Well I dare to oppose with "mailing yourself the music situation" - I think it was very much working thing back in a days because it in fact prove that you created music before mailing date but you could NEVER OPEN THE ENVELOPE.. the opening would happen only if you would get in court with that music because of copyright infrigement... it can be actually used in these days.. E-mailing yourself music in mp3 format so it can be played and dowloaded instatly anytime in the future or even mailing yourself session from your DAW!!! its always better proof than none

so as you are saying it doesnt prove when music was created- we dont need the exact day when it was created, we just need SOME date to hold on to- obviously music was created before post mark.. can other side in court prove that they have any sooner date ? and thats the point

I'm so glad I found this video. I have some fools who are trying to steal my music at this moment laying claim to them. I copyright my songs that were released on an album in 1980, they are now in 2016 trying to lay claim to these songs. Thanks so much for your video.

If you look at the Splice terms of service it says you own the composition, but not the Copyright*** So if a producer is using samples from Splice and many of them are they may be distributing parts of a song they don't own the rights to. The loops and samples are creating a lot of problems with copyright and I think there will be a lot more in the future being that so many people are buying loop packs and downloading chord progressions from the same places... even DAW'S and places that are royalty free- it's causing mass confusion.

Your not too bright are you?? Just because this lawyer says that it can be proven with the timestamp off the computer or pro tools, does not cover everything. The "poor mans copyright" was made to show an approximate time the works was competed, because someone could just say they wrote your song on a certain date and you might have to prove different. Lets say someone says they wrote your song on January of 1990, then you say no i wrote that song in Feb of 1985. Then you pull out that "poor mans copyright" with the date from the postal service stamps on the UN-opened envelope with Feb of 1985 on it, and woollaa you got them. Now, i never wrote my song with a computer or pro-tools i wrote, played guitar, sang and recorded my song on a portable tape recorder..get what i am saying...not everyone writes there songs on a computer or pro-tools where there are timestamps....so the postal time stamp (poor mans copyright) is the equivalent to a computer or pro tools timestamp. So your lawyer is not exactly right as he thinks he is. I been copyrighting songs for over 40 years, and believe me i do a "poor mans copyright" as soon as i complete a song and i even use pro-tools, i don't care i am not taking a chance because there are people that will do anything to steal your songs believe me!

hi i have a question, i'm a music composer i create my own music i have my music sessions and everything how do i prove that i'm the owner of my songs without any document that can say "yes i'm the owner of this song" do i have to register them on the isa copyright office or not?.. i know you're saying is not necessary in the video but what if someone steal my song and i says "i'm the owner" how can i prove that i'm the creator of the whole arraignment and not them

Ok so I'm dealing with a copyright infringement situation right now. I released a song that i produced and performed in along with two other artists about 10 years ago, song did extremely well and is still a hit among our subculture of music. Recently i found out that song got released on Spotify, apple and other streaming services about 3 months ago. The Artist Name is Similar or Identical to the Artist i worked with. This Artist Uploaded the song as his and gives no credit to me or the other artist. The guy in question had nothing to do with our music but is getting paid off our song just because his name is identical. All youtube streams Spotify, apple are licensed to a label i have never heard about. This guy is flat out stealing the song claiming it as his. So i have a few questions. I never registered the song with the copyright office. Who owns copyright if i made the beat, performed in the song with two other artists? Do all 3 of us own copyright? If i can't get in touch with the two other artists can i copyright it by myself? It's been 10 years since release, if i register the work now will it hold weight in court? How do i go about taking this guy down and getting all my rights and royalties so i don't have copyright strikes on my own song? This song has millions of views on KZbin and the spotify in question has about 130.000 streams in 3 months and counting.

Thank you much for this. I am a professional musician 65 years old. I do copyright my music before I release it but I was telling a friend of mine in the studio, a few days back, that my songs are protected once I record them and there's a time stamp on it that gives the creative date proving me correct. Thank you for the additional info on the legalities of all this without having to pay legal fees. LOL

False information. You do not have 3 months after music is published to copyright with the Library of Congress! You must copyright before you publish your music. Otherwise you'll have to copyright each song individually.

Anyone can change the date on a computer, hence the record date. Wouldn't a you-tube upload be better? It does have to be video but a static pic of the writer would even help, with overlay-ed text stating this song was written by ______ your name.

