It seems that most people debating this case are not talking about the legal principle of retrospective effect. The 2016 constitutional amendment cannot be applied backwards, that's were the error was made.

We have had enough of this ECL eligibility case. We have heard recycled arguments over and over. The judges have delivered to Zambians their decision. I believe this is final. Every individual has their own opinion. You can argue endlessly on this case leading to nowhere. Can all these TV houses leave this case and give us different topics that matter in building the economy destroyed by PF?

Given Lubenda is always misleading in terms of the way he comes out remember the issues of Bill 10,the issue of Mps who over stayed in office and now supporting what he himself knows very well that the constitution which ashard ECL into office was the 1991 constitution which states that twice elected and twice sworn in that's all now why does he want the court to decide that ECL is eligible based on the constitution which he signed after becoming president ?

The Danger is that in Zambia at the moment Judges are now writing the Law that power only belongs to parliament .... They acted unconstitutional irregardless of the reason because there is no constitutional provision for departure from past decisions so in short the constitutional Court became the legislator the right decision was to recommend to parliament to change the constitution to add that provision that was the issue with roe VS wade what happened recently was the court saying it was not supposed to happen because it was unconstitutional that's why for decades it was a thorn in the courts because they where unconstitutional ... I am not even a legal guy and I don't belong to any party Lubinda is right these guys fumbled. they should have recommended first parliament to change the law to allow them to go back and change the mistake they made if truly they made a mistake the first 4 times

Your chain of thought gets flawed when you say there's no constitutional provision for a court to change it's decision. There's no constitutional framework that explicitly says a court can never change it's previous position. Absolutely none. And if we're being honest Lungu and Co dribbled the whole country in 2021same way they have been dribbled by the current administration now.... It just didn't workout at the polls.
