Lawyers charge unacceptable prices for this process. At the end, they only put together your application, and they repit what is in the USCIS requirements are. You are the one who has to provide the documents and do the endeavour. It does not justify paying 15,000 dollars to a person who just puts together your papers. It took me 2 months and 20 days to do all the processes by myself, I read more than 40 times the whole EB2 NIW requirements and forms, and I watched Oscar videos and his website. Hi Elisabeth, only you have to apply for the I-140 step and then each one of you have to send an adjustment of status I-485 if you are in US or do consular processing if abroad.

Hi Elizabeth! It is hard to tell without seeing the full profile, and even then, it would just be my personal opinion (I am not a lawyer). You should read the requirements carefully and decide ( eb2niw.info/2022/06/16/how-to-qualify-for-national-interest-waiver/ ). Technically, if you already have a good case, you may not need to wait. Hi there! The USCIS website says that only checks or money orders from US banks are accepted. For applications from abroad they ask to contact your local consulate to ask specifics to your country.

Hi Oscar, I think the fee on lawyers is taking into consideration the "standard" case, as a STEM professional I can tell you most lawyers refused to take my case and the ones willing to do it are charging 14k (big name) starting price and I was also asked till 25k! If you know any STEM professionals who got around a quotation around 7k , do you mind sharing the lawyer's names? I did a careful due diligence so far and it looks like adding also premium processing we go close to ~20k even with the cheapest options. Let me know! Btw, I am a HUGE supporter! I have your classes and your case as examples (problem I work 12 h average per day LOL) but I lack the time to build it myself :(

Hello Oscar. Do you think that I would have any chance having no master or PHD, only the graduation? I graduated 6 years ago, and I have 10 years of experience in the field (only 6 as engineer, ofcourse, but I was doing technical work in the field before the diploma). The years of experience is just one part of the requirements so it is impossible to know only with that info. Oscar the fees in the second stage of the process for people abroad like me is 565$ using the form DS-260 + medical examination + biometrics. For 140 is just the 700$ + mailing fees. The attorneys has many different fees from 5.000 to 18.000 at least in Latin America. There are others in the range from 20.000 to 30.000. Attorneys only gives you guidance and support. We have to do the 90% of the task. I'd say the benefit hiring a firm would be responding RFEs or NOID. I'm collecting all the info and documentation needed to do it myself but it's a long road.

Hi, you are right Gil. The Consular fees are a total of 565. In the table shown in the video I only have the $345 for Consular Processing fee, but then you would need to pay another $220 (USCIS Immigrant fee) to cover the cost of producing the card. That adds up to $565. Unfortunately, I cannot modify the videos once uploaded so I could only add a comment in the description (I did that a couple of weeks ago). The info was added to the website too. Once I make an updated video for costs or I make a specific one for consular processing, I will add that. And yes... the cost for attorney are very variable. That's why I say it really depends who you go with, if you choose to use lawyers. Like you said, even if you choose that route you will have to do most of the work yourself with the exception of drafting the cover letter, as they typically include that (but again, it may vary case to case). Yes, it is a long road indeed. But if you are diligent and patient you can break it down to smaller steps and eventually you will gather everything you need. Good luck!!

Hi there,this category of green card doesn't require company sponsorship. So these are the total costs, typically paid by you the petitioner. If your company is willing to reimburse you for the fees that would be great, but it's not typical.

You are correct, biometric and medical fees are per person, as well the consular fee. The biometrics fee in only for adjustment of status. I just realized that I missed one other fee that applies to Consular Processing: after all the process is finalized and you are approved, you will need to pay an "Immigrant Fee" ($220) that can be paid before or after arrival to the US and covers the cost of producing the actual Green Card.

Hi Pilar. I can't recommend because I had a US degree and I didn't need to do it. But two organizations I heard about are WES and IEE. You would need an overall equivalency of your highest degree .

Great to see this explained from another scientist from Europe in the Boston area who went through all of this. Thinking about the same path to attempt EB-2 NIW while waiting for the slow EB-1B process - just as a backup. Am I correct to understand that if we go without a lawyer, the initial financial risk of this parallel route is only about $700? (= the cost before the i-140) And additional $2300 if we decide to follow through with the status change with EB-2

Hi Maximilian, that is correct. In fact it is exactly what I did. I was waiting for the lawyers to submit the EB-1B and I went ahead and did my own EB2 NIW. I have a video about that story. The financial risk, as you said, is only $700 and the remaining amount only applies if you decide to adjust the status on that petition; if not that is the end of the story. An additional benefit is that it gives you one more chance in a lower priority (theoretically easier) category and it is owned entirely by you and not a company. If you decide to go that route you can check out my own petition in eb2niw.info. In any case I wish you good luck with your green card(s)!

Hola Clandestino. Yo no soy abogado así que antes de proceder deberías consultar uno para estar 100% seguro. Según yo entiendo, puedes enviar otra I-140 sin problema después del rechazo pero es una petición nueva y has de pagar las fees otra vez. Respecto a la segunda pregunta, la I-140 hoy en día no se puede presentar en un consulado o embajada , tiene que enviarse a USA aunque solicites desde fuera. Saludos

Hi Elisabeth. You can choose either option. You can either do it at same time or first apply for I-140 and once you get the answer proceed with I-485 (adjustment of status). It is up to you what to choose. Financially, it may be less risky to do it one after the other because I-140 is cheaper, but doing it at the same time may save processing time. Hi Daya, Thanks for watching. as I say in the video, you do not need a lawyer in this green card category. If you choose to do it with a lawyer you can expect to pay around 5,000 dollars,but the range is quite big depending on which firm you choose. Some may charge well over 10,000 US dollars.

Hola Steven! Gracias por tus palabras! Respecto a 1) por desgracia no puedo decirte demasiado, puesto que no conozco tu campo...te recomiendo que consultes con calma porque es algo muy importante. En algunas ocupaciones hace falta tener algún tipo de certificación o convalidación (si no me equivoco, medicina es uno de ellos). Como parte del proceso EB2 NIW sí necesitas hacer una evaluación de tus credenciales (por lo menos el título más elevado que tengas) para establecer equivalencia con un título de EEUU. Respecto a 2) sí que puedes incluír a tu esposa en la petición I-140 y luego ella, de serte aprobada, puede también recibir la green card y trabajar en Estados Unidos. Sólo es necesario que una persona sea el peticionario principal pero luego los dependientes recibirían también la green card. Saludos y suerte!

Cuándo te aprueban la green card a través de proceso consular te estampan un visado en el pasaporte y allí pone la fecha de caducidad. Una vez dentro de EEUU te envían la tarjeta.