The sooner the copyright, the better. The only drawback is that many people, like myself, want to get a bunch of songs done in order to copyright them all at once for a single fee, as opposed to paying for every individual song. Then you're going to have one song laying around for a while as you come up with 9 more. And if you're copywriting the performance as well as the composition, it's going to take a bit longer because you want to do a perfect job on the recordings. Also, very important, keep in mind that the rules have changed today and that you cannot copyright an unlimited number of songs all at once. Now you can only copyright 10 items at once, and one of those items has to be the overall title of your work. In other words, the title plus 9 songs, so technically you're only getting 9 in that bundle. There are a few tricks to get around that, such as sticking a couple songs together and copywriting them as a medley. I just submitted a copyright for 16 songs. I had no choice but to do it twice and pay double the fee. I did the first eight songs and then the second eight songs. And yes, I've hidden all of this stuff from everyone on the entire planet prior to submitting to the copyright office. Seriously, don't even let your friends hear any of this stuff until you've submitted it. Because they could borrow from it without even consciously realizing that they're doing it.

I really appreciate the extra info you've provided. Do you know if the fee has been increased? I just recently went to Copywrite.gov & noticed that it's $45 now instead of $35 like most of these videos have mentioned. I do realize that alot of these videos are a couple of years old though.

This video is old but GOLD! He is right about everything especially about the mailing your music to yourself which still makes me laugh till this day. With all of that said, Yes your music is technically copywritten from the time you export. However, it is easier to prove the works belongs to you if you already have it copywritten and No just because you register with a (PRO) like BMI or Ascap does NOT mean you're music is copy written. Keep in mind that having your music copy written before its stolen is ideal for the simple fact attorney fees are so high if you copy written your music after it was stolen by the time you win in court and pay back attorney fees you'd be lucky to break even depending on the individual circumstance that is. You can copyright up to 135 songs/beats for $35. =-) @ www.copyright.gov Hope this helps someone. God bless.

Also for beatmakers, if a Client purchases a beat from you and then changes the name of the beat to whatever his/her title of their song, you get around that by simply using websites like Tunecore, you can pay for options that allow any music using your instrumental be detected. Once detected on KZbin and other services you will be paid revenue!

You're correct about poor man's copyright being bunk, and its glaring issue. But very wrong about the 'timestamped file' alternate method of proof. The timestamp on a file is based on the computer's clock at the time of saving, so it's extremely easy to back-date the timestamp on a file, just by changing your computer's clock date before saving it. This falls into the same trap as the envelope method, of being extremely falsifiable. What gets around this issue, is having uploaded the material to an external service, like cloud storage, or a video/music website, where the user has no control to manipulate the date backwards in time. As long as the file remains there, one would think it stands as proof of creation/release date - barring accusations of 'someone on the inside' at those companies {Google, KZbin, etc...} manipulating the date in your favor. Probably should update your video or add some kind of notice, to reflect this. That piece of 'timestamp' advice was severely flawed.

I usually make two copies of my lyrics/poems or whatever and then go to my local court house and get both copies notarize for free and then go to the post office and mail one copy to myself. That insures that my lyrics and envelope are dated. And its also good to put your music on a junk drive, dated and label for extra extra backup.

All of that is unnecessary. Bro, all you have to do is put your Name, the Year it was created and a Copyright Symbol. here's an example and you will see this on all of my work on my Channel: Written, Recorded and Produced by: Michael Barletto ©2021. To create the Copyright Symbol press Alt 0169. I'm a member of ASCAP believe me.

I always purchase a "Commercial Rights," with stems package. I want to monetize my music. What do you know about commercial rights? Do I register performance rights as well as publishing rights? Is this the same as work-for-hire? Do I own 100% of my songs? .............Okay I had a few questions lol Anything you can share on this subject is greatly appreciated!!

ITS NOW BEING RELEASED BY ARTISTS AND COMPANIES WORLD WIDE. I NEVER GAVE THE ORIGINAL GUY PERMISSION TO RECORD OR SHARE IT AND HE DODGED ME FOR 20 YRS, RELEASED DEROGATORY SONGS WITH THE NICK NAME HE CALLED ME IN IT. AN GAVE THE TRACK TO ANOTHER ARTIST WHO NOW HAS A DEAL AND RELEASED IT A MONTH AGO. SO NOW THAT THE ORIGINAL GUY IS ANGRY WITH THE ONE WHO GOT THE DEAL , HE CONTACTS ME, TELLS ME HE REGISTERED THE SONG 3 YEARS AGO ( WHICH I DOUBT) SO HE IS GOING TO TAKE THE GUY TO COURT ( THOUGH HE GAVE HIM THE MUSIC) HE TOLD ME THE SONG IS LEGALLY HIS BECAUSE HE TOOK MY VOCAL AND PUT MUSIC TO IT AND CLAIMS PUBLISHING FOR IT..... ASKED ME TO SIGN A CONTRACT FOR US TO SPLIT PUBLISHING RIGHTS 50/50 SO WE CAN GET ROYALTIES AND SAYS I SHOULD THANK HIM FOR RELEASING IT AND MAKING THAT OFFER BECAUSE HE OWES ME NOTHING BECAUSE HE PUBLISHED IT FIRST. Very correct and accurate video. However I do suggest copy writing as a sound recording because even though the entire song as a whole may be protected people can still sample or still excerpts from the song which would not be protected unless you have the sound recording Copywrites. Correct me if I’m wrong.

