I used to have to drive from Maine to New York every weekend. I always tried to stay in the center lane, that way you got two choices of where to go if you have to make emergency maneuvers. 5 miles under the speed limit is nothing, sometimes I had to do way lower. I remember people in their all wheel drive vehicles flying by me, only to come up on them again off the road, sometimes on their roof. Winter up north is treacherous

No it IS torture, it was -7c, in the wind it would have felt like -20c, and i am 100% sure that if he still said no after 20 minutes, they would go on to 30 minutes or longer, this is why people dislike and fear -police- pigs so much.

That’s on him. We yell at the top of our lungs - do not talk to cops. You stand there in that uncomfortable silence until they let you go. As long as you engage in the back and forth - you’re going to get rolled. He doesn’t have a case. He gave in. If he would have stopped talking after the pat down it would have been a totally different story.

@@karinaz8756 yeah if he was a bit more savvy he would have asked if he was being detained or if he was free to go, forcing the cops hand as the traffic stop was over. The cop has to either let him go, or double down to an illegal detainment. Then, upon the threat of a k9, instead of saying "go for it I have nothing in there", he asks again "am I detained or am I free to go? Because you are now extending the stop beyond its original scope which is illegal and unconstitutional". He did ok, I really hoped he was going to stand firm buy sadly he eventually folded, helped no doubt by the cop being a prick making him stand in the cold until he gave in.

Not only was it Harassment, this was a Civil Seizure/Civil Asset Forfeiture attempt. They’re looking for people traveling between states with Cash so they can steal the cash from unsuspecting victims. They typically pull out a Currency Dog to detect any Cash being carried,. They’ll 100% claim that the “dog hit” to gain access to the car. If any Cash is found during the illegal search, they’ll claim the cash either “hit” or “tested positive for Drug Residue” giving them permission to take said cash for profit to the department. If you come back to prove where you got the cash, you’ll likely end up paying court costs or lawyer fees which brings in money to the county/municipality.

This department is always being accused and taken to court for profiling blacks, So I'm sure it's more of a department leadership issue. I don't recall how they all have turned out, but I believe they most often find themselves free of any wrongdoing of course. I grew up in the area and was stopped by them a lot and never once had issues and was quickly released, but friends and cousins of a different color have often had complicated traffic stops like this. The problem has only gotten worse with time especially with the Mall of America being in the city and being a big hangout that occasionally turns into a battleground between different groups.

I have dealt with this my entire life. I believe my first harrassment by Law Forcement occurred with I was 8 or 9 (physical). When I look back on it, what grown man in a position of authority would physically assult an non-threatening boy? The United States will always be the United States. Nothing new to see here.

YOU teach people how to treat you. This cop wasn’t violent. The man was being profiled. CLEARLY. Sorry, this man should have stood his ground and said loud leaving no room for doubt - you do not have probable cause . I do not give consent to search my car. You’re asking for my consent because you don’t have probable cause. There is no probable cause but somehow this cop still thinks this man needs to “prove” himself.

@@snex000 I've had that happen to me. Been followed for a few miles. Through random lane changes so I knew the police was interested in my car. Finally I just pulled over and stopped and the cop stopped behind me for a full 15 minutes with his high beams on me (no flashers) and finally just pulled out and left. Completely bizarre. I have a completely clean record and at the time had never even had a traffic ticket yet. But they just decided to F with me that day over nothing. The plates would have come back spotless

I know man. I just feel like taking the next exit to go chill at a gas station for a few minutes but you can get a 6th sense they're going to light you up. This same type of traffic stop happened to me twice in rental cars too. Just invoke the 5th and 4th and just sit there and keep your mouth shut until they say have a good day.

Yes, and you can thank drug prohibition for that cruelty....since Nixon launched the War on drugs in 1971, the Supreme Court has eroded the 4th amendment on drug cases more than any other type of case....the smell of marijuana is the justification in the majority of warrantless vehicle searches....96% of no-knock raids claim to be looking for drugs.... Quite literally, drug prohibition has destroyed our rights, given more power to the police, and militarized the police more than any other policy in American history. More than half of all arrests involve drugs and the cops know that without drug prohibition they'd lose half their arrest numbers and therefore the justification for half of their budget. There's a reason why Police Unions have spent more than any other entity on opposing legislation and ballot initiatives aimed at drug law reform....because if drug prohibition goes, they'd lose their best excuse for fishing expeditions, most of their arrests, their excuse to over-police poor communities and communities of color, and their military hardware and egregious budgets. Drug prohibition has shaped modern policing more than anything else, and there cannot be meaningful police reform without addressing the absolute failure which is drug prohibition

Being as there was a very recent US Supreme Court decision dealing exactly with prolonging a traffic stop beyond the time of the original ticketing in order to delay for a search, which lackluster even mentioned here, this cop would lose. Rodriguez court case, he got like a pound of meth thrown out as evidence because he was made to wait 15 minutes after getting a ticket, with no RAS of further crime. This 20+ min delay after completion of the traffic stop thus wouldn't fall under qualified immunity because every cop in the country was already put on notice for the particular set of circumstances dealing with this in the Rodriguez case.

