when we got back there he said to me what happened so i told him what the cop told me and he looked at the cop and said is this true because this is a good kid and don`t you lie to me and the cop admitted it and the judge went off on him and dismissed the case.

OMG, incredible!!!! Thank GOD that the judge knew you or you could have been framed for something terrible. This is incredible and so representative of what has happened to other unfortunate young people! This has happened to many other innocent young people grabbed off the street and used to make an arrest. I saw 3 men finally exonerated after an officer tried to coerce them at age 16 and then lied that they committed a murder. They lost 36 years of their lives, I was there when they were let out of prison! Also, once an officer arrests someone for a crime it is considered "cleared" and so they include that in their statistics as their clearance rate. But their clearance rate is actually supposed to reflect crimes solved! The person who was arrested could be vindicated and released later and the case still would be considered cleared and the officer would get the credit. This creates a perverse incentive and so they say to themselves well if they really aren't guilty it will come out in court, not thinking about prosecutors stacking charges and pushing for plea deals for wins. This is so terrible!!! I am just so glad that judge gave him a dressing down and believed you and knew you!!! It breaks my heart thinking of what could have happened!!! -taya

What most people don't understand is that the majority of police are seeking retribution for the past aggression against them by their peers. They have almost always been the the teacher's pet or school rat that was sticking their nose in other people's business and were never able to make any friends cause nobody trusted them. Everyone is an enemy and they are always justified by their actions and never have to apologize for there mistakes.

@ 24:15. I somewhat agree Taya. The big problem with law enforcement started in the 60s with the creation of the qualified immunity test. Followed by the Terry V Ohio decision. It created the culture of "oh well the courts will sort it out". Then 9/11 started the militarization. We need to get back to community policing with officers being responsible for their mistakes.

I was just skimming through and saw your comment; it really touched my heart and let me know that I am doing the right thing! Sometimes, as I am sure you can imagine, this work becomes very disheartening. So many people need help, so many people have their lives ruined or worse, and so many never receive any justice or are made whole again. I can only hope that by the reporting I do and adding context I can help build consensus with all people, no matter what their race/creed/political affiliation to realize American policing has a problem and if we work together we can fix it! And the irony is, the FOP paid for Sgt Newberg's defense, he didn't spend one night in jail, he was allowed to work while he was charged and pull his full salary until he could retire, and then he pulled his full pension.