What's the difference between copyright, and publishing? Second, if I write all of the lyrics to a song, and the producer produces all of the music, how much pubishing do we each have? Is it 50/50 publishing, or 100% each?

As a music producer who released an album with different artists on my beats, as in I pay to record the songs, pay to mix and master and distribute. Who owns the copyright to the songs?

Will someone please answer this question? my girlfriend insist that in order to copyright an album I released back in 1980 I HAVE to send them a copy of the album and case or even the master tape which is ridiculous in my thinking. I filled out the paperwork and paid the copyright office in 80 when I copyrighted this album but now they say it isn't there, of course. Any help, thanks.

You answered your own question. The answer is No because they don't have (Full rights) Also this can vary from producer to producer and would be stated in your license agreement upon purchasing the "instrumentals". Hope this helps. God bless.

gstreet Blak yes u can... of course u can.theres many sites that does copyrights for a fee that gives you the option and ask u what have u created.for example whose the instrumental by?who wrote the lyrics?in some cases alot of people rap over industry beats which that option can be left blank.check song registration on the internet,people who see u COPYRIGHT ya music from that site would think twice from stealing material from anybody

Just because this lawyer says that it can be proven with the timestamp off the computer or pro tools, does not cover everything. The "poor mans copyright" was made to show an approximate time the works was competed, because someone could just say they wrote your song on a certain date and you might have to prove different. Lets say someone says they wrote your song on January of 1990, then you say no i wrote that song in Feb of 1985. Then you pull out that "poor mans copyright" with the date from the postal service stamps on the UN-opened envelope with Feb of 1985 on it, and woollaa you got them. Now, i never wrote my song with a computer or pro-tools i wrote, played guitar, sang and recorded my song on a portable tape recorder..get what i am saying...not everyone writes there songs on a computer or pro-tools where there are timestamps....so the postal time stamp (poor mans copyright) is the equivalent to a computer or pro tools timestamp. So your lawyer is not exactly right as he thinks he is. I been copyrighting songs for over 40 years, and believe me i do a "poor mans copyright" as soon as i complete a song and i even use pro-tools, i don't care i am not taking a chance because there are people that will do anything to steal your songs believe me!

Useful advice. However I don't think a computer date-stamp is is a strong enough evidence for making a claim, simply because computer date-stamp can be easily altered!

Did I get it right? Someone has stolen my music and put it on a show/film/media...I need to copyright that music max. 3 month after it was used somewhere, so I can sue? If yes, what happens if I only realised after that 3 month period...thank you in advance! :)

Thing is, you gotta upload it somewhere public where the date can not be changed. Because on a pc, you can change the time/date configuration to make it export in 1994 if you'd like lol. It doesn't prove shit.

I tried downloading music to burn on a cd for my personal use,but I can,t,them big money bands like ozzie Osborn,fleetwood mac and other bands that came out in the 70,s and 80,s must have spent there millions on alcohol and woman because they don't want anybody copying there music anymore.because I hav,nt been able to copy any on a cd.lately.i guess they could,nt live off of 50 million dollars all there life.the bums

I have ℗ by the label amuse but Someone has used my instrumental of my song & there saying they have contract alienation giving them all the rights. I had it published on August 4 & released on August 8 while the person released it on Nov 15. So how does it work?

Its simple if people says they own the music you make. Just ask them if they have the raw file of it. If they don't then it doesn't belong to them :)

Hello, I recorded 8 original blues tracks the lyrics were all new but standard 12 bar blues stuff After a few months I had decided to re do the drum tracks we were able to isolate and remove the tracks and I had them replayed now the original drummer is threatening to sue me for destroying his drum tracks. He has no investment in the CD and is no longer my working drummer he claims by removing his drum parts I have violated his copyright.

I have been ordered to change the music in my video of me playing my own composition. The video has been muted by tic toc with a list of alternative tracks. I have a feeling someone is going to steal my music as first videos had good results before the uploads were removed from audiences stopping at time my composition was flagged as copywrit apparently not yet released in my country. I’m not in America, do I still need to register it ?