You are assuming that the driver did not have warmer clothing. Just as the driver may have assumed that his time outside the vehicle would be short. Remember that he did not want to exit the car and that there was no legitimate reason for him to do so. The NHTSA recommends that drivers travel slower in adverse conditions. Remember, whether they are able to pull you out of the car because of state law or not, the only reason they are doing this is to provoke, or create a circumstance to put handcuffs on you and arrest you. There is never a good reason for them to pull you out of the car, is only to put you in jail for anything they can trump up.

It’s case law from the Supreme Court that they have the right for “safety reasons” to pull you out of the car. So that’s country wide. Everyone should step out when asked. Like you said they’re hoping you don’t step out so they can go hands on and tag you with a charge.

It's best to politely inform them you don't answer questions without a lawyer present and then stay silent. If they tell you to get out of the car tell them you want to record everything on your phone, if they say no don't argue, get out and stay silent. They will most likely try to provoke a reaction, just repeat you don't talk without a lawyer present.

It isn't "no reason." It's meant to be due to the legal stop of a vehicle due to a witnessed crime or infraction. Only then can an officer escalate to a detainment.

@@post-leftluddite there is no law either prohibiting or allowing for police officers to order you out of your car. Thats why it went to the supreme court, because it sets a legal precedents . The difference is that is is not a law but a interpretation of a law's nuances. Therefore you cannot repeal a precedent as the court case cannot be retried. Also it is not 'undemocratically' decided, as the makers of that decision (and all judges) are ELECTED!

I've been profiled, and pulled over in the parking lot at my work. I used to live in a shady low income apartment. Cops pulled me over for a bogus reason, then asked to search my car. I knew I was clean, so I gave them consent to search. They tossed all my belongings around and made a total mess of my car and trunk. They pulled the carpets up and completely trashed it. They were 100% disrespectful of me and my property. They finally let me go when they realized they were fishing up the wrong creek. I'll never give concent to search my car ever again after being disrespected like that. Cops are worse to your belongings than an unsupervised toddler on a sugar high.

Yep. It's an unreasonable extension of the stop, and despite the cop saying it wasn't, there's a very strong case for coercion as well. Even if the cop had found incriminating evidence, it should have been thrown out of court. Not that it necessarily would have been, because the courts can be corrupt too.

Sadly, he was already being detained at that point because the officer held on to his license. He used his license to force him out of the car. Ricky should have asked for his license after not being written up. But, people think being nice to officers will get them better treatment. But we see here, that officers can and will racially profile you based on nothing and will use your nice behavior as means to violate your rights. As long as the officer is holding on to that license, it is a detainment.

@@deemcclanahan He was being detained the moment the officer indicated he needed to pull over. And regardless of whether the officer had his licence or not, if he felt he couldn't leave the stop, the detainment continued. Whether the detainment was valid is another question entirely. I'd argue that based on the evidence the cop provided, it wasn't. It might even be argued that given how long this detainment lasted, it became a de-facto arrest. A good lawyer and an honest judge could make this cop's life hell because of this one incident. And honestly, I think the cop would deserve every bit of it.

The biggest problem with police is that they think asserting your rights is being uncooperative. Never say, "go ahead" when they threaten you with the dog because you are inadvertently consenting to a search.

If the police ask for a consensual search and you refuse, then inform you of the K-9 being called, you can bet you’re going to get a search of your vehicle. The K-9 officer has been clued onto the scam and the dog will “hit” on your vehicle automatically. Since it’s the handlers word against yours they will search you.

Lootus No. Penn V Mimms suggests that officer safety or safety of the public are reasons why they green lit officers ordering a person out of a car- or into it. It does not require officers have a specific reason nor that they be able to articulate it in court.

Here's my advice for what it's worth...whenever an officer asks you to step out of your car, let them know if they pull you out of your car you will not say another until word until you see them in court when you sue them. Remain silent, wait out the clock limit for a reasonable traffic stop and go on your way.

He needs to ask "am I free to go" those are the magic words. I think the police are obviously profiling him, but they are not obligated to tell him he's free to go unless they are asked. Until he asks " am I free to go" it's considered a consensual encounter. Just knowing your rights these days isn't enough, you have to know how to enforce them.
